RESOLUTION NO. 2012-983
RESOLUTION GRANTING REQUEST OF CUNNINGHAM
CONSTRUCTION, FOR VARIANCE TO NOISE ORDINANCE,
ORDINANCE NO. 3094.
WHEREAS, Cunningham Construction is requesting a variance to
the Noise Ordinance to allow new pavement to be saw cut by the
contractor along Donald Street from Highway 63 to Mildred Street
until completion of project estimated for spring of 2013 in
conjunction with the F.Y. 2012 East Donald Street Improvements,
Contract No. 797, and
WHEREAS, said work will exceed the limits of the Noise
Ordinance, Ordinance No. 3094, and
WHEREAS, said Cunningham Construction has made formal
application for a variance until completion of project estimated
for spring of 2013.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the request of Cunningham Construction, for
a variance to Ordinance No. 3094, Noise Ordinance, to allow new
pavement to be saw cut by the contractor along Donald Street from
Highway 63 to Mildred Street until completion of project
estimated for spring of 2013 in conjunction with the F.Y. 2012
East Donald Street Improvements, Contract No. 797, be and the
same hereby granted.
PASSED AND ADOPTED this 8th da of October, 2012.
