RESOLUTION NO. 2025-478
RESOLUTION APPROVING A REQUEST BY CLAUDE L. MANNING AND ROSE M. MANNING FOR AN ENCROACHMENT AGREEMENT TO ALLOW FOR A FENCE ON CITY-OWNED RIGHT-OF-WAY IN THE “R-2” ONE- AND TWO-FAMILY
RESIDENCE DISTRICT LOCATED SOUTH OF 806 CLOVERDALE AVENUE ON LUCAS STREET.
WHEREAS Claude L. Manning and Rose M. Manning have requested an Encroachment Agreement to permit the installation of a fence on City-owned right-of-way located south of 806 Cloverdale
Avenue on Lucas Street; and
WHEREAS, the property is located within the “R-2” One- and Two-Family Residence District, and the proposed fence is intended to enhance the privacy and security of the Manning's property;
and
WHEREAS, the City staff has reviewed the encroachment request and determined it will not interfere with public use or future municipal needs and is therefore deemed to be in the public
interest; and
WHEREAS, the approval of this Encroachment Agreement is subject to the compliance with any and all applicable City codes and regulations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that:
1. The request by Claude L. Manning and Rose M. Manning for an Encroachment Agreement to allow for a fence on the City-owned right-of-way located south of 806 Cloverdale Avenue on Lucas
Street is hereby denied.
