RESOLUTION NO. 2025-639 RESOLUTION APPROVING A SECOND AMENDMENT TO THE DEVELOPMENT AGREEMENT WITH DEBRA KAY HODGES HARMON, ORIGINALLY EXECUTED DECEMBER 7, 2020, CONCERNING THE REHABILITATION OF 1644 LOGAN AVENUE TO EXTEND THE TIMELINE OF COMPLETION TO DECEMBER 31, 2025, AND REMOVE A REQUIREMENT FOR FENCING, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT. WHEREAS the City of Waterloo, Iowa and Debra Kay Hodges Harmon entered into a Development Agreement dated December 7, 2020, for the rehabilitation of the property located at 1644 Logan Avenue, and WHEREAS, the Agreement was previously amended August 1, 2022, and the parties now desire to further amend certain terms of the Agreement; and WHEREAS, the Developer has requested to extend the timeline for substantial completion of the rehabilitation work for the Property to December 31, 2025, and remove a requirement for fencing at the Property; and WHEREAS, City staff has reviewed the request and recommends approval of a second amendment to accommodate the revised construction schedule and to remove the fencing requirement, while leaving all remaining terms and conditions of the Agreement in full force and effect; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that: 1. The Second Amendment to the Development Agreement with Debra Kay Hodges Harmon, is hereby approved, extending the completion deadline for the home located at 1644 Logan Avenue to December 31, 2025, and removing the fencing requirement. 2. The Mayor and City Clerk are authorized and directed to execute said documents on behalf of the City of Waterloo, Iowa.
