SECOND AMENDMENT TO
DEVELOPMENT AGREEMENT
This Second Amendment to Development Agreement (the "Second Amendment") is
entered into as of embe( 3 , 2025 by and between the City of Waterloo,
Iowa ("City") and Debra Kay Hodges Harmon ("Developer").
RECITALS
A. WHEREAS, Developer and City are parties to that certain Development
Agreement dated as December 7, 2020, amended August 1, 2022 (collectively, the "D.A.")
concerning the rehabilitation of property at 1644 Logan Avenue, as further described in the
Agreement.
B. WHEREAS, the parties desire to enter into this Second Amendment to the
Agreement to amend or modify the D.A. as specifically set forth below.
NOW, THEREFORE, in consideration of the premises and of other consideration, the
receipt and sufficiency of which is hereby acknowledged, the parties hereby agree to amend the
D.A. as follows:
1. The deadline to complete the Improvements shall be December 31, 2025.
2. Any obligation imposed on Developer to construct or erect a fence on the Property
is hereby deleted and removed. The Developer shall not have an obligation to construct or erect
a fence on the Property.
3. Except as amended herein, the D.A. shall continue unmodified in full force and
effect. Terms capitalized in this Amendment but not defined herein shall have the meaning
ascribed to them in the D.A.. This Second Amendment is binding on the parties and the
respective successors, assigns, transferees and legal representatives of each. This Second
Amendment may be executed in counterparts, each of which shall be deemed an original and
all of which, when taken together, shall constitute a single instrument.
IN WITNESS WHEREOF, the parties have executed this Second Amendment to
Development Agreement and as of the date first set forth above.
