RESOLUTION NO. 2025-630 RESOLUTION AFFIRMING PREVIOUS DETERMINATION OF AN AREA OF THE CITY TO BE AN AREA OF SLUM AND BLIGHT AND AN ECONOMIC DEVELOPMENT AREA, DETERMINING THAT THE DEVELOPMENT OR REDEVELOPMENT OF SAID AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY OR WELFARE, DESIGNATING SAID AREA AS APPROPRIATE FOR URBAN RENEWAL PROJECTS, AND APPROVING AND ADOPTING AN AMENDMENT TO THE DOWNTOWN WATERLOO RIVERFRONT URBAN RENEWAL AND REDEVELOPMENT PLAN. WHEREAS upon finding and determining that certain areas located within the City are eligible and should be designated as an urban renewal area, under Iowa law on December 23, 1974, the City Council of the City of Waterloo, Iowa (the "City") adopted Ordinance No. 2723 which was amended by Resolution No. 1996-804, adopted December 16, 1996, amended by Resolution No. 2001-394, adopted on August 6, 2001, amended by Resolution No. 2003-225, adopted on April 7, 2003, amended by Resolution No. 2011-1109, adopted December 5, 2011, amended by Resolution No. 2014-966, adopted November 10, 2014, amended by Resolution No. 2015-632, adopted August 10, 2015, and amended by Resolution No. 2017-772, adopted September 18, 2017, approved and adopted the Downtown Waterloo Riverfront Urban Renewal and Redevelopment Plan of the City of Waterloo Iowa (the "Plan") for the urban renewal area described as set forth in the Plan, and its amendments. WHEREAS, a proposed 2025 Expansion Area Amendment to the Plan has been prepared, which is on file in the office of the City Clerk, and which is incorporated herein by reference, the purpose of which is to amend the Plan to include one or more additional urban renewal projects, to update related financial information, and also to set forth and include within the Plan additional land described as follows: Beginning at the intersection of the centerline of Southbound Washington Street as now located (also known as U.S. Highway 218) and the centerline of W. 4th Street, thence Southwesterly along the centerline of W. 4th Street to a point that would intersect a Northwesterly extension of the Southwest line of the public alley as platted in Block 31 of the Original Plat of Waterloo West of the Cedar River, thence Southeasterly along said Northwesterly extension of the Southwest line of said alley, and Southeasterly along the Southwest line of said alley, and Southeasterly along a Southeasterly extension of the Southwest line of said alley to the centerline of W. 5th Street, thence Northeasterly along the centerline of W. 5th Street to the centerline of Southbound Washington Street, thence Northwesterly along the centerline of Southbound Washington Street to the point of beginning. WHEREAS, the property proposed to be added by the proposed 2025 Expansion Area Amendment is legally described in the Amendment and above, and this Council has reasonable cause to believe that said Area satisfies the eligibility criteria for designation as an urban renewal area under Iowa law; and WHEREAS, it is desirable that the property to be added by the proposed 2025 Expansion Area Amendment be redeveloped as part of the overall redevelopment covered by or stated in the Plan; WHEREAS, Iowa statutes require the City Council to submit the proposed 2025 Expansion Area Amendment to the Planning and Zoning Commission of the City for review and Docusign Envelope ID: DA39AF30-5238-4302-A798-AC1707986064 Resolution 2025-630 Page 2 recommendation as to its conformity with the general plan for development of the City as a whole, prior to City Council approval thereof, WHEREAS, adoption of the proposed 2025 Expansion Area Amendment has been approved by said Commission as being in conformity with the general plan for development of the City as a whole, as evidenced by its written report and recommendation filed with the Council, which report and recommendation is hereby accepted, approved in all respects and incorporated herein by this reference; and WHEREAS, pursuant to Resolution No. 2025-550, a consultation was held with the designated representatives of all affected taxing entities to discuss the proposed 2025 Expansion Area Amendment and the division of revenue described therein, and that notice of said consultation and a copy of the proposed 2025 Expansion Area Amendment was sent to all affected taxing entities, all required responses to the recommendations made by the affected taxing entities, if any, have been timely made; and WHEREAS, pursuant to Resolution No. 2025-550, this Council also set a public hearing on the adoption of the proposed 2025 Expansion Area Amendment to the Plan and for this meeting of the Council, and due proper notice of said public hearing was given, as provided by law, by timely publication in the "Waterloo Courier", which notice set forth the time and place for this hearing and the nature and purpose thereof; and WHEREAS, in accordance with said notice, all persons or organizations desiring to be heard on said the proposed 2025 Expansion Area Amendment, both for and against, have been given an opportunity to be heard with respect thereto, and due to consideration has been given to all comments and view expressed to the Council in connection therewith, and said public hearing has been closed. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That the findings and conclusions set forth or contained in the Plan and the proposed 2025 Expansion Area Amendment concerning an area of the City of Waterloo, Iowa, described in the Plan, its amendments, the proposed 2025 Expansion Area No and the preamble hereof, be and the same are hereby ratified and confirmed in all respects as the findings of this Council. Section 2. This Council further finds: a. That the Plan Area and the 2025 Expansion Area is an economic development area within the meaning of Iowa Code Chapter 403 that is appropriate for urban renewal activities and projects; that such area is eligible for designation as an urban renewal area and otherwise meets all requisites under the provisions of Iowa Code Chapter 403; and that the rehabilitation, conservation, redevelopment, development, or a combination thereof, of such area is necessary in the interest of the public health, safety, or welfare of the residents of this City; and b. The Plan conforms to the general plan for the development of the City as a whole; and c. Although is relocation is not expected, a feasible method exists for the location of families who will be displaced from the Plan area into decent, safe and sanitary dwelling accommodations within their means and without undue hardship to such families. Section 3. That the proposed 2025 Expansion Area Amendment of the Downtown Waterloo Riverfront Urban Renewal and Redevelopment Plan of the City of Waterloo, Iowa, which is incorporated herein by reference, be and the same is hereby approved and adopted as the "2025 Expansion Area Amendment", that said 2025 Expansion Area Amendment is hereby in all respects approved; and that the City Clerk is hereby directed to file a certified copy of said Plan with the proceedings of this meeting. That the 2025 Expansion Area Amendment shall be in full force and effect from the date of this Resolution until the later of the date of termination set forth in the Plan, or the date on which payment of all obligations issued or advances made to carry out the purposes thereof shall be fully provided for. Said Plan shall be forthwith certified by the City Clerk, along with a copy of this Resolution, to the Recorder for Black Hawk County, Iowa, to be filed and recorded in the manner provided by law. Section 5. That all other provisions of the Plan as previously amended that are not affected or otherwise revised by the terms of the instant Amendment be and the same are hereby ratified, confirmed, and approved in all respects.
