RESOLUTION NO. 2025-631 RESOLUTION DETERMINING AN AREA OF THE CITY TO BE AN ECONOMIC DEVELOPMENT AREA, AND THAT THE REHABILITATION, CONSERVATION, REDEVELOPMENT, DEVELOPMENT, OR A COMBINATION THEREOF, OF SUCH AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY OR WELFARE OF THE RESIDENTS OF THE CITY, AND DESIGNATION OF SUCH AREA AS APPROPRIATE FOR AN URBAN RENEWAL PROJECTS, AND ADOPTING THE BALTIMORE FIELDS URBAN RENEWAL PLAN. WHEREAS it is hereby found and determined that one or more economic development areas, as defined in Chapter 403, Code of Iowa, exist within the City and the rehabilitation, conservation, redevelopment, development, or combination thereof, of the area is necessary in the interest of the public health, safety, or welfare of the residents of the City; and WHEREAS, a proposed Baltimore Fields Urban Renewal Plan has been prepared ( the "Plan") and is on file in the Office of the City Clerk, which is incorporated herein by reference, the purpose of which is to designate an area of the City, as described in the proposed Plan and below, as an economic development area for purposes of urban renewal law, to allow within such area the carrying out of urban renewal activities and projects that involve the rehabilitation, conservation, development, and redevelopment of such area, or a combination of such activities or projects in the area, including the provision of public improvements related to housing and residential development consistent with Iowa Code Sections 403.19 and 403.22, and to promote continued growth and development in the area through various public purpose and special financing activities permitted under Chapter 403: Lot No. 5, except the East 156 feet thereof and except those parts deeded to the City of Waterloo, Iowa in T.L.D. Book 151 Page 562 and T.L.D. Book 272 at page 391, in Auditor Francis' Reitzel Plat; and the Northerly Half of that part of Byron Avenue in the City of Waterloo, Iowa, lying East of a Northerly extension of the West line of Lot No. 1 in Orlo C. Miller Addition, and West of a line that is 156 feet West of the West line of Baltimore Street, all in the City of Waterloo, Black Hawk County, State of Iowa, excluding thereof the area platted as Hawthorne Estates First Addition. AND Orlo C. Miller Addition, all of Lot 1 except the West 30 feet, Lot 2, and all that part of the Southerly one-half of Byron Avenue in the City of Waterloo, Iowa, lying East of a Northerly extension of the West line of Lot No. 1 in Orlo C. Miller Addition, and West of a line that is 156 feet West of the West line of Baltimore Street. Also, all that part of Denver Street in the City of Waterloo, Iowa, lying South of the South line of Byron Avenue and North of the North line of Eureka Street, all in the City of Waterloo, Black Hawk County, Iowa, excluding thereof the area platted as Baltimore Field First Addition. AND All that part of Hawthorne Avenue as it presently exists lying East of a Northerly extension of the East line of Hawthorne Estates First Addition, and West of a line that is 156 feet West of the West line of Baltimore Street, City of Waterloo, Black Hawk County, Iowa. Docusign Envelope ID: DA39AF30-5238-4302-A798-AC1707986064 Resolution No. 2025-631 Page 2 AND All that part of Eureka Street as it presently exists lying East of a Southerly extension of the East line of Baltimore Field 1st Addition, and West of a line that is 156 feet West of the West line of Baltimore Street, City of Waterloo, Black Hawk County, Iowa. WHEREAS, the property proposed to be included in the Urban Renewal Area is legally described in the Plan and above, and this Council has reasonable cause to believe that the Area described in the Plan satisfies the eligibility criteria for designation as an urban renewal area under Iowa law; and WHEREAS, it is desirable that the Area be redeveloped as part of the overall redevelopment covered by or stated in the Plan; and WHEREAS, the Iowa statutes require the City Council to submit the Plan to the Planning and Zoning Commission for review and recommendation as to its conformity with the general plan for development of the City as a whole, prior to City Council approval thereof; and WHEREAS, adoption of the Plan has been approved by the Planning and Zoning Commission for the City as being in conformity with the general plan for development of the City as a whole, as evidenced by its written report and recommendation filed herewith, which report and recommendation is hereby accepted, approved in all respects and incorporated herein by this reference; and WHEREAS, by Resolution No. 2025-551, this Council directed that a consultation be held with the designated representatives of all affected taxing entities to discuss the proposed Urban Renewal Plan and the division of revenue described therein, and that notice of the consultation and a copy of the proposed Urban Renewal Plan be sent to all affected taxing entities; and WHEREAS, the aforementioned consultation was duly held with the designated representatives of all affected taxing entities to discuss the proposed Plan and the division of revenue described therein, and that notice of said consultation and a copy of the proposed Plan was sent to all affected taxing entities; and WHEREAS, by Resolution No. 2025-551, this Council also set a public hearing on the adoption of the Plan for this meeting of the Council, and due and proper notice of said public hearing was given, as provided by law, by timely publication in the "Waterloo Courier", which notice set forth the time and place for this hearing and the nature and purpose thereof; and WHEREAS, in accordance with said notice, all persons or organizations desiring to be heard on said proposed Plan, both for and against, have been given an opportunity to be heard with respect thereto and consideration has been given to all comments and views expressed to this Council in connection therewith and said public hearing has been closed. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That the findings and conclusions set forth or contained in the Baltimore Fields Urban Renewal Plan concerning the area of the City of Waterloo, Iowa, described in the Plan and the preamble hereof, be and the same are hereby ratified and confirmed in all respects as the findings of this Council. Section 2. This Council further finds: That the Plan Area is an economic development area within the meaning of Iowa Code Chapter 403 that is appropriate for urban renewal activities and projects; that such area is eligible Docusign Envelope ID: DA39AF30-5238-4302-A798-AC1707986064 Resolution No. 2025-631 Page 3 for designation as an urban renewal area and otherwise meets all requisites under the provisions of Iowa Code Chapter 403; and that the rehabilitation, conservation, redevelopment, development, or a combination thereof, including the provision of public improvements related to housing and residential development consistent with Iowa Code Sections 403.19 and 403.22, of such area is necessary in the interest of the public health, safety, or welfare of the residents of this City; and The Plan conforms to the general plan for the development of the City as a whole; and Although is relocation is not expected, a feasible method exists for the location of families who will be displaced from the Plan area into decent, safe and sanitary dwelling accommodations within their means and without undue hardship to such families. Section 3. That the proposed Baltimore Fields Urban Renewal Plan of the City of Waterloo, Iowa, which is incorporated herein by reference, be and the same is hereby approved and adopted as the "Baltimore Fields Urban Renewal Plan", that said Plan is hereby in all respects approved; and that the City Clerk is hereby directed to file a certified copy of said Plan with the proceedings of this meeting. Section 4. That the Plan shall be in full force and effect from the date of this Resolution until the later of the date of termination set forth in the Plan, or the date on which payment of all obligations issued or advances made to carry out the purposes thereof shall be fully provided for. Said Plan shall be forthwith certified by the City Clerk, along with a copy of this Resolution, to the Recorder for Black Hawk County, Iowa, to be filed and recorded in the manner provided by law.
