RESOLUTION NO. 2025-673
RESOLUTION APPROVING AND ACCEPTING AN
ACQUISITION CONTRACT AND APPROVING A DEED TO
SELL REAL PROPERTY TO THE CITY OF WATERLOO FOR
A PARTIAL RIGHT-OF-WAY ACQUISITION, AND
PERMANENT AND TEMPORARY EASEMENTS
AGREEMENTS WITH C AND M ENTERPRISES, INC., IN
THE AMOUNT OF $5,132.00, LOCATED AT 1620 LA PORTE
ROAD, IN CONJUNCTION WITH THE LA PORTE ROAD
PHASE II RECONSTRUCTION PROJECT, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
WHEREAS the City of Waterloo is undertaking the La Porte Road Phase II
Reconstruction Project to improve public transportation infrastructure, traffic safety, and utility
coordination; and
WHEREAS, to complete said project it is necessary for the City to acquire a partial right-
of-way interest and certain permanent and temporary construction easements over a portion of
the real property locally known as 1620 La Porte Road, Waterloo, Iowa; and
WHEREAS, City staff have negotiated with the property owner, C and M Enterprises,
Inc., for the acquisition of the necessary interests and have reached agreement on the terms set
forth in an Acquisition Contract, related Deed conveying the partial right-of-way, and Permanent
and Temporary Easement Agreements (collectively, the "Agreements"); and
WHEREAS, the total compensation to C and M Enterprises, Inc., for the property
interests acquired is $5,132.00, which City staff have determined to be fair and reasonable and in
the best interests of the City; and
WHEREAS, approval of the Agreements and authorization for execution are necessary to
keep the project on schedule.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
1. The Acquisition Contract, the Deed conveying a partial right-of-way interest to the
City, and the Permanent and Temporary Easement Agreements from C and M Enterprises, Inc.,
for property located at 1620 La Porte Road, Waterloo, Iowa, all in conjunction with the La Porte
Road Phase II Reconstruction Project, are hereby approved and accepted in the total amount of
$5,132.00.
2. The Mayor and City Clerk are authorized and directed to execute said documents on
behalf of the City of Waterloo, Iowa.
