RESOLUTION NO. 2025-727
RESOLUTION ACCEPTING AND APPROVING AN
ACQUISITION CONTRACT AND APPROVING A DEED TO
CONVEY REAL PROPERTY TO THE CITY OF WATERLOO
FOR A PARTIAL RIGHT-OF-WAY ACQUISITION IN THE
AMOUNT OF $5,226.00; A PERMANENT EASEMENT
AGREEMENT IN THE AMOUNT OF $7,416.00; AND A
TEMPORARY EASEMENT AGREEMENT IN THE AMOUNT
OF $358.00, FOR A TOTAL COMPENSATION AMOUNT OF
$13,000.00, WITH LA PORTE RE, LLC, FOR THE PROPERTY
LOCATED AT 1328 LA PORTE ROAD, IN CONJUNCTION
WITH THE LA PORTE ROAD PHASE II RECONSTRUCTION
PROJECT, AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SAID DOCUMENTS.
WHEREAS the City of Waterloo, Iowa, is engaged in the La Porte Road Phase II
Reconstruction Project to enhance transportation infrastructure; and
WHEREAS, the project requires partial right-of-way acquisition, a permanent easement,
and a temporary easement on property located at 1328 La Porte Road, owned by La Porte RE,
LLC; and
WHEREAS, the following agreements have been negotiated and are presented for
approval:
• Acquisition Contract and Deed for partial right-of-way in the amount of Five Thousand
Two Hundred Twenty -Six Dollars ($5,226.00).
• Permanent Easement Agreement in the amount of Seven Thousand Four Hundred Sixteen
Dollars ($7,416.00).
• Temporary Easement Agreement in the amount of Three Hundred Fifty -Eight Dollars
($358.00).
WHEREAS, the total compensation amount agreed upon is Thirteen Thousand Dollars
($13,000.00), ensuring compliance with city standards and project requirements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
1. The Acquisition Contract, Deed, Permanent Easement Agreement, and Temporary
Easement Agreement with La Porte RE, LLC, are hereby accepted and approved.
2. The Mayor and City Clerk are authorized and directed to execute said documents on
behalf of the City of Waterloo, Iowa.
