RESOLUTION NO. 2025-728 RESOLUTION ACCEPTING AND APPROVING AN ACQUISITION CONTRACT AND APPROVING A DEED TO CONVEY REAL PROPERTY TO THE CITY OF WATERLOO FOR A PARTIAL RIGHT-OF-WAY ACQUISITION IN THE AMOUNT OF $35,653.00; A PERMANENT EASEMENT AGREEMENT IN THE AMOUNT OF $1,550.00; AND A TEMPORARY EASEMENT AGREEMENT IN THE AMOUNT OF $663.00, FOR A TOTAL COMPENSATION AMOUNT OF $37,866.00, WITH MCDONALD'S CORPORATION, FOR THE PROPERTY LOCATED AT 1709 LA PORTE ROAD, IN CONJUNCTION WITH THE LA PORTE ROAD PHASE II RECONSTRUCTION PROJECT, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS the City of Waterloo, Iowa, is continuing the La Porte Road Phase II Reconstruction Project to upgrade transportation infrastructure; and WHEREAS, this project requires the acquisition of a partial right-of-way, a permanent easement, and a temporary easement on property located at 1709 La Porte Road, owned by McDonald's Corporation; and WHEREAS, the following agreements have been negotiated and require City approval: • Acquisition Contract and Deed for partial right-of-way in the amount of Thirty-Five Thousand Six Hundred Fifty-Three Dollars ($35,653.00). • Permanent Easement Agreement in the amount of One Thousand Five Hundred Fifty Dollars ($1,550.00). • Temporary Easement Agreement in the amount of Six Hundred Sixty-Three Dollars ($663.00). WHEREAS, the total compensation for these acquisitions is Thirty-Seven Thousand Eight Hundred Sixty-Six Dollars ($37,866.00), ensuring alignment with city requirements and project objectives. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that: 1. The Acquisition Contract, Deed, Permanent Easement Agreement, and Temporary Easement Agreement with McDonald's Corporation are hereby accepted and approved. 2. The Mayor and City Clerk are authorized and directed to execute said documents on behalf of the City of Waterloo, Iowa.
