RESOLUTION NO. 2026-011
RESOLUTION ACCEPTING AND APPROVING AN
ACQUISITION CONTRACT AND APPROVING A DEED TO
CONVEY REAL PROPERTY TO THE CITY OF WATERLOO,
FOR A PARTIAL RIGHT-OF-WAY ACQUISITION
CONTRACT IN THE AMOUNT OF $2,728.00, AND A
TEMPORARY EASEMENT AGREEMENT IN THE AMOUNT
OF $1,523.00, FOR A TOTAL COMPENSATION AMOUNT OF
$4,251.00, WITH PEBBLE HILL, LLC, FOR THE PROPERTY
LOCATED AT 714 LA PORTE ROAD, IN CONJUNCTION
WITH THE LA PORTE ROAD PHASE II RECONSTRUCTION
PROJECT; AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SAID DOCUMENTS.
WHEREAS, the City of Waterloo, Iowa, is undertaking the La Porte Road Phase II
Reconstruction Project, which requires the acquisition of property and easements to improve and
expand city infrastructure; and
WHEREAS, Pebble Hill, LLC, is the owner of certain real property located at 714 La
Porte Road, Waterloo, Iowa, which is essential for the successful completion of this
infrastructure project; and
WHEREAS, the City has negotiated a Partial Right -of -Way Acquisition Contract in the
amount of $2,728.00, and a Temporary Easement Agreement in the amount of $1,523.00, for a
total compensation amount of $4,251.00, with the property owner; and
WHEREAS, this acquisition and the accompanying temporary easement are vital for
facilitating the necessary improvements within the project scope.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
1. The Acquisition Contract and deed to convey real property to the City for a Partial
Right -of -Way and Temporary Easement Agreement with Pebble Hill, LLC, are hereby accepted
and approved.
2. The total compensation amount of $4,251.00 is recognized as fair consideration for the
acquisition and temporary easement needed for the project.
3. The Mayor and City Clerk are authorized and directed to execute said document on
behalf of the City of Waterloo, Iowa.
