SPECIAL WARRANTY DEED
For the consideration of$1.00 Dollar(s) and other valuable consideration, the City of Waterloo,
Iowa, does hereby convey to International Paper Company the following described real estate in Black
Hawk County, Iowa:
Parcel "C" of the Southwest Quarter (SW 1 /4) of Section 5, Township 89 North, Range
13 West of the 5th Principal Meridian, City of Waterloo, Black Hawk County, State of
Iowa, and more particularly described as follows:
Commencing at the Northwest Corner of the Southwest Quarter of Section 5; thence
South 00°36'49" West along the West line of the Southwest Quarter 156.54 feet; thence
South 89°23'11 " East at a right angle to the said West line 33.00 feet to the West Right-
of-Way line of Leversee Road and the Point of Beginning of this description; thence
South 89°08'03" East along a line that is 565 feet normally distant to and parallel with
the North line of Parcel "B" of the Southwest Quarter, 2,429.54 feet to a line that is 684
feet normally distant to and parallel with the centerline of Runway 18/36; thence South
07°02'21" West along said parallel line 548.18 feet to the Northeast corner of Parcel
"B" of the Southwest Quarter; thence North 89°08'03" West along the North line of
said Parcel "B" 2,368.20 feet to the Northwest corner of said Parcel "B", being on the
East Right-of-Way line of Leversee Road; thence North 00°36'49" East along the East
Right-of-Way line of Leversee Road 545.00 feet to the Point of Beginning containing
1,307,378 square feet (30.01 acres).
Subject to (a) easements, conditions, and restrictions of record as set forth in the
subdivision Deed of Dedication. (b) general utility and right-of-way easements serving
the property and of record, (c) restrictions imposed by local zoning ordinances and
other applicable law.
This is a deed from a political subdivision that is exempt from transfer tax, declaration of value,
and groundwater hazard statement pursuant to Iowa Code § 428A.1(2) and Iowa Code § 428A.2(6).
The grantor hereby covenants with grantees, and successors in interest, to warrant and defend
the real estate against the lawful claims of all persons claiming by, through, or under it, except as may
be stated above. Words and phrases herein, including acknowledgment hereof, shall be construed as in
the singular or plural number, and as masculine or feminine gender, according to the context.
