RESOLUTION NO. 2026-040 RESOLUTION APPROVING THE DEDICATION OF A SANITARY SEWER AND WATER MAIN EASEMENT BY THE CITY OF WATERLOO ON CITY OWNED PROPERTY, LOCATED WEST OF 3105 AIRPORT BOULEVARD AND NORTH OF THE CANADIAN NATIONAL RAILROAD. WHEREAS, the City of Waterloo, Iowa owns certain real property located west of 3105 Airport Boulevard and north of the Canadian National Railroad in Waterloo, Iowa; and WHEREAS, in order to provide for the installation, operation, maintenance, repair, and replacement of a public sanitary sewer and water main, it is necessary and in the public interest for the City to dedicate a sanitary sewer and water main easement over and across a portion of said City -owned property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo as follows: 1. The City Council hereby approves the dedication of a water main easement over City - owned property located west of 3105 Airport Boulevard and north of the Canadian National Railroad, Waterloo, Iowa, as more particularly described in the easement document and legal description described as follows: COMMENCING AT THE SOUTHEASTERN MOST CORNER OF LOT 13, MIDPORT AMERICA PARK PLAT NO.2; THENCE NORTH 00°57'07" WEST ALONG THE WESTERN -MOST EAST LINE OF LOT 13, 60.03 FEET TO THE NORTH LINE OF A PLATTED 60-FOOT EASEMENT AND THE POINT OF BEGINNING OF THIS DESCRIPTION; THENCE NORTH 89°12'25" WEST ALONG THE NORTH LINE OF A PLATTED 60-FOOT EASEMENT 1,534.22 FEET TO THE EASTERLY LINE OF A PLATTED 30-FOOT EASEMENT; THENCE NORTH 06°51'18" EAST ALONG THE EASTERLY LINE OF A PLATTED 30-FOOT EASEMENT 152.23 FEET; THENCE SOUTH 83°20'12" EAST 1,206.42 FEET ALONG A LINE THAT IS 80-FOOT NORMALLY DISTANT TO AND PARALLEL WITH THE NORTHERLY LINE OF A RAILROAD EASEMENT TO A LINE THAT IS 88-FEET NORMALLY DISTANT TO AND PARALLEL WITH THE SOUTH LINE OF LOT 13, MIDPORT AMERICA PARK PLAT NO.2; THENCE SOUTH 89°12'25" EAST ALONG SAID PARALLEL LINE 287.03 FEET TO WESTERN -MOST EAST LINE OF LOT 13; THENCE SOUTH 00°57'07" EAST ALONG THE WESTERN MOST EAST LINE OF LOT 13 20.01 FEET TO THE POINT OF BEGINNING CONTAINING 116,904 SQUARE FEET (2.684 ACRES). THE SOUTH LINES OF LOTS 13 AND 14 OF MIDPORT AMERICA PARK PLAT NO.2 IS ASSUMED TO BEAR NORTH 89°12'25" WEST FOR THIS SURVEY. 2. The Mayor is authorized and directed to execute said easement document on behalf of the City of Waterloo, Iowa. PASSED AND ADOPTED this 2nd day of February 2026.
