RESOLUTION NO. 2026-104 RESOLUTION APPROVING A VARIANCE TO THE REQUIREMENTS OF THE SUBDIVISION ORDINANCE IN SECTION 11-3-2 PRELIMINARY PLATS AND SECTION 11-3-3 FINAL PLATS, RELATING TO THE APPROVAL OF THE FINAL PLAT OF UNIVERSITY PLAT NO. 2, A 3-LOT COMMERCIAL AND RESIDENTIAL SUBDIVISION IN THE "C-2" COMMERCIAL DISTRICT LOCATED WEST OF 3345 UNIVERSITY AVENUE AND 950 SHEERER AVENUE, TO ALLOW APPROVAL OF THE PLAT OF SURVEY THAT DOES NOT MEET ALL REQUIREMENTS FOR A PRELIMINARY AND FINAL PLAT. WHEREAS, University Plat No. 2 is a proposed three -lot commercial and residential subdivision located west of 3345 University Avenue and 950 Sheerer Avenue in the City of Waterloo, Black Hawk County, Iowa, and is zoned "C-2" Commercial District; and; WHEREAS, the City of Waterloo Subdivision Ordinance specifies requirements for the submission and approval of plats including, but not limited to, Section 11-3-2 Preliminary Plats and Section 11-3-3 Final Plats; and WHEREAS, a request has been made by the City of Waterloo for a variance from the requirements of said sections to allow approval of a Plat of Survey for University Plat No. 2 in lieu of meeting all requirements applicable to a preliminary plat and final plat under the Subdivision Ordinance; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that: 1. The City Council hereby approves a variance to the requirements of the Subdivision Ordinance in Section 11-3-2 (Preliminary Plats) and Section 11-3-3 (Final Plats), relating to the approval of the Final Plat of University Plat No. 2, a three -lot commercial and residential subdivision in the "C-2" Commercial District located west of 3345 University Avenue and 950 Sheerer Avenue, to allow approval of the Plat of Survey that does not meet all requirements for a preliminary and final plat.
