RESOLUTION NO. 2026-097 RESOLUTION APPROVING AN ASSIGNMENT OF REBATES AND WAIVER/RELEASE TO IOWA HEARTLAND COMMUNITY INVESTMENT FUND, LLC IN CONJUNCTION WITH THE DEVELOPMENT AGREEMENT WITH BLACK HAWK CONTRACTING AND DEVELOPMENT DATED FEBRUARY 17, 2014, FOR THE PROPERTY LOCATED AT 301-311 E. 3RD STREET, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT. WHEREAS, the City of Waterloo, Iowa previously entered into a Development Agreement with Black Hawk Contracting and Development dated February 17, 2014; and WHEREAS, the Development Agreement relates to certain development and/or redevelopment activities involving the real property located at 301-311 E. 3rd Street, Waterloo, Iowa; and WHEREAS, White Rhino Real Estate has requested an Assignment of Rebates and Waiver/Release in favor of Iowa Heartland Community Investment Fund, LLC in connection with the Development Agreement and the Property; and WHEREAS, the City Council finds it to be in the best interests of the City to approve the Assignment of Rebates and Waiver/Release to Iowa Heartland Community Investment Fund, LLC. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that: 1 . The Assignment of Rebates and Waiver/Release to Iowa Heartland Community Investment Fund, LLC, in conjunction with the Development Agreement with Black Hawk Contracting and Development dated February 17, 2014, for the Property located at 301-311 E. 3rd Street, Waterloo, Iowa, is hereby approved. 2. The Mayor and City Clerk are authorized and directed to execute said documents on behalf of the City of Waterloo, Iowa. PASSED AND ADOPTED this 2nd day of March 2026.
