Mr. Salamanca commented that this was a costly miscommunication and asked for assurance this would not happen again. Randy Bennett explained that the cost was not affected by the miscommunication. The work was still needed at the same cost. The miscommunication was that the contractor did not get pre -approval before the work was done. Mr. Salamanca asked if steps have been taken to ensure this would not happen again. Randy Bennett confirmed. Mr. Schmitt asked what would happen if the council does not approve the change order. Randy Bennett commented that he would advise not to go in that direction because this is work that did need to take place and could possibly have a negative impact on the contract. It could also be devastating to Waterloo Fiber, potentially. Mr. Schmitt explained his reason for asking and questioned if there are multiple change orders that have been presented. Randy Bennett provided statistics on the project and said that some of the change orders have been due to new development in the area that was not in place when the project started. Motion carried. Resolution adopted and upon approval by Mayor Metropolitan Transit Authority "How to Ride" signage policy for the Motion carried. Resolution adopted and upon approval by Mayor Ms. Creighton -Smith requested an overview of the signage policy. Noel Anderson, Community Planning and Development Director, explained that city staff is working with INRCOG and met primarily through the traffic department for a partnership to put up new signs. Nick Fratzke, INRCOG, 229 E. Park Avenue, shared that through a series of planning studies, one being the Passenger Transportation Study that is updated every five years with the Metropolitan Transit Authority. A lot of the public input identified an issue with many of the potential riders not understanding how the Met Transit system operates. The signage would be placed where existing signage is currently and in areas of high foot traffic and would include a QR Code that could direct non -English-speaking passengers to translation services. Mr. Salamanca questioned how MET Transit will track the success of the policy and commented that understanding how to utilize MET continues to be an issue for citizens. He asked if it would be better to have bus stops. Nick Fratzke shared that tracking usage would be available through the QR Code landing page. He further commented that creating designated bus stops would involve regulatory compliance requirements, so he would defer that question to Noel Anderson. Page 9 of 14 Docusign Envelope ID: 2BA02A85-E195-4590-93B8-E23065DB8755 Mr. Salamanca requested an explanation as to why this project had not yet started despite entering into an agreement one year ago including a six-month extension. O'Dell Sallis, Idaho Street, explained the reasons for the delays, including getting the right permits for this type of material that had not been used in Iowa before. He stated that the homes will be 100% non-combustible and guaranteed for 200 years. When you build a house with these materials, there will be no mold, and you will not have to worry about having termites. These properties are here to stay. Mr. Salamanca questioned the process for requesting extensions to a Development Agreement when they have not yet completed Phase 1. Noel Anderson, Community Planning and Development Director, provided an outline of the housing policy for infill housing projects and shared that the process for an extension is to request an amendment and give staff the information to come back to council for approval. Mr. Salamanca questioned if this was the first or second request to amend, and when the project was supposed to be completed. Noel Anderson stated that the original Development Agreement was approved in September 2024, with construction to begin within four months and completed in fourteen months. He reiterated the reasons for the delay as stated by Mr. Sallis and shared that they are hopeful they can begin to move ahead with this amendment. Ms. Creighton -Smith asked for clarification again that these materials have never been used in this area. O'Dell Sallis confirmed the materials have been used in other parts of the country, but not in Iowa. He shared that new jobs will be created for people who have not used this material previously and reiterated that these homes are good for the environment. Mr. Simon asked if the need to train local construction workers to use this material would set him back. O'Dell Sallis commented that training only takes a day or two and they would be able to construct this fifteen -hundred square foot home in less than two days. Mr. Simon questioned whether the use of this material had set him back on the first process. O'Dell Sallis explained that the materials are not holding up the process, the Building and Planning Departments are holding up the project with the delay in getting through the permitting process. He explained that now that everything else has been approved, they need the amendment approved so that they can move forward. Mr. Simon questioned how much money was received by the Development Agreement. Noel Anderson explained that $5,000 was received from the developer and everything is ready to move forward. Mr. Schmitt asked if the delay was more on the end of the city or the developer. Page 10 of 14 Docusign Envelope ID: 2BA02A85-E195-4590-93B8-E23065DB8755 Noel Anderson commented that there was more of a delay during the question and answer period than there normally would not be with a stick -built structure making sure code requirements were met. Additionally, Mr. Sallis came back and asked to change the Development Agreement to transfer for $1.00. He stated that the policy says $5,000 for infill housing, so they stuck with that. Mr. Schmitt questioned if the delay is typical of what we would extend to other developers. Noel Anderson confirmed. Mr. Schmitt requested confirmation from Mr. Sallis that they have been using this material in different parts of the country for quite some time and have developed a track record. O'Dell Sallis, confirmed. Mr. Schmitt questioned Noel Anderson if he had confirmed their success in building in other communities. Noel Anderson commented that he had. Mr. Salamanca questioned if the projects staff had seen were using the same materials Mr. Sallis is proposing here. Noel Anderson confirmed. Mr. Salamanca questioned if city staff had spoken with city officials from the communities where they have built with these materials. Noel Anderson explained that he had not, and he just reviewed images on their websites. Mr. Salamanca asked Chief Beck if he had any concern as to the fire rating of this material that has never been used within the city limits of Waterloo. Bill Beck, Fire Chief, commented that he can only assume that the material is covered by all fire code and international codes whether it be fire, plumbing and electrical, as they are federally mandated. He further commented that they are confident that if a fire is started, they can put it out. Ms. Creighton -Smith questioned if it is typical practice to contact other cities and talk with their city officials about building projects in their jurisdictions. Noel Anderson commented that it is not common practice and that they typically just visit websites to view images. Mayor Boesen commented that his only concern is what caused an eighteen -month delay from the time we approved the development agreement. Noel Anderson commented that he could get a timeline to show the council. Page 11 of 14 Docusign Envelope ID: 2BA02A85-E195-4590-93B8-E23065DB8755 Mayor Boesen questioned if the property is in a target zone.
