RESOLUTION NO. 2013-125
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON APPLICATION OF FRANK
CAGLEY TO REZONE APPROXIMATELY 18 ACRES OF
LAND LOCATED AT 3730 WAGNER ROAD FROM %NR -1"
ONE AND TWO FAMILY RESIDENCE DISTRICT TO "M-
1" LIGHT INDUSTRIAL DISTRICT, AS MARCH 11,
2013, AT 5:30 P.M. IN THE COUNCIL CHAMBERS IN
CITY HALL AND INSTRUCTING CITY CLERK TO
PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5:30 p.m. on the 11th day of March, 2013, for
the purpose of considering and acting upon an application of
Frank Cagley to rezone approximately 18 acres of land located at
3730 Wagner Road from "R-1" One and Two Family Residence District
to "M-1" Light Industrial District, and legally described as
follows:
That part of the Southwest Quarter of the Northwest
Fractional Quarter of Section No. Three (3), Township
Eighty-nine (89) North, Range No. Thirteen (13) West of
the Fifth (5th) Principal Meridian, Black Hawk County,
Iowa, bounded as follows:
Beginning at a point on the West line of said Section
which is One Thousand One Hundred Seventy-seven and
Sixty-nine Hundredths (1177.69) feet South of the
Northwest Corner of said Section;
thence North Eighty-nine (89) degrees Sixteen (16)
minutes East a distance of Two Hundred Thirty (230)
feet;
thence South parallel with the West line of said
Section a distance of One Hundred Two and Ninety-four
Hundredths (102.94) feet;
thence East at right angles a distance of One
Hundred Fifty-nine (159) feet;
thence South at right angles a distance of Fifty-
eight (58) feet;
thence East at right angles a distance of Three
Hundred Fifty-four and Seventy-eight Hundredths
(354.78) feet;
thence South at right angles a distance of One
Thousand One Hundred Three and One Hundredths (1103.01)
feet to the South line of the Northwest Fractional
Quarter of said Section;
thence West along the South line of the Northwest
Fractional Quarter of said Section a distance of Seven
Hundred Forty-three and Ninety Hundredths (743.90) feet
to the Southwest Corner of the Northwest Fractional
Quarter of said Section;
thence North One Thousand Two Hundred Seventy-four
and Twenty-one Hundredths (1274.21) feet to the point
of beginning; except the West Fifty (50) feet of the
South One Thousand Seventy-nine and four tenths
(1079.4) feet thereof conveyetJ to Black Hawk County,
Iowa, for road purposes.
Note: The West line of the Northwest Fractional Quarter
of said Section is assumed to bear due North and South.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
