RESOLUTION NO. 2016-613
RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF
CERTAIN TRACTS OF LAND, FORMERLY PORTIONS OF WEST
SAN MARNAN DRIVE RIGHT-OF-WAY ADJACENT TO 1104-1111
WEST SAN MARNAN DRIVE, TO SAN MARNAN MANAGEMENT,
LTD. IN THE AMOUNT OF $1.00 IN ACCORDANCE WITH A
DEVELOPMENT AGREEMENT APPROVED ON APRIL 27, 2015,
AND AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE NECESSARY DOCUMENTS.
WHERAS, the City of Waterloo, Iowa is the owner of real property in the City of
Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real property has been made by
San Marnan Management, Ltd., in the sum of$1.00, and
WHEREAS, a public hearing was held on August 1, 2016 at 5:30 p.m. in the Council
Chambers at City Hall for the City of Waterloo, Iowa, on the proposal to sell and convey portions
of West San Marnan Drive right-of-way owned by the City of Waterloo, Iowa, adjacent to 1104-
1111 West San Marnan Drive, to San Marnan Management, Ltd., in accordance with a
development agreement passed and adopted by this Council as Resolution No. 2015-292 on April
27,2015, and
WHEREAS, it is the opinion of this Council that sale and conveyance should be made as
proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY
OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, as fully described in the published notice in the
Waterloo Courier on July 25, 2016, is not presently needed and will not be needed in the
foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and
2. That the offer of San Marnan Management, Ltd., to purchase real property for the sum
of$1.00, for real property described below:
TRACT 1
THAT PART OF THE SOUTHEAST QUARTER OF SECTION 5, TOWNSHIP 88
NORTH, RANGE 13 WEST OF THE FIFTH PRINCIPAL MERIDIAN, BLACK
HAWK COUNTY, IOWA, DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SAID SECTION 5; THENCE
S89050'54"W 137.44 FEET ALONG THE SOUTH LINE OF SAID SECTION 5 TO
THE POINT OF BEGINNING ON AN EXTENSION NORTHWESTERLY OF THE
EXISTING RIGHT-OF-WAY OF ANSBOROUGH AVENUE; THENCE
CONTINUING S89050'54"W 678.58 FEET ALONG THE SAID SOUTH LINE OF
SAID SECTION 5; THENCE NORTHEASTERLY 36.77 FEET ALONG A 50.00 FOOT
RADIUS CURVE, CONCAVE SOUTHEAST, SAID CURVE HAVING A CHORD OF
35.95 FEET BEARING N64°43'31"E; THENCE N85°09'49"E 118.28 FEET; THENCE
N87059'00"E 493.93 FEET TO THE NORTHWESTERLY EXTENSION OF THE

WEST RIGHT-OF-WAY OF ANSBOROUGH AVENUE; THENCE S40°10'56"E 53.66
FEET TO THE POINT OF BEGINNING, CONTAINING 0.453 ACRES, AND IS
SUBJECT TO UTILITIES AND DRAINAGE EASEMENT OVER, ACROSS, AND
UPON THE ENTIRE PARCEL.

THAT PART OF THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 88
NORTH, RANGE 13 WEST OF THE FIFTH PRINCIPAL MERIDIAN, BLACK
HAWK COUNTY, IOWA, DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF SAID SECTION 8; THENCE
S89050'54"W 137.44 FEET ALONG THE NORTH LINE OF SAID SECTION 8 TO
THE POINT OF BEGINNING ON AN EXTENSION NORTHWESTERLY OF THE
EXISTING RIGHT-OF-WAY OF ANSBOROUGH AVENUE; THENCE S40°10'56"E
40.82 FEET ALONG SAID RIGHT-OF-WAY EXTENSION TO THE EXISTING
INTERSECTION OF THE WEST RIGHT-OF-WAY OF ANSBOROUGH AVENUE
AND THE SOUTH RIGHT-OF-WAY OF WEST SAN MARNAN DRIVE; THENCE

FEET; THENCE S 87°52'32"W ALONG SAID SOUTH RIGHT-OF-WAY 365.40
FEET TO THE EAST RIGHT-OF-WAY OF GALACTIC DRIVE; THENCE NO°29'46"
E 14.40 FEET ALONG A NORTHERLY EXTENSION OF THE EAST RIGHT-OF-
WAY OF GALACTIC DRIVE; THENCE NORTHEASTERLY 37.53 FEET ALONG A
50.00 FOOT RADIUS CURVE, CONCAVE SOUTHEAST, SAID CURVE HAVING A
CHORD OF 36.65 FEET BEARING N21059'26"E TO THE NORTH LINE OF SAID
SECTION 8; THENCE N89°50'54"E 678.58 FEET ALONG THE NORTH LINE OF
SAID SECTION 8 TO THE NORTHWESTERLY EXTENSION OF THE WEST
RIGHT-OF-WAY OF ANSBOROUGH AVENUE AND THE POINT OF BEGINNING,
CONTAINING 0.611 ACRES, AND IS SUBJECT TO UTILITIES AND DRAINAGE
EASEMENT OVER, ACROSS, AND UPON THE ENTIRE PARCEL.
3. That the City of Waterloo, Iowa conveys said parcel of real property to San Marnan
Management, Ltd., by deed.
4. That the Mayor and City Clerk are hereby authorized to execute said deed.
5. That the original of said deed fully executed and acknowledged is hereby approved
and confirmed by the Council.
6. That the Community Planning and Development Director is authorized and directed to
deliver said deed of conveyance to San Marnan Management, Ltd., upon receipt in the sum of
$1.00.
