The City Council of the City of Waterloo, Iowa, met in Special Session in the
Council Chambers, Mayor's Office, in the City Hall in the City of Waterloo, Iowa, at
11:30 o'clock A. IVI., April 1, 1940, pursuant to the following call:
"To T. D. Burtner, T. E. Dolan, Earl B. Toder, Warner J. Lang, Stanley B.
Shane and. Dewey W. Strang:
You and each of you are hereby notified that there will be and is hereby
called a Special Meeting of the Council of the City of Waterloo, Iowa, to
be held in the Council Chambers, Yayor's Office, of the above -named city,
on the lst day of April, 1940, at 11:30 A. M. for the purpose of considering
and acting upon the following:
1 - Acceptance of Canvassers' Report;
2 - For the consideration and action upon
all and any unfinished business of this Council.

13514 - Moved by Burtner, Seconded by Strang that on account of the illness of Knapp F.
Matthews,City Clerk, -Lulu K. Smith be appointed Clerk pro tem for this meeting.
Motion carried.
13515 - On motion by Shane, seconded by Dolan the copy of the call was received and place
on file.
13516 - Moved by Dolan, seconded by Toader the Canvassers' Report of the Official Count
of ballots cast at the Regular Municipal Election, March 25th, 1940, be received,
placed on file and approved. Motion carried.
13517 - W. T. Lang/ President of the Council, recommended that the bids on departmental
needs for the City of Waterloo, Iowa, for the fiscal year beginning April 1, 1940
and ending Larch 31, 1941, be referred to the incoming council.
Moved by Toder, seconded by Dolan that said recommendation be approved. 0n roll call
Burtner, Dolan, Toder, Lang, Shane and Strang voted. Aye. Nays: None. Absent: None.
Mayor declared the motion carried.
13518 - Moved by Lang, seconded by Burtner that the communication from Knapp F. Matthews,
City Clerk and. Auditor, anpointing Viola Dugstad to the position of Assistant in the
office of Auditor and Clerk in the City of Waterloo, Iowa, with full civil service
rights, subject to the approval of the council, be received, placed on file and
appointment approved.
On roll call Burtner, Dolan, Toder, Lang, Shane and Strang voted Aye. Nays: None.
Absent: None. Mayor declared thenotion carried.
13519 - Moved by Strang, seconded by Shane that the Bill of Sale of the Iowa Paving
Materials Company, Paul Graham and. E. H. Matthias, to the City of Waterloo, Iowa,
dated March 30th, 1940, and the option agreement submitted therewith and bond
guaranteeing the delivery of the materials described in said Bill of Sale, be re-
ceived, placed on file and accepted.
0n roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted Aye. Nays: None.
Absent: None. Mayor declared the motion carried.
13520 - 0n motion by Strang, seconded by Lang the communication from D. R. Kennicott,
Regional Director, P. W. A., Chicago, Ill., approving the contract of Dobson &
Robinson, Lincoln, Nebr., Contractors, for the construction of Section "T", Contract
kll, of a sewage disposal plant, P. W.A. Project, Docket No. Ia. 1254-F, in the
City of Waterloo, Iowa, in the amount of :59,495.00, together with a copy of said
contract and set of plans, were received and Placed on file.
13521 - Moved by Strang, seconded by Lang that Resolution No. 8338, allowing Frank
McGowan 166.25 additonal pay for services as Electrical Inspector of the City of
Waterloo, Iowa, during the period beginning January 1, 1940 and ending March 31,

The Oath of Office was administered to Mayor -Elect Ralph B. Slippy by District
Court Judge Geo. W. Wood in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 12 o'clock noon, April lst, 1940.
Mayor Ralph B. Slippy appointed Lulu K. Smith as Clerk pro tem for this meeting
on account of the illness of Knapp F. Matthews, City Clerk.
Mayor Ralph B. Slippy made a brief address to the Council which he thanked the
public for the re-election of the entire administration, and pledged continuance of
the conduct of public affairs in the same manner that they have been in the past; he
also thanked the councilmen for their cooperation in helping to make the administration
a success and asked their continued support. He also called attention to the follow-
ing five problems, which would be likely to confront the council within the next two
years, giving a brief opinion and urging the council to take them under careful
consideration:
1 - New City Hall;
2 - Sewer extensions in suburban districts;
3 - Centralziation of Street Department - Safety Lane;
4 - Parking downtown area;
5 - Extension of city limits.
Judge Geo. W. Wood then administered the Oath of Office to the following:

13523 - Councilman T. E. Dolan moved that Warner J. Lang be elected. President of the
City Council. Councilman Dewey W. Strang seconded the motion, which was carried
unanimously, and the Mayor declared Warner T. Lang, duly elected as President of the
City Council.
13524 - Councilman J. D. Burtner moved that Knapp F. Matthews be appointed Clerk and
Auditor of the City of Waterloo, Iowa, for the term of two years from and after the
date of this meeting and until his successor is appointed and has Qualified.
Councilman Dewey W. Strang seconded the motion.
On roll call Burtner, Dolan, Toder, Lang, Shmie and. Strang voted Aye. Nays: None.
Absent: None.
Mayor Slippy declared Knapp F. Matthews the duly appointed Clerk and. Auditor of the
City of Waterloo, Iowa.
13525 - Following the announcement by Mayor Slippy regarding the illness of Knapp F.
Matthews, City Clerk, it was moved by Councilman Stanley B. Shane, seconded by
Councilman T. E. Dolan that Resolution No. 8339, appointing Lulu K. Smith Acting
City Clerk during the absence of Knapp F. Matthews, the duly appointed City Clerk
of the City of Waterloo, Iowa, be adopted.

Absent: None. Mayor declared the resolution adopted.
13526 - Moved by Councilman Dewey W. Strang, seconded by Councilman T. E. Dolan that
Resolution No. 8340, fixing 7:30 o'clock P. M. of the second and fourth Mondays of
each month as the time, and the council chambers in the City Hall, Waterloo, Iowa,
as the place for holding the meetings of the council, be adopted.

13527 - Councilman Earl B. Joder moved that C. T. Wilson be appointed City Engineer for
the City of .aterloo, Iowa, for the term of two years from and after date of this
meeting. Councilman J. D. Burtner seconded the motion, which was carried unanimously
13528. - Councilman Warner J. Lang moved that W. L. Beecher be appointed City Solicitor fo
the City of Waterloo, Iowa, for the term of two years from and after date of this
meeting. Councilman Dewey W. Strang seconded the motion, which wqs carried unanimous
13529 - Councilman Dewey W. Strang moved that E. F. Keith be appointed Assistant City
Solicitor for the City of Waterloo, Iowa, for the term of two years from and after
date of this meeting. Councilman T. D. Burtner seconded the motion, which was
carried unanimously.
13530 Movedby Councilman Warner T. Lang, seconded by Councilman T. D. Burtner that the
communication from Mayor Slippy, appointing Dr. T. F. Thornton to fill the unexpired
term of the Late H. 'T. Dallman, which term expires the first Monday in April, 1942,
and re -appointing Fred G. Clark, Jr. for the term expiring the first Monday in April,
1946, as members of the Civ.,1 Service Commission be received, placed on file and
appointments approved. Motion carried.

requesting that the alley in the 2500-block East 4th Street, running from Esther
Street to Anita Street, a distance of one block, be graded, was received, placed on

East Independent School District, Waterloo, Iowa, requesting permission to construct
and maintain a curb and gutter along Edwards and. Lincoln streets to the Virden Creek

Education, East Independent School District, Waterloo, Iowa, permission to construct
and maintain curb and gutter along Edwards Street and. Lincoln Street to the Virden

Department of Health regarding a meeting to be held in the Dairy Industry Building
of the Iowa State College, Ames, Iowa, on May 6, 1940 and continuing for four or
five days, be received, placed on file and the Milk Inspector be authorized to
attend said meeting.

13550 - Moved by Burtner, seconded by 511ane that the Agreement between the Iowa
Unemployment Compensation Commission and the City whereby the City agrees to pay
the sum of g3oo.00 at 325.00 per month, for the fiscal year beginning April 1,
1940 and ending March 31, 1941, be received, placed on file and the Mayor and
Clerk be instructed to sign said contract. Notion carried.
13551 - 0n motion by Lang, seconded by Dolan the Proposed Band Contract submitted by
the Becker -Chapman Post #138 of the American Legion for the year beginning April
1, 1940, be received and placed on file.
13552 - On motion by Strang, seconded by Dolan the petition of Harry Saltau, 1917
Mulberry Street, et al, for vacation of the alley north of an adjacent to Welsteadis
Sub, was received, placed on file and referred to the Street and Alley Committee.
13553 - On motion by Lang, seconded by Dolan the offer of the Hawkeye Securities Corp-
oration by W. E. Tohnson, Secretary, to deed certain land to the City for street
purposes, and. Resolution of the Park Board dealing therewith, were received and
placed on file.
13554 - On motion by Burtner, seconded by Shane the application of L. L. Coryell & Son
for permission to install underground storage tanks at the corner of Mullan Avenue
and Comftercial Street, was received, placed on file and referred to the Council
as anCommittee of the Whole.
13555 - On motion by Lang, seconded by Shane the application of L. L. Coryell & Son
for permission to cut the curbing on the east side of Mullan Avenue for a distance
of 36, in front of the filling station at the corner of Mullen Avenue and Commercial
Street, together with accompanying plat, were received, placed on file and referred
to the Council as a Committee of the Whole.
13556 - 0n motion by Strang, seconded by Shane the application, and accompanying
petition of consent of property owners, of the Old Mill Ice cream Company request-
ing permission to erect a building and conduct a retail ice cream business at the
Northwest corner of Independence Avenue and Vinton Street, were received, placed
on file and referred to the Council as a Committee of the Whole.
13557 - 0n notion by Dolan, seconded by Shane the communication from H. R. Crumrine,
Chief of Police, making various appointments in the Police Departl_ent of the City
of ',Iaterlool Iowa, was received, placed on file and appointments approved.
13558 - On motion by Shane, seconded by Dolan the communication from Ralph B. Slippy
*Mayor, stating that he administered the oath of office on April 1, 1940 to Knapp
F. Matthews, City Clerk and Auditor,Dr. F. Harold Entz, Director Venereal Clinic
and Fred Clark, Civil Service Commissioner, was received, placed on file and
approved.

Park, Inc., the owner of Lot 42, Auditor Rainbow's West Side Plat, and J. H. Shanks,
the owner of Lot 44, Auditor Rainbow's West Side Plat, Waterloo, Iowa, by Harris
& Van Metre, Attorneys, against the oiling of Black Hawk Road lying adjacent to

with Paving Contract No. 33 was submitted by the Clerk, and on motion by Lang,
seconded by Dolan said proof of publication was received and placed on file.

paving that the council would proceed with the consideration of objections. No
objections, written or oral, were filed or presented.
