The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council
Chambers in the City Hall in said. City at 8 o'clock P. m., August 12th, 1940.
Mayor Ralph B. Slippy in the Chair. Present: Councilmen T. D. Burtner; T. E. .uolan;
Earl B. Toder; 'Varner T. Lang, Dewey W. Strang, and. Edward R. g)INeill, Travelling
limgineer, representing P. W. A. Officials. Absent: Councilman Stanley B. Shane.
14171 - On motion by Burtner, seconded by Lang the minutes of the regular session of July
22nd, Special Session of July 26th, and Special Session of July 31st, 1940, were
received, placed on file and ap-nroved.
14172 - On motion by Councilman Lang, seconded by Councilman Toder the proof of publicatio
of the Notice of Hearing on proposed plans, specifications and proposed form of contra
for the construction of a part of Section "G" of a Sewage Disposal Plant for the City
of Waterloo, Iowa, was received and placed on file.
There being no written or oral objections, Mayor Ralph B. Slippy instructed the
council to proceed with the next order of business.
14173 - moved by Councilman Lang, seconded by Councilman Toder that Resolution No. 8511,
ratifying, confirming and approving plans, specifications and form of contract for
the construction of a part of Section "G" of a sewage disposal plant for the City of
Waterloo, Iowa, P. W. A. Project, Docket No. Iowa 1254-F, be adopted.
On roll call Councilmen Burtner, Dolan, Toder, Lang and Strang voted. Aye. Nays: None,
Absent: Councilman Shane.
Mayor Slippy declared the resolution adopted.
14174 - On motion by councilman Toder, seconded by Councilman Lang a communication from
Federal Emergency Administration of Public Works, being Project Memorandum No. 6,
Docket Iowa 1254-F, Sewage System, granting an extension of time for the completion
of the same to the 28th day of September, 1940, upon certain conditions, was received
and placed on file.
14175 - Moved by Councilman Burtner, seconded by Councilman Toder that Resolution No. 851;
accepting the conditons of the extension of the completion date to September 28, 1940
of the construction of the sewage disposal plant for the City of Waterloo, Iowa, Dock(
Iowa 1254-P, be adopted.
On roll call Councilmen Burtner, Dolan, Toder, Lang and. Strang voted Aye. Nays: None,
Absent: Councilman Shane.
Mayor Slippy declared the resolution adopted.
14176 - The City Clerk submitted proof of publication of "Advertisement for Bids", P. W.
A. Project No. Iowa 1254-F, Waterloo Disposal Plant, and on motion by Councilman 3ode]
seconded by Councilman Burtner said Proof of publication was received and placed on
file.
Mayor Ralph B. Slippy announced that the time had arrived to consider "Supplemental
Bids" as specified under Section "G", Contract No. 8, Waterloo Sewage Disposal Plant,
P. W. A. Project No. Iowa 1254-F.
14177 - Moved by Councilman Burtner, seconded by Councilman Lang that the City Clerk be
instructed to proceed with the opening of said bids, which were opened and read by
the Clerk as follows:
Bid of Henry A. Zimmer, Moline, Illinois:
Total Bid 10,700.00
(60 days required to complete work)
A proposal bond in the amount of 53 of the base bid accompanied said bid, said
bond surety being the Massachusetts Bonding and Insurance Company, Boston, Mass.
Bid of T. W. Darragh, Cedar Rapids, Iowa:
Total Bid 0,882.00
(45 days required to complete work)
A proposal bond in the amount of 3,000.00 with Hartford Accident and. Indemnity
Company, Hartford, Conn., as surety, accompanied said bid.
14178 - Moved by Councilman Lang, seconded by Councilman Burtner that the said bids be
received, placed on file and referred to the council as a committee of the whole.

14180 - Mayor Ralph B. Slippy announced that the time having arrived for accepting bids
for the aforesaid sewer contract #34 bonds that bids would not, be in order.
The Carleton D. I3eh Company of Des Moines, Iowa, bid Par and accrued interest.
Mayor Ralph B. Slippy, representing the Grand Chapter charity Fund R. A. M. of Iowa,
bid. Par, accrued interest and a premium of -10.00.
The final bid was Par, accrued interest plus premium of 15.00.
14181 - Moved by Lang, seconded by Dolan that Resolution No. 8513, accepting the bid
of the Grand Chapter uharity Fund, R. A.,Y. of Iowa of Par, accrued interest plus
,115.00 premium for Sewer Contract No. 34 bonds in the sum of '13,282.86, be adopted.
On roll call Burtner, Dolan, oder, Lang and Strang voted Aye. Nays: None. Absent:
Shane. I:ayor declared the resolution adopted.
14182 - Doved by Lang, seconded by Strang that the Petition and Waiver of G. T. Bennett,
et al for oiling all of Norfolk Road between West Fourth Street and Berkshire Road,
be received, placed on file and the Street Commissioner instructed to do the work.
0n roll call Burtner, Dolan, Joder, Lang and Strang voted Aye. Nays: Hone. Absent:
Shane.
Mayor declared the motion carried.
14183 - Moved by Joder, seconded by Burtner that the petition of Theo. Winninger, 401
Jefferson St., et al objecting to the resurfacing of Jefferson Street between W.
Park Ave. and W. 3rd Street and on W. 3rd Street between Commercial and Jefferson
Sts., be received and placed on file. Motion carried.
14184 - Moved by Lang, seconded by Joder that the petition of Floyd E. Hershberger,
327 West 3rd Street, et al, objecting to the resurfacing of West 3rd Street be-
tween Bluff Street and Tefferson Street, be received and placed on file. Motion
carried.
14185 - The City Clerk submitted proof of publication of the Notice to Contractors,
Paving Contract No. 34, and on motion by Lang, seconded by Dolan the same was re-
ceived and placed on file.
Mayor Slippy announced that the time having arrived for opening bids for resurfacing,
etc., under Paving Contract No. 34 that the council would now proceed with the same.
14186 - 0n motion by Lang, seconded by Burtner the City Clerk was instructed to proceed
with the opening of bids, which were read as follows:

14187 - On notion by Lang, seconded by Strang the foregoing bids were received, placed on
file and referred to the Council as a Committee of the Whole.
14188 - The City Clerk submitted proof of publication of Notice of Hearing on Proposed pla
specifications and proposed form of contract for repair and/or reconstruction of the
series boulevard lighting system on the west side of the Cedar River in the City of
Waterloo, Iowa, and on motion by Joder, seconded by Burtner the said proof of publicat
was received and placed on file.
There being no written or oral objections to the said proposed plans, specifications a
proposed form of contract for repair and/or reconstruction of the series boulevard
lighting system on the west side of the Cedar River, Mayor Slippy instructed the Counc
to proceed with t he regular order of business.
14189 - The City Clerk submitted proof of publication of Notice of Assessment, Paving
Contract 03, and on motion by Toder, seconded by Strang said proof of publication was
received and placed on file.
There being no written or oral objections to the assessment for paving under Contract
No. 33, the Mayor instructed the Council to proceed with the regular order of business.
14190 - The City Clerk submitted proof of publication of Notice to Coal Dealers for approl
innately 242 tons of a)al for the various municipal buildings for the current year, and
on motion by Lang, seconded by Strang said proof of publication was received and place
on file.

14191 - On motion by Toder, seconded by Burtner the city clerk was instructed to proceed
with the opening of said coal bids, which were read as follows:

14193 - The City Clerk submitted proof of publication of the Notice of Resolution of
Necessity No. 8487, being a proposed resolution of necessity for the construction of
lateral sewer on Boston Street known as Sewer Contract No. 38, and on motion by Dolan,
seconded by Lang, said proof of publication was received and placed on file.
There being no objections written or oral, the Mayor instructed the council to proceed
with the regular order of business.
14194 - On motion by Lang, seconded by Dolan the communication from Street Commissioner,
A. C. Behrens, recommending the purchase of two Buckeye Agitatos at 52.50 each, was
received, placed on file and referred to the council as a committee of the Whole.
14195 - On motion by Lang, seconded by Dolan the communication from A. C. Behrens, Street
Commissioner, recommending seal -coating of various streets at an approximate cost of
5,500.00, was received, placed on file and referred to the council as a committe of
the whole.

14196 - On motion by Lang, seconded by Burtner the petition, and accompanying plat, of
Mr. and Mrs. Ben Barg for permission to erect a two-story business building and
basement on Lot 11, Beal's Addition to the city of Waterloo, Iowa, were received,
placed on file and referred to the council as a committee of the whole.
14197 - Moved by Toder, seconded by Lang that the petition of Lester W. Miller and
accompanying plat, to erect a grocery store on Lots 10 and 11, Block 8, Hagerman
Addition, be received, placed on file and permit granted.

14198 - 0n motion by Lang, seconded by Strang the petition of Frank B. Schrader, 518
Sumner Street, et al for the boulevardinr! of Sumner Street and for the elimination
of parking in the first two blocks on Sumner Street from East Fourth Street east,
/ was received, placed on file and referred to the ordinance Committee.
14199 - On motion by Dolan, seconded by Burtner the communication from C. G. Forney, et
al, waiving objections to the oiling of Donald. Street, was received, placed on file
and referred to the council as a committee of the whole.
14200 - Loved by Lang, seconded by Strang that the communication from Street Commissioner;
A. C. Behrens, announcing the request for the building of crosswalks at Hoover and
Forrest; Byron and. Baltimore and. Eureka and. Baltimore, be received, placed on file
and the Street Commissioner authorized to do the work.

14201 - un notion by Toder, seconded by Lang that the financial report of the City Cab
Company covering the period of May 1, 1940 to July 31, 1940 inclusive, was received
and placed on file.
14202 - On motion by Dolan, seconded by Strang the petition of Theo. Winninger, 401
Jefferson St., et al, asking for two-hour parking zone on Jefferson Street between
Park Avenue and. West Third Street, and on West Third. Street between Commercial and
Jefferson Streets, was received, placed on file and referred to the Ordinance
Cormnittee.
14203 - 0n motion by Dolan, seconded by Strang the communication from F. E. Wilkin,
lectrical Inspector, relative to power and light for the sewer lift station on
Douglas Street (Sewer Contract W26), was received and placed on file.
14204 - Loved by Dolan, seconded by Strang that the communication from. 7. B. Barber,
city Engineer, asking permission to wax the new truck purchased for the Engineering
Department, and to store same in the Harry Peterson garage at a cost of 5.00 per
month, be received, placed on file and request granted.

14205 - On motion by Strang, seconded by 1)olan the copy of the communication by Mayor
Ralph B. Slippy to Roger 1. urowell notifying him of his appointment as water works
Trustee, was received and placed on file.
14206 - On motion by Strang, seconded by Toder the General Notice of Dena Stoyanoff vs
various claimants to settle title to certain property, was received, placed on file
and referred to the City Attorney.
14207 - Moved by Lang, seconded by Strang that the communication from the Young Goal
Company, rebuesting refund of '42.00 on heating permit w2207 because said permit was
not used, be received, placed on file and refund authorized.

14208 - On motion by Dolan, seconded by Strang the application, and accompanying bond,
of Burton Avenue Grocery and.Big T Fbod Yiarket to transfer their cigarette permit
to 950 W. parker Street, were received, placed on file and granted.
14209 - Moved by Lang, seconded by Strang that the communication from N. B. Barber, City
Engineer, notifying the council that Minnie May Kniss had asked the city to divide
the sewer assessment on Byron Avenue rot Lots 45 and 46-, Hollandale Addition to show
the amount that should be charged to the West 451 bf the East 170' of Lots 45 and
46, Hollandale Addition',be received, placed on file and Resolution No. 8514, dividing
sewer certificates numbered 9316-e, 9316-f and 9316-g, be adopted.

14210 - Moved by Strang, seconded by Lang that the communication from N. B. Barber, City
Engineer, stating that an error had been made in the sewer assessment of lAary McMulla
covering Lot 18, Block 12, Hillside Addition, be received, placed on file and that
Resolution No. 8515, correcting assessment for sewer assessed against lot 18, Block
12, Hillside Addition in Sewer Contract No. 34, and authorizing the City Clerk to
change his records accordingly, be adopted.

14212 - On motion by Joder, seconded by Strang the Notice of personal injury of Gertrude
E. Fitkin was received, placed on file and referred to the City Attorney.
14213 - Moved by Lang, seconded by Strang that the communication from E. S. Estel, SecretarY
Manager, The Dairy Cattle Congress, asking that the city oil certain streets and walks
on the dairy cattle congress grounds with the understanding that the Dairy Cattle
Congress will pay for the same, be received, placed on file and the Street Commissione
instructed to proceed with the work.

14214 - On motion by Joder, seconded by Strang the communication from George C. Heath,
asking permission to erect six metal welcome signs at the city limits of each of the
three main highways entering Waterloo, was received, placed on file and permission
granted - said work to be done under the supervision of the Lieutenant of Traffic.
14215 - Moved by Lang, seconded by Strang that the communication from: H, L. Green, 1314
Jefferson Street, asking that the 7-ft. strip in. the 'center of the paving on j-effe±son
Street between West llth and West 12th Streets be oiled and the expense of the same
charged to him, be received, placed on file and the Street Commissioner instructed to
do the work.

14217 - On motion by Strang, seconded by Toder the communication of N. B. Barber, City
Engineer, together with plat and schedule of assessments for Oiling Project No. 2,
Year 1940, were received and placed on file.
14218 - On motion by Toder, seconded by Burtner the report of City Engineer, N. B. Barber,
of a proposal of N. Y. A. Officials to give the City of Waterloo a project for the
maximum cost of $1000.00 to the City for constructing a river road to serve the Cattl
Congress Grounds, was received and placed on file.
14219 - 0n motion by Burtner, seconded by Dolan various claims for poll tax exemption for
the Year 1940 were received, placed on file and referred to the Finance Committee.
14220 - On motion by Dolan, seconded by Lang the application of David M. Shepard, 217
Falls Avenue, for taxicab driver's license, together with doctor's certificate, were
received, placed on file and approved - subject to the approval of the Chief of Police.
14221 - Moved by Dolan, seconded by Lang that the application of Ray Randall d/b/a People,
Market, 349 LaPorte Road, and bond, for Class "C" Beer Permit, be received, placed on
file and Resolution No. 8516, granting same, be adopted.

Barber, offering to supervise the remodeling of the hand -rail on Fifth Street Bridge,

Docket Iowa 1254-F, by T. W. Darragh of Cedar Rapids, Iowa, Contractor, was re-
ceived and placed on file.
14225 - On motion by Councilman Strang, seconded by Councilman Toder the report of C.T.
Wilson, certifying completion of Section "L" of the Waterloo Sewage Disposal Plant,
Docket Iowa 1254-F, by Dobson and Robinson, Lincoln, Nebr., Contractors, was re-
ceived and placed on file.
14226 - Moved by Toder, seconded by Strang that the communication from C. T. Wilson re-
lative to the sodding of certain riverfront property be received, placed on file
and referred to the committee on public grounds with power to act.

14227 - On motion by Lang, seconded by Toder the report of City Engineer N. B. Barber
relative to the completion of Sewer Contract No. 37, I3yrnbrae Replat, and recommend-
ing acceptance of said work, was received and placed on file.
14228 - On motion by btrang, seconded by Lang the communication from. A. A. Sekt, Owner's
dedication, Engineer's certificate of survey and plat of K. E. George Addition located
on Lots 11 and 12, Mitchell's Outlots on the west side of the river in the City of
Waterloo, Black Hawk County, Iowa, were received and placed on file.
14229 - On motion by Toder, seconded by Burtner the report of the Finance Committe re-
lative to the sale of certain city owned properties was received, placed on file
and approved.
14230 - Moved by Strang, seconded by Burtner that Resolution No. 8517, approving the
plat known as N. E. George Addition, .be adopted.
On roll call Burtner, Dolan, Joder, Lang and Strang voted Aye. Nays: None. Absent;
Shane. Mayor declared the resolution adopted.
14231 - An Ordinance amending Ordinance 1546 by limiting parking on part of Ballou Street
to two hours and prohibiting drivers from coming from an alley, driveway or building
without stopping their vehicle before entering a street, was read by the Clerk.
Moved by Joder, seconded by Lang that the rules be suspended for the purpose of
placing said ordinance on its passage, being Ordinance No. 1571.
On roll call Burtner, Dolan, Toder, Lang and Strang voted Aye. Nays: None. Absent:
Shane.
14232 - Moved by Strang, seconded by Lang that said ordinance be considered to have
passed its first, second and third reading.

Moved by Strang, seconded by Toder that an ordinance amending Ordinance 1546 by
limiting parking on part of Ballou Street to two hours and prohibiting drivers from

entering a street, be adopted, being Ordinance No. 1571.
