ORDINANCE NO. 5362
AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS
AMENDED, CITY OF WATERLOO ZONING ORDINANCE, BY
AMENDING THE OFFICIAL ZONING MAP REFERRED TO IN
SECTION 10-4-4, APPROVING A REQUEST BY MUHAMED KUDIC
FOR A REZONE OF 5.45 ACRES FROM "R-3, R -P" PLANNED
MULTIPLE FAMILY RESIDENCE DISTRICT TO "C -P" PLANNED
COMMERCIAL DISTRICT, TO ALLOW FOR THE CONSTRUCTION
OF A NEW ELECTRICIAN CONTRACTOR BUSINESS AND FOR
FUTURE DEVELOPMENT, GENERALLY LOCATED AT THE
SOUTHEAST CORNER OF SOUTHLAND DRIVE AND SERGEANT
ROAD.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA
AS FOLLOWS:
Section 1. That the Official Zoning Map referred to in Section 10-4-4, Rezoning Certain
Property, of Ordinance no. 5079, is amended, City of Waterloo Zoning Ordinance, be amended to
rezone the property legally described as follows:
"R-3, R -P" Planned Multiple Family Residence District to "C -P" Planned Commercial District
THAT PART OF THE SOUTHWEST QUARTER OF SECTION SEVEN (07),
TOWNSHIP EIGHTY-EIGHT NORTH (T88N), RANGE THIRTEEN WEST (R13W) OF
THE FIFTH PRINCIPAL MERIDIAN, WATERLOO, BLACK HAWK COUNTY,
IOWA, DESCRIBED AS FOLLOWS:
LOT NO. C-7 AND LOT NO.0-8 IN SOUTHLAND PARK FOURTH ADDITION,
WATERLOO, BLACK HAWK COUNTY, IOWA.
AND
BEGINNING AT THE MOST SOUTHERLY CORNER OF AFORESAID LOT NO.0-8;
THENCE SOUTHWESTERLY ALONG THE NORTHWEST RIGHT-OF-WAY LINE
OF CHARM DRIVE, AS PLATTED IN AFORESAID FOURTH ADDITION, TO THE
MOST WESTERLY CORNER OF SAID CHARM DRIVE; THENCE CONTINUE
SOUTHWESTERLY ALONG THE SOUTHWESTERLY EXTENSION OF SAID
RIGHT-OF-WAY LINE TO THE NORTHEAST LINE OF PARCEL DESCRIBED IN
LAND DEED 551, PAGE 281 IN THE BLACK HAWK COUNTY RECORDER'S
OFFICE; THENCE NORTHWESTERLY ALONG SAID NORTHEAST LINE TO THE
SOUTHEASTERLY RIGHT-OF-WAY LINE OF U.S. HIGHWAY NO. 63; THENCE
NORTHEASTERLY ALONG SAID SOUTHEASTERLY RIGHT-OF-WAY TO THE
MOST WESTERLY CORNER OF AFORESAID LOT NO. C-8; THENCE
SOUTHEASTERLY ALONG THE SOUTHWEST LINE OF SAID LOT NO.0-8 TO THE
POINT OF BEGINNING;
now zoned on the Official Zoning Map of Waterloo, Iowa, approximately 5.45 acres of generally
located at the southeast corner of Southland Drive and Sergeant Road, as "R-3, R -P" Planned
Multiple Family Residence District, be and the same is hereby rezoned as "C -P" Planned
Commercial District, as above described, and subject to the following conditions:

1. That the final site plan meets all applicable city codes, regulations, etc.
limited to, parking, landscaping, drainage, etc.
Section 2. That the City Clerk is hereby authorized and directed to file
this Ordinance with the Recorder of Black Hawk County, Iowa.
