Council Proceedings Record, City of Waterloo 1 C801.4 FARRO-7& SONS WATERLOO, WV NUMBER TITLE REGULAR SESSION January 8th, 1940 RECORD The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers in the City Fall in said City at 8 o'clock P. M., January 8th, 1940. Mayor Ralph B. Slippy in the Chair. Present: Councilmen J. D. Burtner; T. E. Dolan; Earl B. Joder; W. J. Lang; Stanley B. Shane and Dewey W. Strang. Absent: None. 13227 - On motion by Joder, seconded by Burtner the minutes of the Regular Session of December 26th, 1939, and the Adjourned Session of December 29th, 1939, were received, placed on file and approved. 13228 - Mayor Slippy announced the time having arrived for considering objections to assessments for sewers constructed uhder Sewer Contract No. 31 that the Council would now proceed with the consideration of the same. The City Clerk submitted proofs of publications of the Notice of Assessment for sewers constructed under Sewer Contract No. 31, and on motion by Lang, seconded by Rurtner said proofs were received and placed on file. 13229 - 0n motion by Joder, seconded by Burtner the written objection of Elmer J. Mulvey regarding the assessments against Lots 20, 21, 22, 23, 33, 34 and 35, 1st Addition to Prospect Hills, was received and placed on file. There were no oral objections offered. 13230 - Mayor Slippy announced the time having arrived for considering objections to assessments for sewers constructed under Sewer Contract No. 32 that the Council would now proceed with the consideration of the same. The City Clerk submitted proofs of publications of the Notice of Assessment for sewers constructed under Sewer Contract No. 32, and on motion by Rurtner, seconded by Dolan said proofs were received and placed on file. There were no written or oral objections filed or presented. 13231 - Mayor Slippy announced the time having arrived for considering objections to assessments for sewers constructed under Sewer Contract No. 33 that the Council would now proceed with the consideration of the same. The City Clerk submitted proofs of publications of the Notice of Assessment for sewers constructed under Sewer Contract No. 33, and on motion by Lang, seconded by Burtner said proofs were received and placed on file. There were no written or oral objections filed or presented. 13232 - Moved by Strang, seconded by Lang that Resolution No. 8268, overruling objections and making assessments for the construction of main and lateral sewers under Sewer Contract No. 31, be adopted. 0n roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted Aye. Nays: None. Mayor declared the resolution adopted. 13233 - Moved by Lang, seconded by Joder that Resolution No. 82691 making assessments for the construction of lateral sewers on Ryron Avenue and West 7th Street, Sewer, Contract No. 32, be adopted. On roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted Aye. Nays: None. Mayor declared the resolution adopted. 13234 - Moved by Joder, seconded by Lang that Resolution No. 8270, Making assessments for the construction of lateral sewer on Dearborn Avenue from Colorado Street to Adrian Street, Sewer Contract No. 33, be adopted. On roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted. Aye. Nays: None. Mayor declared the resolution adopted. 13235 - 0n motion by Lang, seconded by Rurtner the communication from Max Petrie, asking for a larger light adjacent to the Blue Mill Service Station on Cedar Rend, was receive placed on file and referred to the Water, Sewer & Gas Committee. 13236 - Moved by Lang, seconded by Strang that the offer of June S. and Walter Melohn of U0.00 for a parcel of ground 16' wide and 164' long owned by the City of Waterloo and dedicated as an alley in Block 1, Highland Second Filing and extending from Alta Vista Avenue on the northerly side of said Block 1, Highland Second. Filing to the dedicated alley intersecting Blocks 1 and 2, Highland. Second Filing, connecting Steely Street and Highland. Boulevard, be received, placed on file and accepted. 0n roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted Aye. Nays: None. Mayor declared the motion carried. SHEET NO. Ankeny, 126 Harrison St., was received, placed on file and re- ferred to the Finance Committee. 13238 - On motion by Lang, seconded by Shane the application of F. vesser Smith, 1217 Sycamore Street, for a position in the new sewage disposal plant, was received and placed on file. 13239 - 0n motion by Strang, seconded by Dolan the communication from Fire Chief Ray Tiller to the Mayor and Council, and a copy of a letter by Chief Tiller to Mr. Nicholas L. Etten, V. Pres. & Gen. Mgr., The Chamberlain Corp. relative to building certain additions to the Chamberlain Plant without conforming to the requirements of the Building Code, were received, placed on file and referred to the Council as a Committee of the Whole. 13240 - 0n motion by Joder, seconded by Shane the Patrolman's Bond of Reginald G. Mahnke, was received, placed on file and approved. 13241 - On motion by Lang, seconded by Joder the communication from F. R. White, Chief Engineer, Iowa State Highway Commission, relative to the routing of. U. S. Road #63 through Waterloo from Grant Avenue to Washington Street, was received and placed on file. 13242 - On motion by Lang, seconded by Burtner the Engineer's Certificate and Plat for Thomas & Brinker Addition, were received and placed on file. 13243 - On motion by Strang, seconded by Shane the communication from Geo. L. McCaughan, Secretary, Iowa State Commerce Commission, Des Moines, Iowa, notifying the City that the Iowa State Commerce Commission has prepared an order which approves Ordinance No. 1545, together with a copy of said order, were received and placed on file. 13244 - Moved by Dolan, seconded by Strang that the report of City Engineer, C. T. Wilson, estimating that it will cost about 750.00 to construct a sidewalk outside of the hand rail on the upper side of the bridge on Lincoln Street across Virden Creek, and requesting instructions from the council as to whether the walk should be 6' or St in width, be received, placed on file and that Resolution No. 8271, instructing the City Engineer to proceed with the construction of a 6-ft. walk in accordance with the provisions of his report, be adopted. 13245 - On motion by Strang, seconded by Shane the petition of the Daughters of Union Veterans, Tent #16, by Mrs. Fred Bingaman, Patriotic Instructor, requesting permission to sell Lincoln Tags on the streets in the city on February 12, 1940, was received, placed on file and request granted. 13246 - On motion by Joder, seconded by Lang the report of City Engineer C. T. Wiison, estimating it will cost about 6000.00 to repair Fifth Street 'ridge, was received, placed on file and referred to the Council as a Committee of the Whole. 13247 - On motion by Shane, seconded by Dolan the application of Fred C. Sloan for a permanent position at the sewage disposal plant was received and placed on file. 13248 - On motion by Lang, seconded by Dolan the communication from the officers and directors of the League of Iowa Municipalities, requesting all municipal officials to lend their support to the state candidates .who are interested in the problems of municipalities, was received and placed on file. 13249 - Moved by Strang, seconded by Lang that the communication from City Engineer, C. T. Wilson, recommending certain changes in Section A, Contract #2; Section B, Contract d3, Section C, Contract #4, and Section D, Contract #5, representing a total cost of $1,388.38, be received, placed on file and that Resolution No. 8272, approving changes in certain contracts for a sewage disposal plant, as recommended by the City Engineer, be adopted. On roll call Burtner, Dolan, -Joder, Lang, Shane and Strang voted Aye. Nays: None. Casey, 1443-1445 Sycamore Street; Class 'C", Mrs. Vera Randall, 1421 Commercial Street. 13252 - On motion by Joaer, seconded by Shane the following applications, and accompany- ing bonds, for permission to sell cigarettes at the designated locations, were received, placed on file and permits granted: E. W. Koepke, 100 East Park Avenue; W. A. McManus, 613i Water Street. 13253 - On motion by Dolan, seconded by Burtner the communication from J. J. Madigan, Acting Commissioner of Public dorks, Washington, D. C., advising Mayor Slippy that he felt that unsatisfactory progress was being made in the construction of the sewage treatment plant project at Waterloo, designated as Tocket No. Ia. 1254-F, was received, placed on file and referred to the City Fmaineer. 13254 - On motion by Dolan, seconded by Shane the report of Frank McGowan, Acting City Electrical Inspector, informing the council that the Apex Electric 7ardware Company has completed the installation of traffic signals at ten street intersections, and that he believes the work was well done and fully complies with the contract for the same, was received, placed on file and approved. 13255 - On motion by Strang, seconded by Shane the following reports of City Officers for the Month of December, 1939, unless otherwise designated, were received, placed on file and referred to the respective committees: S. A. Dudley, Building Commissioner, Annual Report; Knapp F. Matthews, Auditor and Clerk; George W. Nauman, City Treasurer; S. A. Dudley, Building Commissioner; David F. Boynton, Plumbing and Gas Inspector; Frank McGowan, Acting Electrical Inspector; F. A. Sporle, Sanitary & Milk Inspector; E. W. Koepke, Municipal Court Clerk; H. R. Crumrine, Chief of Police; A. C. Mayor declared the resolution adopted. 13258 - Moved by Burtner, seconded by Lang that Resolution No. 8275, accepting and approv- ing the Plat known as "Thomas & Brinker Addition" in. the City of Waterloo, Black Hawk County, Iowa, be adopted. On roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted Aye. Nays: None. Mayor declared the resolution adopted. 13259 - Moved by Shane, seconded by Burtner that Resolution No. 8276, accepting the work of the Apex Electric & Hardware Company, Waterloo, Iowa, for the installation of traffic signals at ten (10) intersections -in the City of Waterloo, Iowa, be adopted. On roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted Aye. Nays: None. Neyes: None. Mayor declared the resolution adopted. 13261 - On motion by Lang, seconded by Strang the Mayor end Council were instructed to meet with H. M. Smith, Ass't Gen. Mgr. of the Eastern Division of the Iowa Public Service Company, before the next regular session of the city council to talk over a new light rate schedule for the City of Waterloo. RECORD 13262 - An Ordinance vacating an alley in Block 1, Highland Second Filing in the City of Waterloo, Iowa,. was read by the Clerk. Moved by Lang, seconded by Dolan that the rules be suspended for the purpoe of placing said ordinance on its passage, being Ordinance No. 1548. On roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted Aye. Nays: None. Absent: None. Moved by Shane, seconded by Dolan that said ordinance be considered to have passed its first, second and third reading. 0n roll call Burtner, Dolan, Joder, Lang, Shane and Strang voted. Aye. Moved. by Strang, seconded by Shane that said ordinance, being Ordinance No. 1548, vacating an alley in Block 1, Highland Second Filing in the City of Waterloo, Iowa, be adopted. Absent: None. 13264 - Moved -by Lang, seconded by Strang that Resolution No. 8278, ordering the Apex Electric & Hardware Company to install an additional stop and go signal at the inter- section of Falis Avenue and Mullen Avenue at a cost of $160.00, be adopted. On roll call Burtner, Dolan, Joder, Lang,. Shane and Strang voted Aye. Nays: None. Absent: None. Mayor declared the resolution adopted. 13265 - Moved by Lang, seconded by Strangthat Resolution No. 8279, authorizing the purchase of an electric welding machine fromMatt Heinen for the sum of $85.00, be adopted. 13266 - Moved by Lang, seconded by Dolan that Resolution No. 8280,'approving applications for beer permits, be adopted. Eureka Fire Hose Division of United States Rubber Co., New York, N. 7. 13271 - 0n motion by Strang, seconded by Burtner the foregoing bids on fire hose were received, placed on file and referred to the Council as a Committee of the Whole. 13272 - On motion by Lang, seconded by Dolan the application of Fred Holbach, 342 Wyoming Street for a maintenance job at the new sewage disposal plant was received and placed on file. 13273 - On motion by Lang, seconded by Burtner the communication from the Associated Manufacturers, Inc., calling attention of the counc13 and the mayor to the fact that apparently thru an oversignt an ordinance adopted years ago vacating a certain alley between Miles Street and West Mullan Avenue was not published, and asking that the council now adopt a similar ordinance vacating said alley and causing publica- tion of the ordinance as provided by law, was received and placed on file. 13273-A - On motion by Lang, seconded by Strang the applications of the City Cab Company for transfer of taxicab licenses from cabs with Plate #18 to 1940 Oldsmobile Motor #G-119653; Factory #711809 and State License #7-9681, and Plate #19 to 1940 Oldsmobile, Motor #G-142597; Factory #722217 and State License #7-9680, together with Endorsement showing insurance coverage, were received, placed on file and approved. 13274 - On motion by Dolan, seconded by Shane the application from John Durst for a job as pump operator at the sewage disposal plant, was received and placed on file. 13275 - 0n motion by Dolan, seconded by Shane the application of Richard 7. Eugene Thornton, was received, placed on file and referred to the City Attorney. 13277 - Moved by Lang, seconded by Strang that the communication from the City Clerk, together with proposed settlement of fire loss at the East Street barns in the sum of $571.52, be received, placed on file and approved. Moved by Dolan, seconded by Shane that the rules be suspended for the purpose of placing said ordinance on its passage, being Ordinance No. 1550. On roll call Burtner, Dolan, Lang, Shane and Strang voted Aye. Nays: None. Absent: Joder. W. A. Docket Iowa 1254-F, sewage disposal plant, to June 1, 1940, and that he file same with R. A. Radford, Regional Director, Federal Eniergency Administration of Public Works, Omaha, Nebraska. 0n roll call Burtner, Dolan, Lang, Shane and Strang voted Aye. Nays: None. Absent: Joder. Nuehring, d/b/a krg:rle Gardens that his Beer Permit #895 and Cigarette Permit #1244 be cancelled as of Jenuary 29, 1940, was received, placed on file and request granted. 13293 - Voved by Shane, seconded by Burtner that the applications and accompanying bonds, of Sultana Sportsmen's Club, Inc., 616 Sycamore Street, and Yrs. 1?ertha Lamb, d/b/a Argyle Gardens, 519 Argyle Street for Class "P" Beer Permits, end the application and endorsement to bond of C. J.
