M., January 12th, 1942. Mayor Ralph B. Slippy absent. J. D. Burtner, President of the Council, in the Chair. Present: Councilmen Dolar Toder, Shane, Strang and. Turner. Absent: None. 16310 - On motion by oder, seconded by Dolan the minutes of the Regular Session held 8 o'clock P. M., December 22nd, 1941, were received, placed on file and approved 16311 - 0n motion by Shane, seconded by Strang the Proof of Publication of Notice to Bc Buyers in connection with iewer Contract No. 48, was received and placed on file. 16312 - The Clerk asked if there were any bidders present to offer bids for the bonds i connection with Sewer Contract No. 48. There being no bidders present, it was moved by Joder, seconded by Strang that Resolution No. 8919, directing the issuance of Sewer Bonds in payment of Sewer Contract No. 48 to the Contractor, John Rooff, Waterloo, Iowa, be adopted. 0n roll call Dolan, Joder, Shane, Strang and Turner voted Aye. Nays: None. Absent: None. Chair declared the Resolution adopted. 16313 - On motion by Strang, seconded by Shane the application of Harley 2. Rice, 225 E. Mullan Avenue, for position as operator, operator's assistant or any other open at the Sewage Disposal Plant, was received and placed on file. 16314 - 0n motion by Joder, seconded by Strang the communication from Virgil Weibel, 30 Iowa Street, regarding the disposition of a truck he left parked on the street in 1940, together with a report from. A. C. Behrens, Street Commissioner, were receive and placed on file. 16315 - On motion by Strang, seconded by Shane the communication from A. C. Behrens, Street -Commissioner, regarding merchants shoveling snow off the sidewalks onto the streets, was. received, placed on file and referred to the Ordinance Committee. 16316 - On motion by Strang, seconded by Dolan the communication from Ralph B. Slippy, Mayor, announcing the reappointment of Roger Crowell to the Board of Waterworks Trustees for the term of six years, effective as of January 12th, 1942, was received, placed on file and appointment approved. 16317 - 0n Motion by Joder, seconded by Shane the claim for poll tax exemption for the Years 1941 and 1942 of Burr W. Ransom, 912 W. 7th Street, was received, placed on file and referred to the Finance Committee. 16318 - On motion by Dolan, seconded by Shane the applications for taxicab drivers' liconses, together with doctor's certificates, of Jess Gregory, 1920 Westfield Avenue; Lawrence Ackerman, 1013 Columbia Street; Ivan Wilharm, 655L- Summit AvenuE and John Frederick Spore, 1521 Black Hawk Street, were received, placed on file E granted - subject to the approval of the Chief of Police. 16319 - 0n motion by Shane, seconded by Dolan the application of the Forum Yellow Cab Company for taxicab auxiliary license for a Ford. V-8 Tudor, Motor #6590393, Stat License #7-2145, was received, placed on file and approved, subject to the insur coverage being approved by the City Attorney. 16320 - 0n motion by Strang, seconded by Joder the Original Notice of Gertrude Fitkir the City of Waterloo, Iowa, claiming $5,000.00 for alleged personal injuries, received, placed on file and referred to the City .Attorney. 16321 - 0n motion by Strang, seconded by Dolan Original notices of suits in District Court of the State of Iowa, in and for Black Hawk County, filed by C. H. Berend Katherine Berend and twelve others against the City of Waterloo, Iowa, for dana resulting from alleged odors from the sewage disposal plant, were received, pla on file and referred to the City Attorney. 16322 - Moved by Shane, seconded by Dolan that the claim of Virgil V. Zubrod, d/b/a Virgil's Place, 219 West 6th Street, for refund on his Class "B" Beer Permit N+ 1126, be received, placed on file and proper refund granted. On roll call Dolan, Joder, Shane, Strang and Turner voted Aye. Nays: None. Absent: None. Chair declared the motion carried. 16323 - Moved by Joder, seconded by Turner that the application of Helen Harrison, Home Like Cafe, 210 Division Street, Pernit No. 1684, and Virgil V. Zubrod, di Virgil's Place, 216 W. 6th Street, Permit No. 1778, for refunds on said permi' received, Placed on file and proper refunds granted. Chair declared the resolution adopted. 16325 - Moved by Shane, seconded by Turner that the following applications and accompanyin bonds for beer permits as designated be received, placed on file and that Resolution No. 8921, approving said applications, be adopted. Chair declared the resolution adopted. 16326 - On motion by Strang, seconded by Turner the following applications and accompanyin bonds for permission to sell cigarettes at the velrious locations designated were received, placed on file and permits granted: Emil Bunker, 326 West Fourth Street; Louise Salsburg, tfa Shaw Grocery, 453 West Parker Street; Ivadelle Schneck, d/b/a Schneck's Tavern, 219 West Sixth Street. 16327 - 0n motion by Dolan, seconded by Strang the followin bonds were received, placed on file and approved - subject to the approval of the city attorney: Official Bonds: S. A. Dudley, Building Commissioner; Roger I. Crowell, Water Works Board Trustee. 16328 - On motion by Dolan, seconded by Shane the following reports of City Officials for the Month of December, 1941, were received, placed on file and referred to the resped. tive committees: Knapp F. Matthews, City Auditor and Clerk; Geo. W. Nauman, City Treasurer; S. A. Dudley, Building Commissioner; David. F. Boynton, Plumbing and Gas Inspector; Frank E. Wilkin, Electrical Inspector; Fred. A. Chair declared the resolution adopted. 16330 - Moved by Joder, seconded by Strang that the Street Department be complimented for the fine way in which it removed the snow after the recent storm. Chair declared the motion carried. 16331 - On motion by Strang, seconded by Dolan the matter of selling to Floyd E. Cole certain property located in Block 15, Hayes Addition, was referred to the Assistant City Attorney. 16332 - Moved by Dolan, seconded by Strang that the City Clerk be authorized to settle the claim of George Plummer in .accordance with the State Law. 0n roll call Dolan, Joder, Shane, Strang and Turner voted Aye. Absent: None. 16334 - On motion by Joder, seconded by Burtner the minutes of the Regular Session held at 8 o'clock P. M., January 12th, 1942, were received, placed on file and approved. 16335 - On motion by Joder, seconded by Dolan the communication from the W. C. T. U. relative to the alleged sale of cigarettes to minors and various other matters was received and placed on file. 16336 - Moved by Dolan, seconded by Strang that the communication from W. J. Lang, Secretary and General Manager, Waterloo Water Works, asking that the city waive charges on waterworks paving cuts when the improvement is for the general benefit of the city rather than for revenue purposes, be received, placed on file and request approved; that present charges of this typebe cancelled by the City Clerk's Office and that the City Engineer be authorized to make no charges on such cuts in the future. On roll call Burtner, Dolan, Joder, Shane, Strang and Turner voted Aye. Nays: None. Absent: None. Mayor declared the motion carried. 16337-- On notion by Burtner, seconded by Dolan the request of Mrs. George Carpenter, Secretary of Jane Kirkwood Tent #16, Daughters of Union Veterans ,of the Civil War, asking permission for that organization to conduct a Lincoln Tag Day sale on the streets of the city on February 12th, 1942, was received, placed on file and re- quest granted. 16338 - Moved by Joder, seconded by Dolan that the petition of May Kellar for refund of $46.92 paid for Paving Cut Permit No. 5241 be received, placed on file and refund granted. On roll call Burtner, Dolan, Joder, Shane, Strang and Turner voted Aye. Nays: None. Absent: None. Mayor declared the motion carried. 16339 - Moved by Dolan, seconded by Burtner that the applications for refunds on cigarette mulct tax as follows be received, placed on file and granted: Permit No. 1853, Self Service Drugs, Inc. 320 E. 4th Street; Permit No. 1659, Gilbert Diemer, d/b/a Linn Gardens, 211 Linn Street. 16340 - Moved by Shane, seconded by Burtner that the claim for refund on beer tax of Gilbert Diemer d/b/a Linn Gardens, 211 Linn Street (Class "B" Beer Permit #1128) be received, placed on file and granted. Tibbitts, complimenting the street department for the manner ih which snow was removed during the recent blizzard, was received and placed on file. 16342 - On motion by Strang, seconded by Turner the application of the Forum Yellow Cab Company for taxicab auxiliary license for a Ford Sedan, Motor #18-6754647; State License 7-23934, was received, placed on file and approved. 16343 - On motion by Dolan, seconded by Shane the applications for taxicab drivers' licenses, together with doctors' certificates, of W. P. Dunson, 227 West 5th Street; Robert L. Wilson, 1102 Mulberry Street; Franke Patrick Ryan, Ellis Hotel, and Richie Darrel Thomas, 426 E. 4th Street, were received, placed on file and granted - subject to the approval of the Chief of Police. 16344 - Moved by Joder, seconded by Shane that the recommendations of C. T. Wilson, Supt. Sewage Disposal Plant, for adjustment in various sewage disposal charges, be received, placed on file and approved. Mayor declared the motion carried. 16350 - Moved by Dolan, seconded by Joder that Resolution No. 8924, fixing the amount of poll tax for the Year 1942, be adopted. Mayor declared the resolution adopted. 16351 - Moved by Joder, seconded by Turner that Resolution No. 8925, being a resolution providing for a permanent transfer of $28,250.00 from the Sewage Disposal Operating Fund to the Sewage Disposal Bond Fund, be adopted. Cowin asking that the Chamberlain Corporation be permitted to erect a fence on a certain portion of its, property in or adjacent to Esther Street for the duration of the war to safeguard the contract held by that company, be received, placed on file and that Resolution No. 8928, granting said company permission to erect said fence, be adopted.
