of Tames L. O'Neill for a funeral home at 618 West 4th Street.

Dolan. Chair declared the motion carried.
14034 - Moved by Shane, seconded by Burtner that the former action of the city council
granting James L. O'Neill a permit to conduct a funeral home at 618 West 4th Street
be rescinded, and that said permit be cancelled.
On roll call Burtner, Joder, Shane and Strang voted Aye. Nays: None. Absent:
Dolan. Chair declared the motion carried.

14036 - 0n motion by Lang, seconded by Shane the minutes of the Regular Session of Tune
24th, 1940 and the Special Session of June 27th, 1940, were received, Placed on
file and approved.
14037 - 0n motion by Burtner, seconded by Lang the proof of publication of the Notice
of Assessment - Sewer Contract No. .- was received and placed on file.
14038 - On motion by Lang, seconded by Burtner the City Clerk was instructed to open
bids for stokers for Fire Stations Nos. 3 and 4, which were read as follows:

14039 - On motion by Lang, seconded by Dolan the foregoing bids on stokers were received,
placed on file and referred to the Council as a Committee of the Whole.
14040 - On motion by Lang, seconded by Burtner the resignation of U. T. Wilson from the
position of City Engineer for the City of Waterloo, Iowa, to be effective as of
Tuly 1, 1940, was received, placed on file, accepted and the City Clerk instructed
to write Mr. Wilson a letter of appreciation of all members of the city administ-
ration for his services as City Engineer.
14041 - Moved by Burtner, seconded by Joder that the claim for refund of Cigarette
Yulet Tax made by Tom Adams, d/b/a Steamboat Gardens, 1338 Falls Avenue, be re-
ceived, placed on file and refund granted.

14042 - On motion by Toder, seconded by Lang a communication from G. L. Rounds, Regional
Engineer, PWA, suggesting that the city council adopt a resolution applying for an
extension of time to October 1, 1940 for the completion of the sewage disposal
plant, Waterloo, Iowa, designated as Docket Iowa 1254-F, was received and placed
on file.
14043 - 0n motion by Lang, seconded by Burtner the communication from Chas. D.Mullinex,
Assit. Engineer, btate Department of Health, together with a copy of a letter
written by Paul T3olton, Public health lingineer, in connection with the investigation

14049 - On motion by Toder, seconded by Shane the Notice of Personal Injury suit brought
by J. Stanley Bailey vs the City of Waterloo, Iowa, was received, placed on file and
referred to the City Attorney.
14050 - Moved by Strang, seconded by Shane that the report of N. B. Barber, stating that
because of an error in the issuance of Paving Cut Permit #4478 a refund in the sum of
6.88 should be made to L. A. Bernard for a paving cut at 916 Hawthorne Avenue, be
received, placed on file and refund granted. Motion carried.
14051 - Moved by Dolan, seconded by Shane that the report of N. B. Barber, calling
attention to property ownership and the necessity of certain changes to be made in
connection with assessments for sewer under Sewer Contract No. 30, be received,

Hawk Road, et al, protesting against the construction of the proposed Fletcher
Avenue and Cleveland Avenue Cut -Off, was received, placed on file.
14053 - Moved by Lan, seconded by Dolan that the specifications for coal be received,
placed on file, approved and that the City Clerk be authorized to advertise for
bids to be opened at 7:30 o'clock P. 11., August 12th, 1940. Motion carried.
14054 - On motion by Lang, seconded by Shane the •communication from Edw. Y. Rocho,
Freeport, 111., asking for payment of ;)6000.00 in connection with Estimate No. 2,
Docket No. Iowa 1254-F, Rath Industrial Line, together with reply made by the city
clerk, were received and placed on file.

for grading and oiling the alley between the Repass Automobile Company and Post
Office Building, for which the Repass Automobile Company agrees to pay, be re-
ceived, placed on file, granted and the Street Commissioner instructed to proceed
with the work.

a mop coat of asphalt on the concrete decks of the pump houses at 6th and 7th

14096 - Mayor Ralph B. Slippy administered the Oath of Office to Nathan E. Barber as
City Engineer, and to C. T. Wilson as Superintendent of the Sewage Disposal Plant.
14097 - Moved by Lang, seconded by Burtner that the estimat4 of the local budget of the
City of Waterloo, Iowa, having been duly considered, and the Council being fully
advised finds that date of hearing on said estimate should be fixed and does hereby
fix the 3lst day of July, 1940, at the hour of 4 o'clock F. M., of said day as the
date of hearing thereon, said hearing to be had at the Council Chambers in the City
Hall in said city, Black Hawk County, Iowa. That the City Clerk be directed to
publish the estimate and the notice of hearing as recuired by law in the Waterloo
Daily Courier, a newspaper of general circulation, published at Waterloo, the County

The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council
Chambers in the City Hall in said. City at 8 o'clock P. M., Tuly 22nd, 1940.
Mayor Ralph B. Slippy in the 'Chair. Present: Councilmen Burtner, Dolan, Joder, Lang

14099 - On notion by Burtner, seconded by Dolan the minutes of the regular session of
Tuly 8th, 1940, were received, placed on file and approved.
14100 - Mayor Slippy announced that the hour having arrived for hearing objections to
Proposed Resolution of Necessity No. 8461, the same relating to the resurfacing, etc.
of various streets in the City of Waterloo, Iowa, that the council would proceed with
said hearing.
The City Clerk submitted ,,roof of publication of Resolution No.8461, and on motion by
Dolan, seconded by Toder said proof of publication was received and placed on file.

Plant to be issued under the Workmen's Compensation Law, were received, placed on file
and referred to the Council as a Committee of the Whole.
14103 - On notion by Dolan, seconded by Burtner the petition of James E. 3aish, 821
Linden Avenue, et al, to replace Lot 11 and that portion of Lots 12 and 13 not now
occupied by a service station, in Block 3, Beal's Sub -Division to the City of Waterloo,
Ia., in the restricted residence district of the 2ourth Ward, was received and -placed
on file.
14104 - Moved by Toder, seconded by Lang that the communication from C. T. Wilson, Sewage
Disposal Plant Supt., asking permission to purchase certain material and labor for the
erection of a fence about the Secondary ularifiers at the Disposal Plant, be received,
placed on file and the City Clerk authorized to make said purchases. On roll call
Burtner, Dolan, Toder, Lang and Strang voted Aye. Nays: None. Absent: Shane. Mayor
declared the motion carried.
14105 - Moved by Strang, seconded by Dolan that the communication from C. T. Wilson, Supt,
of Sewage Disposal Plant, asking permission to purchase a barrel of Chloraline, be

The City Council of the City of Waterloo, Iowa, met in Special Session in the Council
Chambers, in the City Hall in the City of Waterloo, Iowa, at 4 o'clock P. M., Tuly
31st, 1940, pursuant to the following call:
"To T. D. Burtner, T. E. Dolan, Earl B. Joder, Warner 1. Lang,
Stanley B. Shane and Dewey W. Strang:
You and each of you are hereby notified that there will be
and is hereby called a Special Meeting of the Council of the
City of Waterloo, Iowa, to be held in the Council Chambers of
the above -named city, on the 31st day of TulY, 1940, at 4:00
o'clock P. 1.1.1 for the purpose of considering and acting upon
the following:
1 - Hearing on the 1941-42 Budget;
2 - Eearinr, on Oiling Program No. 3;
3 - To Consider and Act on Beer Permits;
4 - To consider passing resolution ordering reinoval
of water connections on Fourth Street, West Third
Street, and various other streets, in connection
with Paving Contract No, 34,
5 - To consider and take action on petition of Merritt
Miller to erect fruit and vegetable stand in restricted
residential district.

14156 - On motion by Toder, seconded by Strang, the copy of the call was received
and placed on file.
14157 - On motion by Strang, seconded by Burtner, the proof of Publication of the
Proposed Budget of the City of Waterloo, Iowa, for the Year 1941-42, was received
and placed on file.
Councilman T. E. Dolan reported present.
14158 - The City Clerk read the Proposed Budget Estimate for the City of Waterloo,
Iowa, for the fiscal year beginning April lst, 1941 and ending March 31st, 1942.
The clerk informed the Mayor and Council that no written objections had been
received or filed in his office. Whereupon, Mayor Ralph B. Slippy asked if any-
one present cared to make oral objection. No objections were made.
After due and careful consideration, there being no written or oral object-
ions, it was moved by Councilman Lang, seconded by Councilman Dolan, that the
Budget, as published in the Waterloo Daily Courier on the 10th day of July,
1940, be pproved, and that it shall be in words and figures as hereafter
shown.
On roll call Councilmen Burtner, Dolan, Joder, Lang and Strang voted Aye.
Nays: None. Absent: Shane.

the oiling of certain streets and alleys in the City of Waterloo, Iowa - Oiling
Project No. 3, Year 1940 - were received and placed on file:
L. A. Bickford, 1026 Bertch Avenue, et al, objecting to the oilinf, of West 9th
Street between Bertch Avenue and. Byron Avenue;
R. A. Burgess, 434 Reber Avenue, objecting to the oiling to summit Avenue from
Moir Street to Clough Street;
H. D. Kixson, 155 Summit Avenue, et al, objecting to the oiling of Marsh Street
from West 2nd Street to Summit Avenue.
L. A. Bickford appeared before the council substantiating his written petition.

Bertch Avenue, et al, for oiling on West 9th Street between Bertch Avenue and. Byron
Avenue to be included in the first oiling program in the spring of 1941, was re-
ceived, placed on file and ordered included in Oiling Program No. 1 of 1941.
14165 - On motion by Dolan, seconded by Lang, the communication from Nicol E. Maxwell,
d/b/a Lax's Inn, 227 West 5th Street, for the cancellation of his Class "B" Beer
Permit in favor of Virgil Zubrodts a7plication for a Class "B" Beer Permit at 1366
Sycamore Street, was received, placed on file and approved.
14166 - On motion by Dolan, seconded by Burtner, the applications, and accompanying
bonds, for beer permits as follows, were received, and placed on file.

Benny's, to transfer his Class "B" Beer Peruit from 715 Sycamore Street to 311-
313 East 7th Street, effective August 29th, 1940, was received and placed on file.
14168 - Moved by Dolan, seconded by Burtner, Resolution No. 8510, approving various
applications and bonds for beer permits in the City of Waterloo, Iowa, be adopted.

14171 - On motion by Burtner, seconded by Lang the minutes of the regular session of July
22nd, special Session of July 26th, and Special Session of July 31st, 1940, were
received, placed on file and approved.
14172 - On motion by Councilman Lang, seconded by Councilman Toder the proof of publicatio
of the Notice of Hearing on proposed plans, specifications and proposed form of contra
for the construction of a part of Section "G" of a Sewage Disposal Plant for the City
of Waterloo, Iowa, was received and placed on file.
There being no written or oral objections, L:ayor Ralph B. Slippy instructed the
council to proceed with the next order of business.

ratifying, confirming and approving plans, specifications and form of contract for
the construction of a part of Section. "G" of a sewage disposal plant for the City of
Waterloo, Iowa, F. W. A. Project, Docket No. Iowa 1254-F, be adopted.

14174 - 0n motion by Councilman Toder, seconded by Councilman Lang a communication from
Federal Emergency Administration of Public Works, being Project Memorandum No. 6,
Docket Iowa 1254-F, Sewage System, granting an extension of time for the completion
of the same to the 28th day of September, 1940, upon certain conditions, was received
and placed on file.
14175 - Moved by Councilman Burtner, seconded by Councilman Toder that Resolution No. 851';
accepting the conditons of the extension of the completion date to September 28, 1940
of the construction of the sewage disposal plant for the City of Waterloo, Iowa, Docke
Iowa 1254-F, be adopted.

14176 - The City Clerk submitted proof of publication of "Advertisement for Bids",
A. Project No. Iowa 1254-7, Waterloo Disposal Plant, and on motion by Councilman Tode/
seconded by Councilman Burtner said proof of publication was received and placed on
file.
Mayor Ralph B. Slippy announced that the time had arrived to consider "Supplemental
Bids" as specified under Section "G", Contract No. 8, Waterloo Sewage Disposal Plant,
P. W. A. Project No. Iowa 1254-14.
14177 - Moved by Councilman Burtner, seconded by Councilman Lang that the City Clerk be
instructed to proceed with the opening of said bids, which were opened and read by
the Clerk as follows:

A proposal bond in the amount of 5% of the base bid accompanied said bid, said
bond surety being the Massachusetts Bonding and Insurance Company, Boston, Mass.

(45 days required to complete work)
A proposal bond in the amount of 3,000.00 with Hartford. Accident and Indemnity
Company, Hartford, Conn., as surety, accompanied said bid.
