The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council
Chambers in the City Hall in said City at 8 o'clock P. M., Nay 12th, 1941.
May 12, 1941
Mayor Ralph B. Slippy in the Chair. Present: Councilmen Burtner, Dolan, Joder, Shane,
Strang and Turner. Absent: None.
15301 - On motion by Joder, seconded by Shane the minutes of the regular Session at
8 o'clock P. M., April 28th, 1941, were received, placed on file and approved.
15302 - On motion by Dolan, seconded by Burtner the letter of thanks from Glenn T.
Scott to the Mayor and Council was received and placed on file.
15303 - 0n motion by Strang, seconded by Dolan the communication from The Real McCoy
Truck Lines, Inc., asking permissionto cut the curb at 911 Sycamore Street, and
to widen the driveway into the parking lot directly across the street, was re-
ceived, placed on file and request granted - subject to the work being done
under the supervision of the Building commissioner.
15304 - Moved by Joder, seconded by Burtner the communication from City Engineer,
N. B. Barber, stating that George E. Rath had asked for permission to emp]r
C. W. Shirey to build the north half of the paving intersection at Sheridan
Road and Berkshire Road at his own expense, be received, placed on file and
request granted.
On roll call Burtner, Dolan, Joder, Shane, Strang and Turner voted Aye. Nays:
None. Absent: None. Mayor/declared the motion carried.

15305 - On motion by Dolan, seconded by Strang the communication from Howard J. Bemus,
asking that he be charged cost rather than ordinance rate for replacing a 140-
ft. oiling cut on Leland Ave., was received, placed on file and referred to the
City Engineer with instructions to report a recommendation at the next meeting
of the council.
15306 - Moved by Burtner, seconded by Strang that the report of C. T. Wilson, Supt.,
of the Sewage Disposal Plant, making certain recommendations for adjustment in
various sewage disposal charges, be received, placed on file and approved.
Motion carried.
15307 - 0n motion by Dolan, seconded. by Shane the communication from the Middle -West
States Association of the Improved Benevolent, and Protective Order of the Elks,
asking permission to hold a public street dance on Vine Street between the
Illinois Central Tracks and East High School Stadium, beginning at 8:30 P. M.,
on June l8th, 1941, was received, placed on file and permission granted.
15308 - 0n motion by Joder, seconded by Burtner the offer of Lloyd McKinney, 808
Denver Street, of t85.00 for a quit claim deed to Lots 12, 13 and 14, Block 2,
Teeter's A ddition, Waterloo, Black Hawk County, Iowa, was received, placed on
file and referred to the Finance Committee.
15309 - On motion by Strang, seconded by Joder the communication from Marion C. Berry-
man, 1736 Forest Avenue, et al, for oiling on and along Ohio Street between Forest

Avenue and Hawthorne Avenue, was received, placed on file and ordered included
in the next oiling resolution.

H. R. Crumrine, asking that a 10inch pipe be run through the back wall of his
office and then through the jail to the outside and install a ventilating fan,
be received, placed on file and that said installation be authorized under the
supervision of the Building Commissioner.

15311 - On motion by Toder, seconded by Burtner the communication from W. F. Loch-
moeller of Crouse -Hinds Company, stating that a special tinier oil for oiling
the type GS timers in the Stop -and -Go -Signals, was being sent the city free of
charge, was received and placed on file.
15312 - 0n motion by Burtner, seconded by Dolan the 'financial Statement of the Forum
Yellow Cab Co., Inc., for the period ending April 30th, 1941, was received and
placed on file.
15313 - Moved by Burtner, seconded by Strang that the communication from Frank E.
Wilkin, Electrical Inspector, asking that he be authorized to represent Waterloo
at a meeting of the Iowa and Illinois Chapters of the International Association
of Electrical Inspectors on Tune 5th and 6th, 1941, in Davenport, Iowa, be re-
ceived, placed on file and that he be authorized to attend said meeting with
legal expenses paid.

15314 - 0n motion by Toder, seconded by Strang the communication from A. H. Wieters,
of the State Department of Health, to C. T. Wilson, Supt. of Sewage Treatment
Plant, relative to a complaint made by Mrs. 'Millie Gilbert, 1049 Lowell Avenue,
about odors from said plant, was received and placed on file.
15315 - On motion by Strang, seconded by Toder the communication from Emery W. Loomis,
Mgr., of Mid -West Homes, Inc., asking that the streets be graded immediately in
Westlawn Addition to the east of Kimball Avenue, was received, placed on file and
referred to the Council as a Committee of the Whole.
15316 - Moved by Strang, seconded by Shane that the communication from E. S. Estel,
Secty-Mgr., of the Dairy Cattle Congress, asking that the Street Department oil
certain streets and walks on its grounds in August, be received, placed on file
and request granted providing that the Dairy Cattle Congress pay the cost of
said work.

15317 - 0n motion by Toder, seconded by Strang the communication from C. W. Shirey,
Waterloo, Iowa, offering to furnish the city concrete at 38.65 per cu. yd., was

15318 - On motion by Burtner, seconded by Dolan the Abstract and. Certificate of the
canvass of the Franchise Election on April 29th, 1941, submitted by the Mayor
and City Clerk, was received and placed on file.

Ordinance No. 1587 passed by the city council on March 24th, 1941, and approved

of the City Attorney.

343 Prospect Avenue, et al, for curb and gutter on and along the west side of
Idaho Street from Alta Vista Avenue north to beginning of pavement, was received
and placed on file.

15331 - Moved by Toder, seconded by Dolan that the City Engineer be instructed to pre-
pare plans and specifications and proposed schedules of assessments for cement
paving to connect with West Fifth Street and run along the side of the Moose
Hall to West Sixth Street.

Commission, certifying the names of ten men as having passed the examination for
positions on the Waterloo Police Department, was received and placed on file.

Tractor Company, asking the return of certain property located at the end of
Commercial Street along the east bank of Black Hawk Creek to the John Deere
Tractor Company in accordance with an agreement made with the City of Waterloo
in 1918, was received, placer file and referred to the Council as a Committee
of the Whole.
15347 - Loved by Joder, seconded by Dolan that the claim of John D. Murphy in the
sum of 34,489.44 as approved by the Workmen's Compensation Service of the
State of Iowa, be received, placed on file and that the claim be paid as order-

15348 - 0n motion by Dolan, seconded by Strang the communication from Fred W. Rosen-

bottling works on the northwesterly corner of the intersection of Lafayette
Street and. Wyoming Street, known as Lot 9, Block 14, Blowers Addition, was re-
ceived and placed on file.
15349 - On motion by Toder, seconded by Strang the petition of C. Watters, 1307
East 4th Street, et al, requesting that the restricted residential district be
extended from Sumner Street to the south side of Adams St., and from Ankeny
Street to Linn Street to cover the area within boundary, which includes Adams
Street from Ankeny Street to Linn Street, Cottage Street from Iowa Street to
Linn Street, and Fourth Street from Sumner Street to south side of Adams Street,
was received, placed on file and referred to the council as a committee of
the whole.
15350 - 0n motion by Strang, seconded by Shane the communication from Geo. B. Miller,
Chairman of the Board of Supervisors, Black Hawk County, Iowa, asking that
the city arrange to expend 3400.00 for certain street improvements on Ansbor-
ough Avenue between West 4th Street and. Ridgeway Avenue with crushed rock and
gravel, install cross road pipe at intersection of West 4th Street and. Ans-
borough Avenue and grade, align and surface Ridgeway Avenue between Kimball
Avenue and Baltimore Street, was received and placed on file.
15351 - Moved by Shane, seconded by Dolan that the applications for renewal of
Class "B" Beer Permits of N. J. Lies and T. C. Crummer, d/b/a Nick's Place,
626 Sycamore Street; Pete Koumalats, d/b/a Willie's Lunch, 90 Commercial
Street; and Paul Shelton d/b/a New L fight Hotel, 105 Oneida Street, and for
renewal of Class "C" Beer Permit of E. M. Holt d/b/a Holt's Grocery, 205

Company, et al, supporting the idea of installing parking meters, was received

15354 - On motion by Dolan, seconded by Strang the certified copy of the Resolution
of the City Plan Commission of Waterloo, Iowa, recommending the approval of
the Plat of City View Heights, Black Hawk County, Iowa, Certificate of Engi-
neer's Survey, Deed of Dedication, Protectives Covenants and. Plat, were received
and placed on file.
15355 - Moved by Joder, seconded by Strang that the communication from S. A. Dudley,
Building Commissioner, calling attention to an excavation on property located
at the southwest corner of Forest Avenue and. Bayard Street owned by Mary Allie
Fairburn, Riddott, Illinois, as being on low ground with water deep enough to
be dangerous to the lives of children, be received and placed on file. Lotion

City Engineer, recommnding that the window in the Idaho Street Lift Station toward
the Great Western Tracks be concreted in solid, be received, placed on file and
that the work be authorized under the supervision of the City Engineer.

15425 - On motion by Joder, seconded by Dolan the Notice of Appeal to the Supreme Court
of the State of Iowa in the case of Agnes Shaffer, d/b/a Colony Club vs the City
of Waterloo, Iowa, was received, placed on file and referred to the City Attorney
with instructions to defend.
15426 - On motion by Burtner, seconded by Dolan the petition of Gerald Gordon, 105
Madison St., et al, for oiling on Madison Street from Nevada Street to Colorado
Street, also Nevada Street from Independence Avenue to Ladison Street, was re-
ceived, placed on file and ordered included in the next oiling resolution.
15427 - On motion by Shane, seconded by Burtner, the binder for insurance policy with
Pioneer Insurance Agency purporting to cover the City Cab Company, was received,
placed on file and approved, subject to the approval of the city attorney.
15428 - Moved by Burtner, seconded by Strang that the communication from City Engineer,
N. B. Barber, stating a correction of an error in connection with a paving cut by
Newville Plumbing Company should be made to read "Permit No. 4675 for a paving cut
at 535 Western Ave., amount due none", be received, placed on file and change of
records authorized.

15429 - On rotion by Shane, seconded by Burtner the communication from John Deere Tractor
Company, by W. A. Wade, asking permission to cut the curb on the north side of
'Ales Street, together with the accompanying blueprint, were received, placed on
file and request granted, subject to the inspection of the City Engineer.
15430 - On motion by Joder, seconded by Strang the communication from Geo. B. Miller,
Chairman, Board of Supervisors, asking permission for a curb cut on the southeast
side of East Third Street in the middle of the 200 block, was received, placed on
file and request granted - subject to the inspection by the Building Commissioner.
15431 - On motion by Dolan, seconded by Strang the -communication from Nike Sulentic,
126 Sumner Street, et al, asking that outside toilets at 115 and 117 Linn Street
be removed, was received, placed on file and referred to the Sanitary Inspector.
15432 - Moved by Joder, seconded by Burtner that the application for a Class "B" Beer
Permit of Wm. Raine d/b/a Bill Rainets place, and accompanying bond, be received,
placed on file and that Resolution No. 8748, approving said application, be adopted.

15433 - On motion by Burtner, seconded by Shane the following applications for cigarette

15435 - On motion by Strang, seconded by Burtner claims for exemption from payment of
Doll tax, Year 1941, were received, placed on file and referred to the Finance
Comaittee.
15436 - On motion by Burtner, seconded by Shane the petition for remission or suspension

Street Commissioner be ordered to do the work and collect for the same.

ber, relative to checking on the request of Howard Benaus for an oil cut price

engineer approved.

WOW 802, 806, 810 and &16 Colorado Street, be approved, sulject to inspection by
the City Engineer.

Block 2, Teeter's Addition, and authorizing the Mayor and. Clerk to sign a quit
claim deed conveying said property to said purchaser, be adopted.

Chambers in the City Hall in said City at 8 o'clock P. M. June 9th, 1941.

15461 - On motion by Dolan, seconded by Turner the complaint about several parties
making sausage in the basements of private residences on Williston Avenue and in
the neighborhood thereof, in a restricted residence district, was referred to
the council as a committee of the whole.
15462 - Moved by Strang, seconded by Burtner that the report of C. T. Wilson, Supt.,
of the Sewage Disposal Plant, recommending various adjustments'in sewage disposal
charges, be received, placed on file and recommendations approved.
