correcting said assessments, be adopted.

14324 - Moved by Burtner, seconded by Joder that Resolution No. 8555, being a resolution
authorizing the City Treasurer to pay E. B. Spencer Construction Company,
Iowa, Contractor, under Sewer Contract No. 34, be adopted.

Lang. Mayor declared the resolution adopted.
14325 - Moved by Dolan, seconded by Shane that Resolution No. 8556, being a resolution
authorizing the City Treasurer to pay E. B . Spencer Construction Company, Waterloo,
Iowa, Contractor, under Sewer Contract No. 37, be adopted.

with sewer Contract No; 38 that the'council would proceed with the consideration of
the same.
14329 - On motion by Lang, seconded by Shane the city clerk was instructed to open bidS
for the construction of sewers under Sewer Contract No. 38, which were read by the
clerk as follows:

14330 - On motion by Lang, seconded by Strang the foregoing bids for the construction of
sewers under Sewer Contract §38 were received, placed on file and referred to the
Council as a Committee of the Whole.
14331 - The City Clerk submitted proofs of publication of Notice of Assessment for Oiling
Project No. 2 - Year 1940, and on motion by Strang, seconded by Shane the proofs of
publication were received and placed on file.
14332 - On motion by Strang, seconded by Shane the petitions of Geo. W. Foreman, 316
Vaughn Street, et al; R. E. Guetzlaff, 1228 Williston Avenue, et al, and Wm. Blair,
1101 Colorado Street, objecting to Oiling Project No. 2, Year 1940, were received and
placed on file.
Mayor Slippy asked if there were any oral objections and being none, it was moved by
Lang, seconded by Strang that Resolution No. 8557, overruling objections, and approv-
ing and levying assessments for the cost and expenses of improving certain streets
and avenues in the City of Waterloo, Iowa, by oiling the same, being Oiling Project
No. 2, Year 1940, be adopted.
On roll call Burtner, Toder, Lang, Shane and Strang voted Aye. Nays: Nones. Absent:
Dolan. Mayor declared the resolutioh adopted.
14333 - On notion by Toder, seconded by Shane the communication and contract submitted by
Architect Ernest A. Pickworth in connection with the proposed construction of a
combined Safety Lane Testing and Centralized Street Department Building were received
placed on file and referred to the council as a committee of the whole.
14334 - On motion by Lang, seconded by Shane the communication from The Rath packing
Company, together with the written consent of the Iowa public Service Company, re-
questing the closing of E1m Street from Sycamore Street to the line of the River Fron
Improvement Commission property, and that the city council give The Rath Packing
Company a quit claim deed for the same, were received, placed on file and referred
to the council as a committee of the whole.
14335 - Moved by Strang, seconded by Lang that the request of R. N. Cowin that the city
oil the parking lot adjacent to the Atlantic & Pacific Tea Store located on the corne
of West 4th and South Streets, and bill him for the cost of the same, be received,
placed on file and the Street Commissioner ordered to proceed with the work.
On roll call Burtner, Joder, Lang, Shane and Strang voted Aye. Nays: None. Absent:
Dolan. Mayor declared the motion carried.
14336 - Moved by Burtner, seconded by Shane that the communication from Mrs. Viola E.
Hartsell, 325 Newell Street, requesting the cancellation of a vault lien, be received
placed on file and request granted.

Bertch Avenue, et al, asking that a load limit of 3000 lbs. be put on trucks operat-
ing on Minnesota Street from Willistoh Avenue to Hawthorne Avenue, be received,

14339 - On motion by Lang, seconded by Shane the communication from Postmaster J. H.
Fitzgerald, asking for "no parking" in front of the Post Office on Commercial Street,
was received, placed on file and referred to the Ordinance Conmittee.
14340 - On motion by Joder, seconded by Shane the communication from Frank Collord,
President of the Chamber of Commerce, asking that the main streets of Waterloo be
not under repair or reconstruction during the week of Dairy Cattle Congress, was
received and placed on file.
14341 - On motion by Toder, seconded by Shane the communication from the Iowa Liquor
Control Commission with reference to an alcohol permit for use at the sewage disposal,
plant, was received and placed on file.
14342 - On motion by Shane, seconded by Lang the communication from Stanley S.Ransom and.
Fred. W. Amfahr, requesting the installation of a street light at the intersection of
Bayard Street andForest Avenue, was received, placed on file and referred to the
Water, Sewer & Gas Committee.
14343 - 0n motion by Joder, seconded by Burtner the communication of G. C. Crossley,
petition of consent of property owners located within 200 feet, and sketch in
connection with the recuest for permission to erect and maintain 4 - 10,000 gallon
underground storage tanks for gasoline on property known as that part of Lot 61
lying easterly of the easterly line of Eighteenth Street in Kenwood Park, were
received, placed on file and referred to the Council as a Committee of the Whole.

ments for water mains in Hollandale Addition on West 7th Street between Byron Avenue
and. Mitchell Avenue were received and placed on file.

assessments for water mains in Byrnbrae Replat were received and placed on file.
14346 - On motion by Burtner, seconded by Shane the petition of C. A. Sackett, 171
Duryea Street, et al, protesting against the paying of oiling assessments on pro-
perty facing Duryea Street from '1150 to the end of the 200-block, was received and
placed on file.

Treas.'Hawkeye Securities Corporation, asking for sidewalk on west Fourth Street
from the intersection of Sheridan Road and. West 4th Street southwesterly to the

Yankton, S. D., asking for appointment as Chief Engineer of a proposed police radio
patrol system, was received and placed on file.

Byrnbrae Replat, Waterloo, Iowa, and Waiver, by Harry P. Houser, et al, was re-

asking that the petition formerly filed by R. J. Lorenzen, et al requesting the
installation of sewer along Evergreen Avenue be presented to the council for re-

Street, et al for street lights at the intersections of Polk Street at Idaho and

by Sewer Outlet and Purifying Plant and for the appointment of a Superintendent for
said plant, was read by the Clerk.

second reading.

jecting all other bids and authorizing the City Clerk to return certified checks to al
unsuccessful bidders, be adopted.

The City Council of the City of Waterloo, Iowa, met in Special Session in the Council
Chambers, Mayor's Office, in the City Hall in the City of Waterloo, Iowa, at 4 o'clock
P. M., August 16th, 1940, pursuant to the following call:
"To J. D. Burtner, T. E. Dolan, Earl B. Toder,
Warner J. Lang, Stanley B. Shane and Dewey W. Strang:
You and each of you are hereby notified that there will be and is hereby
called a Special Meeting of the Council of the City of Waterloo, Iowa, to
be held in the Council Chambers, of the above -named city, on the 16th day

Council Chambers, Mayor's Office, in the City Hall in the City of Waterloo, Iowa, at
2 o'clock P. M., September 25th, 1940, pursuant to the followingcall:

You and each of you are hereby notified that there will be and is hereby
called a Special Meetin6f the Council of the City of Waterloo, Iowa, to be
held in the Council Chambers, Mayor's Office, of the above -named city, on
the 25th day of September, 1940, at 2 o'clock P. Y. for the purpose of con-
sidering and acting upon the following:
1 - To consider and take action upon the appointment of Councilmen to fill
the vacancies caused by the resignations of Warner J. Lang and Earl B.
Joder, and to reorganize Council;
To consider and take action on the ordinance relative to sewer rental
rates;
3 - To consider and take action on taxicab drivers' licenses.

14441 - On notion by Councilman Shane, seconded by Councilman Strang the resignation
of Earl B. Joder as Councilman from the First Ward in the City of Waterloo, Iowa,
was received and placed on file.
14442 - l_oved by Councilman Burtner, seconded by Councilman Shane, thate,arl B. Joder
be nominated as Councilman at Large, West Waterloo, for the City of Waterloo, Iowa,
to fill the vacancy caused by the resignation of Warner J. Lang.
No further nominations being made, the Mayor ordered the vote to be taken by ballot.
Said ballots were counted and Mayor Slippy declared Earl B. Joder unanimously
elected as Councilman at Large, West Waterloo, for the City of Waterloo, Iowa,
after which he administered the Oath of Office.
14443 - Moved by Councilman Burtner, seconded by Councilman Strang that David E. Seger
be nominated as Councilman of the First Ward in the City of Waterloo, Iowa, to fill
the vacancy caused by the resignation of Earl B. Toder.
No further nominations being made, the Mayor ordered the vote to be taken by ballot.
Said ballots were counted and Mayor Slippy declared. David E. Seger unanimously
elected as Councilman from the First Ward, Waterloo, Iowa, after which he administere
the Oath of Office.
14444 - Councilman Earl B. Joder moved that J. D. Burtner be elected President of the
City Council. Councilman T. E. Dolan seconded the motion, which was carried unani-
mously, and the Mayor declared T. D. Burtner duly elected as President of the City
Council.
14445 - Mayor Slippy made a verbal announcement of the Standing Council Committees as

14455 - On motion Strang, seconded by Shane the proofs of publication of the Notice of
Assessment for the cost of the construction of extension of water mains on a part of
West 7th Street, were received and placed on file.
Mayor Ralph D. Slippy announced that the time having arrived for hearing objections
for the levying of assessments for the cost of the construction of extension of water
mains on a part of West 7th Street that the council would proceed with the hearing of
said objections. There being no objections, either written or oral, the Mayor instructed
the council to proceed with the regular order of business.
14456 - Moved by Strang, seconded by Joder that Resolution No. 8587, levying assessments
for the construction of extension of a water main on West 7th Street, be adopted.
On roll call Burtner, Dolan, Joder, Seger, Shane and Strang voted Ayes. Nays: None.

14457 - On motion by Joder, seconded by Dolan the offer of Celia Gronen to pay the city
325.00 for a certain parcel of ground facing Riverside Drive approximately 19 feet,
and extending south approximately 63 feet to the line established by the Riverfront
Commission, was received, placed on. file and referred to the Finance Committee.
14458 - On motion by Dolan, seconded by Burtner the petition of G. J. Bennett, 2825 11.
4th Street, et al, for the oiling of Hampshire Road from the intersection of West
4th Street to the intersection of Berkshire Road, was received, placed on file and
ordered included in the next oiling program.
14459 - On motion by Joder, seconded by Shane the request of H. O. Bernbrock, Waterloo
Laundry Company, for permission to cut the curb for a length of 30 feet in front of
the residence property known as Lot 9, Block 15, Original Plat, was received, placed
on file and request granted - said work to be done under the supervision of the
Building Commissioner.
14460 - On motion by Shane, seconded by Strang the communication and accompanying petitioJ
of consent filed by Viola B. Finch seeking permission to operate a beauty shop at
1407 Vine Street, were received, placed on file and permission granted.
14461 - On motion by Strang, seconded by Shane the petition of Mrs. T. A. Morrison, 608
Pleasant Avenue for suspension or reduction of an oiling assessment assessed against
her property in the sum of 07.47, was received, placed on file and referred to the Fin-
ance Committee.
14462 - On motion by Joder, seconded by Strang the supplemental petition for sewer on
Blowers Avenue from Idaho Street to California Street as filed by Chas. D. Perry,
222 Blowers Avenue, et al, was received, placed on file and referred to the City
Engineer to check signatures.
14463 - On motion by Joder, seconded by Dolan the offer of R. N. Cowin to pay the city
100.00 for Lot 19, Block 15, Westfield Addition to the City of Waterloo, Iowa, was
received, placed on file and referred to the Finance Committee.
