AMENDMENT TO TEMPORARY EASEMENT AGREEMENT
This Amendment to Temporary Easement Agreement ("Amendment") is entered
into as of -\v_ , 2026, by and between the City of Waterloo,
Iowa ("Grantor") and McDonald's USA, LLC ("Grantee").
RECITALS
A. Grantee and Grantor are parties to that certain Temporary Easement
Agreement dated August 4, 2025 ("Agreement") concerning a temporary easement
granted by the City to Grantee as set forth and described therein.
B. The parties desire to amend the Agreement to modify the terms as set forth
in this Amendment.
NOW, THEREFORE, in consideration of the mutual covenants set forth herein, the
parties agree as follows:
1. Section 2 of the Agreement is hereby stricken in its entirety and replaced
with the following amended Section 2:
Unless extended by the written mutual consent of Grantor and
Grantee, the Temporary Easement shall continue in force and
effect July 31, 2026.
IN WITNESS WHEREOF, the parties have executed this Amendment to the
Temporary Easement Agreement by their duly authorized representatives as of the date
first set forth above.
