RESOLUTION NO. 2016-570 RESOLUTION APPROVING AND ACCEPTING CERTAIN ACQUISITION CONTRACT AND ACCEPTING CERTAIN DEEDS TO SELL REAL PROPERTY TO THE CITY OF WATERLOO FOR THE ACQUISITION OF NEEDED PROPERTY FOR DELANE CREEK DRAINAGE IMPROVEMENTS FROM WATERLOO MEMORIAL PARK CEMETERY FOR$21,967.44 (FEE TITLE ACQUISITION) LOCATED AT 3430 WEST 4TH STREET, AND AUTHORIZE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT. WHEREAS, the City of Waterloo, Iowa, has had the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels and easements are in conjunction with the Delane Creek Drainage Improvements located at 3430 West 4th Street, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same on behalf of the City and to execute all instruments necessary to consummate the agreements to purchase the property from the owner thereof, and the deeds for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties from city funds. The subject properties are: Owner: Waterloo Memorial Park Cemetery Fee acquisition: $21,967.44 Tract A COMMENCING AT THE NORTHWEST CORNER OF SAID SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER (SE 1/4 SE 1/4); THENCE SOUTH O1057'25" EAST (SOUTH-RECORD) ALONG THE WEST LINE OF SAID SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER (SE 1/4 SE '/a) A DISTANCE OF 175.19 FEET TO THE SOUTH LINE OF THE NORTH 175.15 FEET AND THE POINT OF BEGINNING OF THE HEREIN DESCRIBED TRACT "A"; THENCE NORTH 89011'23" EAST (EAST-RECORD) ALONG SAID SOUTH LINE 166.38 FEET (173.65 FEET-RECORD) TO THE EAST LINE OF A PARCEL OF LAND RECORDED IN BOOK 115, PAGES 587-588 IN THE OFFICE OF THE BLACK HAWK COUNTY RECORDER; THENCE SOUTH 40°31'30" EAST ALONG SAID LINE WHICH IF EXTENDED NORTHWESTERLY WOULD INTERSECT THE NORTH LINE OF SAID SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER (SE 1/4 SE 1/4) AT A POINT 24.39 FEET (30 FEET-RECORD) EAST OF THE NORTHWEST CORNER OF SAID SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER (SE 1/4 SE 1/4) A DISTANCE OF 538.71 FEET TO THE PRESENTLY ESTABLISHED NORTHWESTERLY RIGHT-OF-WAY LINE OF WEST FOURTH STREET; THENCE SOUTH 52028'58" WEST ALONG SAID NORTHWESTERLY Resolution No. 2016-570 Page 2 RIGHT-OF-WAY LINE 73.24 FEET TO THE NORTHEASTERLY LINE OF A PARCEL OF LAND RECORDED IN LAND DEED BOOK 550, PAGE 37 IN THE OFFICE OF THE BLACK HAWK COUNTY RECORDER; THENCE NORTH 37032'03" WEST ALONG SAID NORTHEASTERLY LINE, 29.91 FEET (30.0 FEET- RECORD) TO THE NORTHWESTERLY LINE OF SAID PARCEL; THENCE SOUTH52028'00" WEST ALONG SAID NORTHWESTERLY LINE 69.96 FEET (70.0 FEET-RECORD) TO THE SOUTHWESTERLY LINE OF SAID PARCEL; THENCE NORTH 39015'22" WEST, 607.80 FEET TO THE POINT OF BEGINNING, CONTAINING 1.78 ACRES, MORE OR LESS.
