The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 5:30 p.m., on Monday, August 14, 2000. Mayor John R. Rooff
in the Chair. Roll Call: Anders, Jordan, Krizek, Murphy, Gronen, Getty, Berry.
Invocation by: Councilperson Jerry Anders.
Pledge of Allegiance: Councilperson Barb Krizek.
ORAL PRESENTATIONS
114155 - Scott Miller, 1214 Pleasant Valley Drive, stated that he received a letter from
the Police Department with a complaint about property he owns. Mr. Miller
stated that the Police Department wants him to take care of the problem, and
Mr. Miller asked doesn't the Police Department take care of that.
Jim Walsh, City Attorney, stated that he believes Mr. Miller received notice of
a crime property, and that the Police Department was notifying Mr. Miller that
as the property owner he could be liable. Mr. Walsh commented that the Police
Department will do their job, and their job is to take care of that problem.
Mr. Miller stated that there is activity in the 500 to 700 blocks of Logan
Avenue, and he offered his property for use by the Drug Task Force, and the
officer never called him back. Mr. Miller noted that the Police Department was
working on a particular home at the time, and the Street Crime Force later
chased the person down, and the Police Department told him they would have
liked to have had a home for that surveillance. Mr. Miller stated that there
are five homes up and down the block and when the problem came up he talked
with the Police Department. The Police Chief got on the speaker phone and the
officer lied to the Police Chief. Mr. Miller stated there are several homes
with illegal activity, and he has tried to keep it under his hat and now he has
received a threatening letter.
Police Captain Tom Jennings stated that the letter is to educate the property
owner of what is going on, and it is not harassment. Captain Jennings will
talk with Street Crime Force and the Tri -County Drug Task Force staff.
Councilperson Berry stated that she has gotten many calls on that particular
area.
Mr. Miller stated that he is in the process of selling the property, and he
does not feel he is getting assistance from the city. Mr. Miller stated that
he just wanted this brought out.
Mayor Rooff asked Captain Jennings to speak with Mr. Miller after the meeting.
Mary Hassis, 116 Courtland, stated that when citizens call the Police
Department, persons engaged in illegal activities hear the sirens from the
police cars and are gone by the time the Police Department arrives at the area.
Councilperson Krizek presented a petition signed by residents on Campbell
Avenue between Kimball and Fletcher Avenues regarding increased traffic and the
speed of traffic in this area. Councilperson Krizek asked that a council work
session be scheduled to discuss the options to take care of the residents'
concerns.
Mayor Rooff asked the City Clerk to schedule a council work session with the
residents.

Certain Property", be considered and passed for the second and third times and

and oral objections.
Councilperson Anders stated that the entire easement is already cemented over,
and the reason the Planning, Programming and Zoning Commission recommended
denial is because of the existing storm sewer and the chance that the carport
could be damaged if the city had to excavate the storm sewer.

City Planner Don Temeyer stated that a driveway is allowed to go over the
easement as there is not a potential to damage any building. Mr. Temeyer
stated that there is an existing 10" storm sewer in the easement that would be
approximately 5'4" from the proposed wall of the applicant's carport. Mr.
Temeyer stated that there are concerns that if the city would have to excavate
along the carport, it could cause instability and damage the carport, which
would create a liability for the city.
