RESOLUTION NO. 2026-280 RESOLUTION APPROVING A REQUEST FOR AN ENCROACHMENT AGREEMENT WITH RYAN MEYERS TO ALLOW FOR THE REPLACEMENT OF AN EXISTING FENCE IN THE GREENHILL ROAD RIGHT-OF-WAY IN THE "R-2" ONE- AND TWO-FAMILY RESIDENCE DISTRICT LOCATED IN THE REAR OF 343 TO 349 NORRIS COURT, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT. WHEREAS Ryan Meyers has requested approval of an Encroachment Agreement to allow for the replacement of an existing fence within the Greenhill Road right-of-way in the "R- 2" One- and Two -Family Residence District located in the rear of 343 to 349 Norris Court, Waterloo, Iowa; and WHEREAS, the City of Waterloo has reviewed said request and determined that approval of the Encroachment Agreement, subject to the terms and conditions contained therein, is in the best interests of the City; and WHEREAS, the Encroachment Agreement sets forth the obligations of the property owner with respect to the placement, maintenance, and removal of the fence within the right-of- way. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that: 1. The request for an Encroachment Agreement with Ryan Meyers to allow for the replacement of an existing fence in the Greenhill Road right-of-way in the "R-2" One- and Two - Family Residence District located in the rear of 343 to 349 Norris Court, Waterloo, Iowa, is hereby approved. 2. The Mayor and City Clerk are authorized and directed to execute said document on behalf of the City of Waterloo, Iowa. PASSED AND ADOPTED this 18th day of May 2026.
