RESOLUTION NO. 2026-370
RESOLUTION ACCEPTING AND APPROVING AN ACQUISITION
CONTRACT, AND APPROVING A DEED TO CONVEY REAL PROPERTY,
TO THE CITY OF WATERLOO, FOR PARTIAL PROPERTY ACQUISITION
AND TEMPORARY EASEMENT AGREEMENT WITH D AND C
MANAGEMENT, LC, IN THE AMOUNT OF $18,000.00 FOR PROPERTY
LOCATED AT 2133-2159 FAIRWAY LANE, IN CONJUNCTION WITH THE
FAIRWAY LANE RECONSTRUCTION PROJECT, AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT.
WHEREAS, the City of Waterloo, Iowa, is undertaking the Fairway Lane Reconstruction
Project; and
WHEREAS, in conjunction with said project, it is necessary and in the best interest of the
City to acquire a portion of the property located at 2133-2159 Fairway Lane, together with a
temporary easement, from D and C Management, LC; and
WHEREAS, D and C Management, LC, has agreed to convey the necessary partial
property interest and temporary easement to the City pursuant to an Acquisition Contract and
Deed to Convey Real Property in the amount of $18,000.00; and
WHEREAS, the City Council finds it appropriate to accept and approve said Acquisition
Contract and approve the Deed to Convey Real Property, and to authorize execution of the same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
1. The Acquisition Contract with D and C Management, LC, for partial property
acquisition and Temporary Easement Agreement for property located at 2133-2159 Fairway
Lane, in conjunction with the Fairway Lane Reconstruction Project, in the amount of $18,000.00,
is hereby accepted and approved.
2. The Deed to Convey Real Property to the City of Waterloo pursuant to said
Acquisition Contract is hereby approved.
3. The Mayor and City Clerk are authorized and directed to execute said documents on
behalf of the City of Waterloo, Iowa.
