RESOLUTION NO. 2026-351 RESOLUTION APPROVING THE REQUEST OF HALF DOZEN PROPERTIES, LLC, FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED AT 806 UPTON AVENUE, WITH THE ELIMINATION OF THE SIDEWALK SECTION DUE TO INABILITY TO MEET GRADE REQUIREMENTS. WHEREAS, Half Dozen Properties, LLC has submitted a request for a waiver concerning the construction of a concrete driveway located at 806 Upton Avenue; and WHEREAS, the requested waiver addresses the inability to meet grade requirements necessary for the installation of a standard sidewalk, which would otherwise result in non- compliance with the applicable city ordinances and engineering standards; and WHEREAS, the City Engineering Department has reviewed the request and determined that the waiver is necessary to ensure proper drainage and access while maintaining public safety and functionality. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, 1. The request by Half Dozen Properties, LLC for a waiver to allow the construction of a concrete driveway with the elimination of the sidewalk section at 806 Upton Avenue is hereby approved, subject to the following conditions: a) Work is to be performed by an approved and bonded contractor. b) A permit is to be obtained from the office of the City Engineer prior to construction. c) All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. 2. The City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
