THE CITY OF WATERLOO,IOWA: THAT WHEREAS, the City Council of the City of Waterloo , Iowa, has heretofore determined to exercise the powers named in Section 797 of the Code in connection with the making of the improvement hereinafter referred to and did, on the 26th day of May, 1913, by resolution No. , direct the City Engineer to prepare plans , specifications g 46&4 i&%A► ter and estimate for from the intersection of Seventh Street and Allen Street in the City of Waterloo, to Byron Avenue in said City, and, WHEREAS, said City Engineer has prepared plans and specifications for and an estimate of the cost of con- structing an artificial channel or covered drain from the intersection of Seventh Street and Allen Street to Byron Avenue, as hereinafter specified, suf'fie t, to carry' the - .. water heretofore flowing in the water course between said points , and for filling the old channel of said stream; which plans and specifications and estimate have been filed in the office of the City Clerk and, by Resolution No. passed on the 25th day of dune , 1913, were approved by this Council; said artificial channel or covered drain to be constructed, as follows: Commencing at the upper end of dry run sewer at the intersection ,of Allen Street and Seventh Street in the City of Waterloo, Iowa; thence South along the line of Allen Street to the youth line of Pleasant Street ; thence in a Southerly d nee an t ►- po t €"r fit rt�., of t3 line of Williston. Avenue and 160 'feet nest of the �?tftl line of Eighth Street; thence in a Southeasterly direction at an angle of 29 degrees 4 minutes with the last describ- ed line 1137 feet to a point 12 feet West of the Test line of Ninth Street and 75 feet North of the forth line of Hawthorne Avenue; thence South parallel with Ninth Street 430 feet to the center of Byron Avenue , and, WHEREAS , it is the opindon of this Council that said artificial channel or covered drain should be construct-, ed, as proposed by said plans and specifications and the t s , water diverted and conducted through said artificial channel or covered drain and the old channel of said stream filled, and, WHEREAS , it is the opinion of this Council that the estimated cost of constructing such artificial chan- nel or covered drain and filling the old channel, is greater than should be levied and collect:ia4:i in a single i year, NOW THEREFORE, Be it resolved by the City Council of the City of Waterloo , Iowa: See . 1. That a special election be and the same is hereby called .to be held on the day of July, 1913, in the territory comprising Sewer District No. 2, in the City of Waterloo, Iowa, said Sewer District consist- ing of the first and second wards in said City, for the purpose of submitting to the qualified electors of said Sewer District X04, the following questio to-fit-,; (1) Shall the- City Council of the City of WELter- loo , Iowa, proceed to construct an artificial channel or . covered drain from the intersection of Seventh Street and Allen Street to Byron Avenue, sufficient to carry the water heretofore flowing in the water course which runs between said points and divert the water from said natural channel and conduct the same through said artificial channel or covered drain and fill the old. channel; said artificial channel or covered drain to be constructed as follows : - Commongi at the upD€- -;en& of dry run sevi�ex at . v._ the intersection o gllen Street an 'afith attest .the City of Waterloo, Iowa; thence South &long the line of Allen Street to the South line of pleasant Street ; thence in a southerl-v direction to a point 96 feet North of the North line of Williston Avenue and 160 feetWest' of the Westerly line of Eighth Street ; thence in a South- easterly direction at an angle of 29 degrees 4 minutes with the last described line 1137 feet to a point 12 feet Test of the West line of Ninth Street and 75 feet Yorth to the North line of Hawthorne Avenue ; thence South parallel with Ninth Street 430 feet to the center of Byron Avenue. Said artificial channel or covered drain to be 10 feet wide and 8 feet high, with a curved invert or bottom. (2) Shall the City Council of the City of Waterloo , Iowa, proceed to levy an annual tax of mills on the dollar on all taxable property in said Sewer District No. 2 in the City of 7,aterloo, Iowa, for each of the years to defray the expense of eenitruoting said artificial channel or covered drain and filling the old channel. Sec. 2. That the City Clerk be and he is hereby directed to publish notice of such election, in each of. the Waterloo daily newspapers, once this week (week of June 23) and once next week (week of June 30) . •
