Be it resolved by the City Council of the City of
Waterloo, Iowa:
THAT WHEREAS; there is now pending in the Die-
trict Court of Iowa, in and for Black Hawk County,- a suit
instituted by the City of Waterloo against the Barber Asphalt
Paving Company and the United States Fidelity and Guar
a
Company, asking a writ of mandamus to compel said Companies
to re-surface or repair certain streets in the City of Water-
loo , Iowa, paved with asphalt by the said Barber Asphalt
Paving Company, and,
WHEREAS, the said Barber Asphalt Paving Company
have made a proposition of settlement of said suit by pro-
posing to re-surface or repair said streets to the extent
of j/Vf O O square yards and such yardage of repairs
or re-surfacing to be placed upon the streets ,covered by the
contracts-in question, in such places as may be deedted _by
the City, Engineer of the City of Waterloo, Iowa, and,
WHEREAS, the City Council deem it advisable to
make such settlement, NOW THEREFORE,
Be it resolved that the Mayor and City Clerk be and
they are hereby authorized to enter into a stipulation of
settlement of said case with said defendants above named, the
terms and conditions o'f which stipulation are to be that
said defendants make or cause to be made Ales.--o
