of the city,of Waterloo, Iowa, that I
the-advisability and necessity of im-
proving the streets hereinafter de-1
scribed are hereby declared and di-
rected: East Tenth street from the
southwesterly line of Franklin street'
to the northeasterly line of Sycamore
street, to be paved 36 feet in width;1
Steely street from the northerly line
of Prospect-avenue to the northerly
line of Vine street, to' be paved a 24
feet in width; If.ingeyeavenueefrom
the- te:ly-line-of-Sullivan-avenue
to,the eazterly line`of Marsh-street,AO
be paved.30 feet,.in width, together
with the necessary Intersections
where not already paved, upon mo-
tion of the city council without peti-
tion therefor by property owners sit-
uated-within one-half block and.not
exceeding 300, feet from the street
improved.
To be constructed�on each side of
the roadway a Portland'cement con-
crete curb or curb and gutter where} j not already built. Wherever the ex-1
isting curb is of sufficient width and
depth and can be removed without;
impairing same said curb to be reset
to new line of curb, said roadway of
said streets to be paved with the best
quality of sheet asphalt,. the pave-
ment to consist of five (5) ladles'
Portland cement concrete base, one
(1) inch asphalt binder course and
one and one-half (1 1-2) inches as-
phalt wearing surface, except.that
portion of the street occupied by the
W., C. F. & N. Railway Co., which is
to be paved between the rails-and 1
one foot outside thereof with No. 1
repressed vitrified brick blocks •laid
on six (61 inches Portland cement
concrete base. 1
The contractor is'to be required to I
guarantee the asphalt pavement for
a period of five (5) years and to ex-
ecute a bond for the sum of not less,
than one dollar per-square yard, to,
be given as security of said guaran-
tee and that he will'carry out all the'
provisions of said contract.
The cost of improving said streets'
to be assessed against all lots or par-
cels of land according to area, in pro-
portion to the benefits thereto, and'
within one-half block or not exceed-
ing three hundred feet from the j
street improved, in accordance with
section one (1), chapter seventy-six
(76), laws of the thirty-fifth general
assembly of Iowa, and the cost of
paving street and alley intersections
' to be assessed in accordance with the
law governing the same.
In case the contract is let by the
city for the construction of the pave-
ment between the rails of the W., C.
F. & N. Railway Co., and one foot
outside thereof, the cost thereof
shall be assessed against said rail-
road company as by law required.
The cost of paving to be assessed
' against the property owners within
' one-half block and. not exceeding
three hundred feet from the improve-
ment and street intersections where
the benefits derived by reason of such
improvement are less than the cost
thereof, and where such -pavement
costs in excess of 25 per cent of the
actual value of the property against
which it is assessed, including prop-
erty owned by, the city, the cost of
such improvement shall be paid out
of the improvement fund or such oth-
er funds' as may be available for
that purpose against._which funds
warrants shall be issued as provided
by law.
