- Be it resolved by the city council
of the city of Waterloo, Iowa, that t
the advisability and necessity of im-
proving the streets hereinafter de-
scribed are hereby declared and di-
rected: Wellington street from the
northwesterly line of First street to
the east line of Belmont street; Al-
len street from the northwesterly line
of First street to the southeasterly
line of Mullan avenue; Randall street
from the west line of Sunnyside ave-
nue to the east line of Belmont
street; Reber avenue from the east
line of Moir street to the east line
of Euclid avenue; Oak Lawn avenue
from the south line of Falls avenue
to the north line of Mullan avenue
together with the necessary intersec-
tions where not already paved, the
roadway of said streets to be paved
24 feet in width excepting Welling-
ton street between First street and.
Mullan avenue which is to,be paved
30 feet in width, and constructed on
each side of the roadway a Portland
cement concrete curb or curb and
gutter where not already built.
Wherever the existing curb is of sufil-
cient depth and width and can be re-
moved without impairing same, said
curb to be reset to new line of curb,
said roadway of said streets to be
'paved with best quality asphaltic con-
crete paving two inches in thickness j
upon a five inch Portland cement I
concrete base.
The contractor is to be required
to guarantee the pavement for a per-
iod of five years from and after the
completion of same and to execute
a bond in the sum of not less than
85 cents per square yard to be given
as security of said guarantee and
that he will carry out all the provi-
sions of said contract.
The cost of improving said streets
to be assessed against all lots and;
parcels of land according to area in
proportion to the benefits thereto
and including one-half of the private-!
ly owned property between the'
streets so.proposed to be improved!
and the next street whether abutting
on said street but not to include pri-I
vately owned property situated more 1
than 300 feet from the street pro-1
posed to be improved hereunder in
accordance with Section T, Chapter
76, Laws of the 35th General Assem-
bly of Iowa, and the roe of paving j
greet and alley intersections to be
assessed in accordance with the laws
governing the same, payment to be I
made to the contractor for the case
of the work by issuance and delivery
to him of Special Assessment Certi-
ficates bearing 6 per cent interest for
the amount of such assessment, said
certificates to be issued in anticipa-
tion of the collection of said Special
Assessment as provided under the
provisions of Chapter 8, Title 5, of
the Code of Iowa and Acts amenda-
tory thereto. Any deficiency be-
tween the amount of the contract,
price and the amount of said certifi-
cates issued on account of said 1m-I
provement will be paid from the Im-
provement Fund or such other funds
as may be available for that purpose
against which fund warrants shall be
issued as provided by law.
