BE IT RBSOLITII by the City Council of the City of -aterloo, Iowa, that whereas it is deemed advisable and necessary to grade, curb, and pave the streets hereinafter named, the foundation to be prepared and the ravinre to be constructed in accordance with the Specifications furnished by the City Migineer of the City of ;at T100 and approved by the City Council of said city on the followilx named streets and parts of streets, to-wit: East Fifth Street frog the southwesterly line of Lafayette treet to the Cedar Rivenridge; Sycamore Street from the northwesterly line of Third to the northwesterly line of Sixth Street; Lafayette Street from the northwesterly line of park Avenue to the northwesterly line of Fourth Street; 'est Fifth Street from the southwesterly line of Coenercial Street to the tctiis -e4ite-air-sR4-1-4--,.$ PiomItt.6'nNhwesterly rifle of Third Street to ti e northwesterly line of Fifth Street; Commercial Street from the southeasterly line of Fifth Street to the tracks of the C. G. 7. R. R. Co., together with the necessary intersections were not already paved. A Now, therefore, be it resolved by the City Council of the City of Waterloo that it will consider the followinr;' nro'Pose resolution of necessity at a meeting of the city council to be held on the .22-( day ofaidefzi.194— at 7:30 o'clock p. m. at the Council Chamber in the City Hall and the City Clerk Is hereby directed to give twenty days notice thereof in accordance with the law and ordinances governing same, said resolution bein as follows, B. IT R,-;SOLTD by the City Council of the City of 'aterloo, Iowa, that the advisability and necessity of irarroving the streets hereinafter described is hereby declared and directed: :last Fifth Street from the southwesterly line of Lafayette Street to the Cedar 'River Bridge; Aire.At Sycamore Street from the northwesterly line of Third Aopto=ze to the northwesterly line of Sixth Street; Lafayette Street from the northwesterly line of 'Dark Avenue to the northwesterly line of Fourth Street; West Fifth Street from the southwesterly line of Commercial Street to the th Ce'll'-nerif41:wsoNTA ot?4,t = \n esterly line of 71,Ird Street to the northwesterly line of Fifth Street; Commercial Street from the southeasterly line of fifth Street to the tracks of the C. C. 71. EL Co. together with t'N) necessary intersections where not already paved, upon motion of the City Council without petition therefor by property owners situated within one-half block and not to exceed 300 feet from the streets to be inreroved. - 2 - cherever the existing curb is of sufficient width and depth and is found to be at line and grade said curb will be retained and where not on line and grade, If curb can be removed without imnairin,e same, said curb is to be reset to new line of curb, now curb to be built only at such laces as City Council my direct. The roadway of said streets is to be paved with the best quality sheet asphalt and pavement to consist of a six inch Portland cement concrete base, one inch asphalt binder course, and Qu-r;4 r—ettt!.,....i-ti. inches of asphalt wearing surface except that portion of the streets occupied by the railway and street railway tracks which is to be Paved between the rails and one foot outside A:NA 4? thereof with ro. The contractor is to be required to guarantee the asphalt pavement for a period of five years and to execute a bond in the sum of not less than one dollar per square yard to be eiven as security of said guarantee and that he will carry out all the provisions of said contract. The cost of improveing said streets to be assessed against all lots or parcels of land accordin to area and in proportion to the benefits thereto situated mtthin one-half block and not to exceed 300 feet from the streets improved in accordance with Section 1, Chapter 76, Laws or the 35th General Assembly of Iowa, and the cost of paving street and alley intersections to be assessed in accordance with the laws governing same. In case the contract is let by the City for the construction of the pavement between the rails of the railway and street railway companies tracks located thereon, and one foot outside thereof, the cost thereof shall be assessed against the said Railway and Street Railway Companies as by law required.
