Notice is.hereby given that the city council of Waterloo, Iowa, will
consider the following proposed resolution of necessity at a meeting to be
held at the council chamber in the city hall in said city at 7:30 o'clock
p.m. on the 26th day of June, 1016, said resolution being as follows, to—wit:

Be it resolved by the city co4noil of the city of Waterloo, Iowa, that
whereas, it is deemed advisable and necessary to grade, curb , gutter and
pave the streets hereinafter named; the foundation to be prepared and the
paving to be constructed in accordance with the speoifications furnished by

Wherever the existing curb is of sufficient width and depth and is found-to
be at line and grade said curb will be retained and where not on line and grade
if curb can be removed without imp#atring same said curb is to be reset to new
line of curb, and in any event all curb and gutters whether retained or reset
shall be fully repaired, and new curb and new curb and gutter to be built at
such places as the city council may direct.

The cost of improving said streets to be assessed against all lots or parcels
of land according to area and in pre-portion to the benefits thereto situated
with one-half block and not to exceed 300 feet from the streets improved in
accordance with Section 1, Chaper 76, laws of the 35th general assembly of Iowa
and amendatory thereto, and the cost of paving street and alley intersections to
be assessed in accord-nee with the laws governing the same.
In case the contract is let by the city for the construction of the pavement
between the rails of the railway and street railway companies tracks located
thereon, and one foot outside thereof, the cost thereof shall be aesessed against
said railway and street railway companies as by law required. That cost of paving
to be assessed against the property owners within one-half block and not exceed-
ing 303 feet from the improvement and street intersections where the benefits
derived by reason of such improvement are less than the cost thereof and where
such pavement costs in excess of 25 per cent of the actual value of the property
against which it is assessed, includint property owned by the city, the cost of
such improvement shall be paid out of the improvement fund or such other funds
as may be available for that purpose, against which funds warrants shall be
issued as provided by law.
