Between The Fails And One Foot Outside
Thereof On Certain Streets In The
City Of TaterloclIowa..
Be It Resolved By The City Council Of The City Of Waterloc,Iowat-
That whereas,pursuant to the authority confemeeed upon it by
lathe city council o.f the city of Taterloc, :owajhae by resolu-
tion duly passed on the rath. ,day of February,I2I7, cedered the
imrrovement by paving and .gutvering of Falls avenue,Test First
street,Parker street,and various other streets in sad city in the
manne7 set forth in said resclution,and
Whereas,The WaterIcoCedar Fails & Northern Railway Comeanyj
The Chicago,Rock Island & Pacific Railroad Companyiand The Ch4ic
go Great Western Railroad CompalChave heretofore ;aid and are
maintaining tracks on said streets as ordered improved in said
above referrea to resolution;,
Jow,Therefore,Be It Eesoived,by the city council o.f the city
of Waterloo,Iowal that said Waterloo,Cedar Falls a Northern Rail-
way Company.,,Chicago)Rock Island & Pacific Failroad Complitny;and
Chicago Great Western Railroad Gomranylare hereby ordered to im-
prove that portion of the above named streets as set forth in said
resolution and said portion of said streets that lies between the
rails of their respective tracks and one foot outside thereofjby
paving the same in the manner described in said resolution, and in
accordance with the specifications prepared by the city eneineer,
and approved by this councilland now on file in the office of the
city clerk,the work of paving said railway, tracks as therein me i-,
fled to b /commenced forthwith and completed on or before the IC_I-

Be it further resolved that the city clerk be and he is here-
by directe and instructed to cause a copy of this resolution to
be served upon said railroad companies and to attach thereto a
copy of the resolution ordering the improveaent of said portions
of said streets,iand in case said railroad companies shall within
ten(I0)days after service of the copies of said resolutions,fail
to notify the said clerkelaPtheir intention. to pave said parts of
said streets in the manner specified,that sulzh failtre shall be
considered a refusal on the part of each and any of said railroad
companies tc do said work and then is that. eventIthe City shall
proceed with the construction, of the paving of said portions of
said streets of the space between the rails of the tracks of said
above named railroad companiesjand one foot outside thereof,as by
law provided,but in case the said railroad companies shall within
the said time notify the said Clerk of their intention to do eata
workland carry the same to completion by theK.4.k.11day of
I9I7„then the contract referred to- in said above named re, flutiots
and entered into for the paving of said portions of said streets
shall not be made.
