ESOLUTION eF NECESSITY
Be It Resolved by the City Council of the City of waterlo-o,
Iowaothat whereas)it is deemed advisable and necessary to resurface
with sheet asphalt or asphaltic concrete the streets hereinafter
named,said resurfacing to consist of removing the present asphalt
wearing surface and binder course front the concrete base which now
lies in said street,in accordance with plans and specifications
furnished by the city engineer of the City of Waterlocjlowaoand
approved by the city council of said city on the following named
streets,alleys,avenues or parts of etreets.I.Aowit:
Hammond avenue from the Northeasterly curb line of South street
to the North line of X6.144ne4cm*zvrt. 6ton't4110 •
West Park avenue from the Southwesterly line of south street
to the North line of Wellington street.
South street from the Northwesterly line of West Fourth street
to the Southeasterly line of Test Third street.
South street: from the Northwesterly line of West Third street
to the Southeasterly line of West Mullan avenue.
Leland avenue from the Southeasterly line of West Mullan
avenue to the East line of Belmont avenue.

Nowathereforembe it resolved by the City Council of ttLe City
of WaterlooaIo3ra,,that it will consider the following proposed
resolution of necessity at a meeting of the city council to be
held on the day of 47, " I919aat 7:3C o'clock
P.M.,at the council chamber in the city hal) and the city clerk is
hereby directed to give fourteen(I4)days1 notice thereof,in accord—
ance with the laws and ordinances governing the sweelsaid resolu—
tion being as follows;towit:—

Iowaathat the advisability and necessity of improving by resurfacing
with sheet asphalt or asphaltic concrete,said resurfacing to consist
of removing the present asphalt wearing surface and binder course
from the concrete base which now lies in said streets and parts of
streets hereinafter described is hereby declared and directed:Ha/mond avenue from the Northeasterly curb line of South street
laor,
to the North line of _ - - tato be resurfaced or repaved
thirty(30) feet in width.
Test Park avenue from the Southwesterly line of South street
to the North line of Wellington streetato be resurfaced or repaved
thirty(30) feet in width.
South atreet from the Northwesterly line of West Fourth street
to the Southeasterly line of West Third street„to be resurfaced ot
repaved thirty(30)feet in width.
South street from the Northwesterly line of West Third street
to the Southeasterly line of West Mullan avenueato be resurfaced or
repaved thirty(30) feet in width.
Leland avenue from the Southeasterly line of West Mullan avenue
to the Fast line of Belmont avenue,to be resurfaced or repaved
thirty(30)feet in width.
Thereiver the existing curb is of sufficient width and depth
and is found to be in line and grade said curb will be retained
and where not tn line and grade,if curb can be retoved without ixr
pairing same said curb is to be reset to new line of curb,and in
any event all curb and gutters whether retained or reset skull, by
fully repaired,and new curb and gutter to be built at such pikoss
as the city council may direct.
All of the above named streets together with the necessary
intersections shall be improved by resurfacing or repaving upon
motion of the city council without petition therefor by the property
owners situated within cne-half block and not to exceed three bun-
dred(300) feet from the streets to be improved.
The roadway of said above named streets to be resurfaced or reip
paved by removing% the present asphalt wearing surface and binder
course from the concrete base witch now lies in said streets,and by
resurfacing or repaving said streets and bids will be received fdr
the following kinds of resurfacing or repaving as follews; towit:

5zheet-Asrhalt-wearing surface of one and one-half(Ipinches
and one(i) inch binder course.
Asphaltic concrete wearing surface of two and one-half(2pinches.
All contractors as a part of the resurfacing as above setfcrth
are required to remove all present materials upon said above named
streets town to said concrete base.
The contractor is to be required to guarantee all forme of re-
surface pavement for a period of not less than one nor more than
five years and to execute a bond in the sum of not less than fine
dollar per square yard to be tiiven as security of said guarantee
and that he will earry -dut the terms and provisions of said contract.
The cost of improving said streets to be assessed against all
lots and parcels of land according to area and in proportion to the
benefits thereto situated within one-half block and not to exceed
three hundred(300) feet from the streets improved in accordance with
Title 174,Chppter Seven(7) ,of the Code of Iowa and the laws amendatory
thereto,and the coati of paving street and &lacy intersections to be

assessed in accordance with the laws governing the same.That the )40

htir cost of paving to be assessed against the property owners within
one—half block and not exceeding three hundred(300) feet from the
improvement and street intersections where the benefits derived
by reason of such improvement are less than the cost thereof and
where sych pavement costs in excess of twenty—five(28)per cent
of the actual value of the property against which it is assessed,
including property owned by the City or property against which
no special assessment can be leviedlthe cost of such toijOiAt/
improvement shall be' paid out of the improvement fund or such
other funds as may be available for that purpose,against which fund
warrants shall be issued as provided by law.
All persons interested will take due notice and govern
themselves accordingly.
