BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY a WATERLOO, IOWA ON ITS OWN MOTION: That pursuant to a resolution of necessity passed by this Council on the 27th day of August , 1923, the same berg; resolution No. °`.a57 , that the improvements described in said Reso- lution of Necessity which is made a part hereof by reference, and which consists of laying-e constructing certain improvements as hereinafter described in, upon and along the following streets and avenues and parts thereof in said city: Pave that part of East Park avenue from the northeast line of ivulberry street to the southwest line of Walnut street , which is now occupied by center pi. rking and unpaved. Resurface that part of Aast Park Avenue which is now paved from the northeast line of iiulberry street to the southwest line of Franklin street . Pave Wost Second street from the northeast line of Com- mercial street to the northeast curb line of Cedar street. Resurface Was :ington street from the northwest line of West Ninth street to the end of the present paving at Eleventh Street. Be and the same are hereby ordered constructed, the same being dnne upon motion of this Council without petition of pro- perty owners. Be it further resolved that the City Clerk be and he is hereby ordered to advertise for proposals or bids for the construc- tion of the improvements aoove ordered , the improvements to be con- structed in strict accordance with the plans and specifications there- for prepared by the City Engineer and approved by this Council; said work to be commenced on or before the 12th day of September, and to be completed on or before the 15th day of October, 1923. Payment to the contractor will be made either in special assessment certificates or street improvement/ bonds bearing interest at the rate of 56 per annum - 2 - to the extent that the cost of said improvement is assessable by law against the property abutting upon the same ; said bonds or certifi- cates to be issued or delivered to the contractor after the work is completed and accepted; any deficiency between the contract price and the amount of said bonds or certificates to be paid in warrants drawn on the street improvement funds available for the year beginning April let, 19 . Or the contractor may be paid in sash. The proposals vd.11 be opened by this Council at a meeting to be held in the Council Chamber on the 10th day of Septem- ber, 1923 at a ht o'clock P.I . and acted upon at that time or such later time as may be then fixed. All bids must be received by the City Clerk on or before five o ' clock on. the 10th day of September, 1923, accompanied in a separate envelope by a certified check payable to the order of the Treasurer of said city, drawn on a Waterloo bank- and in an amount equal to 1010 of the bid . Said checks are required as security that the bidder will enter into a contract with said city for the do ing of the work and will furnish the required bond in the amount and form provided for by the specifications and conditioned on the faith ful performance of the contract and on the contractor keeping the work in repair for four years after acceptance thereof and on the contractor payigg the laborers and persons furnishing material therefor.
