RESOLUTION NO. 2026-187
RESOLUTION APPROVING AN AMENDMENT TO A
TEMPORARY ACCESS EASEMENT AGREEMENT WITH
MCDONALD'S USA, LLC, LOCATED AT AND ADJACENT
TO 2222 LOGAN AVENUE, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID
DOCUMENT.
WHEREAS, the City of Waterloo, Iowa, and McDonald's USA, LLC entered into a
Temporary Access Easement Agreement on August 4, 2025, for property located at and adjacent
to 2222 Logan Avenue; and
WHEREAS, the Temporary Access Easement Agreement provided temporary access rights in
connection with City improvements and related property matters involving the area at and
adjacent to 2222 Logan Avenue; and
WHEREAS, it was subsequently determined that certain property now held in the name of the
City of Waterloo was formerly right-of-way owned by the Iowa Department of Transportation;
and
WHEREAS, the Iowa Department of Transportation has proceeded through the necessary steps
to deed said property to the City of Waterloo; and
WHEREAS, the City intends to subsequently convey certain property to McDonald's USA,
LLC, pursuant to a land swap agreement; and
WHEREAS, plats of survey are currently being prepared for review by the Iowa Department of
Transportation in connection with the property conveyance process; and
WHEREAS, the Temporary Access Easement Agreement provided that the easement would
expire upon completion of the City improvements or on July 31, 2026; and
WHEREAS, the City improvements have been completed; and
WHEREAS, the parties desire to amend the Temporary Access Easement Agreement to confirm
that the July 31, 2026, expiration date shall remain in full force and effect notwithstanding
completion of the City improvements; and
WHEREAS, it is in the best interest of the City of Waterloo to approve said amendment and
authorize execution of the same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
1. The Amendment to Temporary Access Easement Agreement with McDonald's USA,
LLC, for property located at and adjacent to 2222 Logan Avenue, is hereby approved.
2. The amendment shall provide that the Temporary Access Easement Agreement shall
remain in effect until July 31, 2026, notwithstanding completion of the City improvements,
unless otherwise terminated or amended by written agreement of the parties.

3. The Mayor and City Clerk are authorized and directed to execute said documents on
behalf of the City of Waterloo, Iowa.
