HomeMy WebLinkAbout5527-12.10.1923 RESOLUTION NO. 5527 EATING ASSESSMENTS FOR PAVING STREETS UNDER CONTRACT NO. 14 BE IT RESOLVED BY TIE COUNCIL OF THE CITY OF WATE: L00, IOWA: That after full consideration of the schedule of assessments and the accompanying plat showing the assessments proposed to be made for the Jost and expenses of constructing paving on the following described streets , to-wit : West Fourth Street from t _ e end of the present paving to the city limits, a width of 24 feet . Lioir Street from the north line of Reber Avenue to the north line of Peoria Street , a width of 24 ft. Summit Avenue from the east line of Lioir Street to the west line of Sullivan Street , a width of 24 feet . Sullivan Street from the north line of Summit Avenue to the north line of West Second Street , a width of 24 feet . .halt imore Street from the south line of Eureka Street to a point 140 feet south of the south line of laitchell Avenue , a width of 24 ft. Randolph Street from the southeast line of West Iiinth Street to the north line of rant Avenue, a width of 24 feet. Wellington Street from the southeast line of West Ninth Street to the west line of Randolph Street, a width of 30 feet. Grant Avenue from the southeast line of West Eighth Street to the northwest line of lu inth Street ; also from the southeast line of . nth Street to the west curb line of Hammond Avenue , a width of 24 feet. iviaryland Avenue from the northeast line of Frederic Avenue to the West line of Lovejoy Avenue, a width of 24 feet . Independence Avenue from the west line of Idaho Street to the east line of Idaho Street. , oir Street in front of Lots Nos . 19-20-21and 5 and 6, Prospect Heights Addition upon petition and waiver of owners of property subject to assessments filed with the City Clerk and approved by the City Council June llth, 1923, a width of 24 feet . as set out in Resolution of Necessity No. 5349, which is by reference made a part hereof, and in petition & waiver of June llth, 1923, which plat and. schedule were filed in the office of the City )1erk on the 10th day of Novem- ber, 1923, of the filing of which notice has be,n published and posted as required by law and the order of this Council, and of the objections to the assessments shown in said schedule filed by T. J. Morris; Charles Burd; Mabel L. & Vernetta Baldwin; Harry V-a. Barker; C. M. Graham; Joseph L. Otto ; Frank R. Connors; Waterloo, Cedar Falls & Northern Ry. Company; G. N. Pruess ; Jake Levingston for Horton-Holden Hotel Company; Lewis Miller, Est ; Waterloo Savings Bank; Henry Rppel; J. A. Rust ; Elizabeth McKean; C. E. Rust and George E. Shoemaker, that the objections made by T. J. Morris ; Frank R. Connors; Waterloo, Cedar Falls & Northern Ry. Company; Jake Levingston for Horton-Holden Hotel Company; Lewis Miller, Est; Waterloo Savings Bank; Henry Appel and George E. Shoemaker; are found to be meritorious , and the said sche dule be and the same is hereby amended and corrected as follows: The assessment against a 300 ' strip adjacent to W 4th St. in all N W of 4th St. in NW SW Sec. 31-89-15 except bank is reduced from 45,891.53 to 3,750.00. The assessment against a 300' strip adjacent to W. 4th St. excepting the NE 477-7 ' of the following. Comm. at the intersection of the N. line of S W. Sec. 34-89-13 with the center line W 4th St . thence W along the N. line of S Wj Sec. 34-89-13 1110' thence at angle left of 140 17' - 255-6' thence on a curve to left with rad. 1146.3' - 250' to pt . on reverse curve, thence on curve with rad . 924.6 - 200' to E 4th St . - NEly center line 4th St. 677.5' to beginning is reduced from 007.04 to 0300.00. The assessment against SW 79.6' NW 300' Lot 36 Prospect Hills 1st Addition is reduced from 0517.10 to 0300.00. The assessment against Lot 28 Prospect Hills 1st Addition is reduced from $412.72 to 0333.33. The assessment against Lot 29 Prospect Hills let Addition is reduced from 0458.98 to 0333.33. The assessment against Lot 30 Prospect Hills 1st Addition is reduced from 544.97 to 333.34. - 3 - The assessment against Lot 7 Block 10 Whitney & Sedgwick Addition except Lucy Gd lbert ' s is reduced from 4537 .55 to 4469.25. The assessment against Lot 10, Block 1 , East Park Place is reduced from $242.38 to 4202.05. The assessment against Lot 10, Block 1, East Park Place is reduced from 369.83 to 4 201.00. The assessment against Lot 48, Aud. Rainbow' s Plat #4 is reduced from 473.40 to 468.25. The assessment against Lot 9 , Aud. Rainbow' s Plat #4 is reduced from 4180.44 to 95.00. The assessment against the W. C. F. & N. Right of Way on Burton Avenue is reduced from $470.96 to '4411.54. The assessment against N 25' Lot 12, Block 2, Beal' s Sub is reduced from 127.10 to 468.17 . That the objections filed by Charles Burd; Label L. & Vernetta BAldwin; Harry W. Barker; C. M. Graham; Joseph L. Otto; : . C . F. & N. :tt. R. Company; G. N. Pruess; J. A. Rust ; Henry Appel; Elizabeth McKean and C . E. ust are found to be without merit , and each and all of said objections are therefor hereby overruled. That after full consideration, appraisement and apportionment of the special benefits conferred upon the property shown in said schedule and plat of the said improvement , this Council finds that the said property is specially benefited by the said improvement in the amounts shown in said schedule as hereby amended and corrected ; and that the said amounts are in proportion to the special benefits conferred upon the propery by the said im- provement, and are not in excess of such benefits, and are,.do excess of twenty five per cent of the actual value of the lots , parts of lots and parcels of real estate shown in. said schedule. BE IT PLIRTHER RESOLVED , that the said schedule of assessments and the accompanying plat , be and the same are hereby approved as hereby amended and corrected; and that there be and hereby is assessed and levied as a special tax and assessment against and upon each of the lots, parts of lots and parcels of real estate , and the owner or owners thereof liable to assessment for the cost and expenses of the said improvement ( and the real estate and personal property of the railway and street railway companies shown therein) shown in said schedule, the respective sums expressed in figures set opposite to each of the same , as amended and corrected by this resolution, on account of the costs and expenses of the construction of the said improve- ment; and said assessments against said lots, pests of lots and parcels of real estate are hereby declared to be in proportion to the special benefits conferred upon said property by said improvement, and not in excess thereof, and not in excess of twenty-five per cent of the actual value of the same.
