BE IT RESOLVED BY TB CITY COUNCIL 02 TEE CITY OF WATRLOO, I0WA or ITS :OTION: That it is deemed advisable and necessary for proper sanitary regulations and for the preservation of the public health of the inhabitants of said city to build , construct and put in place the following lines of sanitary sewer in said city from and between the various noints and termini as hereinafter set forth and of the dimensions as hereinafter -iven: That the cost and expenses of making and constructing said sanitary sewers including the costs and expenses of such sewers or parts thereof which come on or across any street or alley intersection, and those sewers opposite street and alley intersec ions Ls but not crossing tLe same, and also the cost of all man holes, lamp holes, flush tanks , and other apputtenances,and all other items of expense incurred on the part of the city by reason of the construct ion of said sewers which under the laws of the State of Iowa are assessable shall be assessed against property abutting on the same and against the owners thereof and agains't the real estate and person- al property of any railroad company or street railway whose proeerty is abutting on said streets or avznues upon which sewers are built, all in accordance with the laws of the -State of Iowa governing the same . All assessments are to be made in accordance and in proportion to the benefits conferred soon each lot , place or parcel of ground , and an cieF/Ci4APLY setweers the cost of said sewers and the amount assessable against said property 1Q law and also one-half of the cost of the sewer opposite probert:y7 owned by the City of daterloo,Iowa, or by the United States Government , shall be paid out of a fund o be created by a special tax to be levied upon all property in the respective sewer districts in the City of daterloo,Iowal or out of the sewer fund of the sewer district of the pity of Waterloo, Iowa, available by las for this pureose. All sewers are to be built in accordance with the plans and snecifications therefore to be prepared by the City Engineer and to be approved by this Council and by the State Board of Health. All sewers shall be constructed of Standard Vitrofied Clay Sewer pipe of the internal dimensions above named , said pipe to have sealed joints and to be laid in line and grade, all as sh by said elans and specifications. The method of construction shall be by contract and the contractor shall be paid eithsr by special assessment sewer bonds or by a special assessment certificate with the deficiency in either case, if any, to be paid by city warrants drawn on the city funds, or the contractor may be paid in cash derived from the sale of the bonds or certificates as the case may be with the deficiency, if any , made up as just mentioned. Said sewer to be provided with all necessary man holes lamp holes, flush tanks and other appurtenances. Be It Further esolved that the abov , and foregoing improvements are hereby propo-,ed to be made anSt constructed as here- inbefore set forth and that this pro-nosed resolution, except this paragraph, be and the same is hereby set down for further and final hearing:, consideration and determination, at a meeting of the City Council to be held on the q TN day oi JULY) 192 3, at eight o 'cl ,ck in the Council Chamber in said city, and that the City Clerk be and he is hereby instructed to cause notice of the pendency of the above resolution and the time and place where and when the same will be submitted for passage,and objections to the passage thereof, and to the construction of said proposed improvements heard, to be given by publication in the tilaterloo Evening Courier and the Saterloo Tribune , newspapers of general circulation published in the City of Ylaterloo, Iowa, in the manner and for the time provided by law. The above resolution was approved and ordered placed on file for final action and notice of the pendency thereof ordered given this llth day of June , 1923. Approved A-41e : 37 or erk.
