ORDERING CONSTRUCTION OP ITED OV E T > AND
DIRECTING AD ERTI9'EMENT FOR BIDS THEREFOR.
Be it resolved by the City Council of the of �.�t�i T ?C aterloo,Iowa, ;
That pursuant to a resolution of necessity proposed at a
meeting of this Council on the 31st day o f May, 1923, and duly passed by
this Council at a meeting held on. the 18th day of June, 1923, it is here-
by ordered upon motion of t his Council without petition of prorerty own-
ers that the improvements described in said resolution of necessity, which
is made a part hereof by reference, consisting of the hereinafter set out
paving, curbing, guttering, on the hereinafter named streets, be and the
same are hereby ordered constructed to-wit :
The following name( street and avenues shall be paved and
curb and gutter laid along the side thereof for the length and for the
width and from and between the various points and termini as hereinafter
set out :
Commercial street from the northwest line of West Fourteenth
street to the northwest line of Eighteenth street twenty-four feet wide ,
and Commercial street from the northwest line of Eighteenth street to
the east curb line of LaPorte Road eighteen feet wide , and LaPorte Road
from the southwest curb line of Commercial street to the City limits
eighteen feet wide.
Kimball avenue from the southeast line of West Fourth street
to the north curb line of Mitchell avenue twenty-four feet wide and from
there to the City limits eighteen feet wide.
Logan avenue from the north line of the Waterloo Cedar Falls;
Ro Northern Right of Way at the end of the present paving on Logan avenue
to the City limits twenty-four feet wide .
-parker street from the east line of Burton avenue t'o the west
curb line of Cedar Bend street twenty-four feet wide and Cedar Bend street
fm m the south curb line of .2 rker street to the city limits eighteen
feet wide.
Lafayette street from the end of the paving thereon to the
city limits, the end of the present paving being about thirteen hundred
feet northwesterly from the city limits , said paving being eighteen feet
wide.

The pavement on said streets shall be constructed of one
or more of the following materials: sheet asphalt; asphaltic
concrete ; bitulithic ; tarvia ; portland cement concrete single
course ; portland cement concrete two course ; vibrolithic concrete
paving ; vitrified brick block.
That the curb and gutter to be constructed on each side
of such pavement shall be of either standard or 0-Gee type or
plain concrete curb.
That the above set out paving shall also include the pav-
ing of tip intersections at all intersecting streets and alleys
along the streets to be paved.
All of said paving, curb and &rutter are to be constructed
in strict accordance with the plans anc specifications therefor
to be prepared by the City Engineer and to be approved by this
Council.
That the cost and expenses of making and coyr t ruc t ing said
improvements shall be assessed upon and against the lots or tracts
of land in each of the five paving districts neretofor established
by this Council , and against the railway and street railway com-
panies whose tracks , station grounds or rights of waylocated are
within said_ Oistri cts , each of which shal be assessed to pay the
costs of the improvements in its vicinity so far as possible .
That after the completion of the improvement contemplated
herein there shall be levied upon all taxable propertz

City of Waterloo excepting moneys and credits , an annual tax for

tory thereto .

Paving district No . 1 , being the property lying along and con-
` tituous and to Commercial street and La Porte Road.
_Paving District No . 2, being the property lying along and con-
tiguous to Kimball avenue .
Davits District o . 3, being the property lying along and con-
tiguous to Logan avenue .
paving District No . 4, being property lying along Darker street
and contiguous thereto .
Paving District o . 5 , being the property lying along Lafayette
street and contiguous thereto.
That a description of the metes and bounds of each of said
paving districts is hereinafter set out as follows :
DISTRICT NO. 1
Shall comprise the territory embraced within the following d is-

Commencing at a point in the center line of Commercial street
150 feet northwest of the northwest line of Fourteenth street ; running
thence northeast to the center of the alley northeast of Commercial
street ; thence alon:=, the center line of the alley northeast of Com-
mercial street to the center line of LaPorte street ; thence south to the
center line of Front street; thence east to a point 300 feet east of the
east line of LaPorte street ; thence south on a line parallel with and
300 feet east of the east line of the LaPorte street to the City Limits ;
thence west along the c ity limits line 666 feet; thence north on a line
parallel with and 300 feet we >t of the west line of LaPorte street to the
center line of Hawthorned avenue ; thence east 150 feet ; thence north on
a line 150 feet west of and Parallel with the west line of LaPorte street
to the center line of Jefferson street ; thence northwest along the center
line of Jefferson street to a line which is 300 feet west and parallel
with the w , t line of La_,orte street ; thence north on a line 300 feet
west and parallel with the west line of LaPorte street to a line which is
the extension of the center line of the alley southwest of Commercial
street ; thence northwest along said center line of the alley southwest of
Commercial street to a point 150 feet northwest of the northwest line of
Fourteenth street ; thence northeast to the place of beginning.
Said paving district being located in the east 2 of section 36,
and the south of section 25, Twp 89 North of the 5th .�'

district .
Commencing at tue center line of 7illist on avenue and the north
and south center line of blocks 1 and 7 of Browh Hall Add ition; thence
south along the north and south center line of blocks 1 and 7 of Bros
Hall Addition to the south line of Forest avenue; thence east along g the

line of Kimball avenue ; thence south on a line which is 300 feet east
of and parallel with the east line of Kimball avenue to the City limits ;

Be it further resolved that the City Clerk be and he is here-
by ordered and instructed to advertise for proposals for the construc-
tion
of the improvements above described , the said improvements to be-
constructed in strict accordance with the plans and specifications
therefor to be prepared by the City Engineer and to be approved
proves. by
this Council . The work to be commenced on or before the 30
ths ay of
June, 1923 and to be fully completed on or before the 1st day of
November, 1923 .
That payment to the contractor will be made in special assess-
ment street improvement bonds , bearing interest at the rate of 6% per
annual, issued in accordance with the provisions of Chapter 8, Title V
of the Code of Iom and acts amendatory thereto , to the extent that the
cost of said improvement is assessable against the lots and tracts of
land embraced in the paving districts hereinbefore describ d ! the cost
in excess of the amount to be assessed ao.ains v the privately owned

provement bonds issued in accordance with the provisions T' r

ter 8-A of the Code of Iowa and acts amendatory thereto levy for which
is to be made a, „ainst all taxable pro rerty in the City of Thterloo ,
moneys and credits excepted as provided in section 84C-0 of the 1915
Supplemental Supplement to the Code of Iowa and acts amendatory thereto .
Be it further resolved that the proposals received for the
construction of said improvements will be opened by this Council at a
meetinv to be held in the Council Chamber in said. City on the 3Crtk .day
of V ti Sa 1923, at MIKE o' clock /4.T1 ., and acted upon at
that time, or such later time as may be then fixed, said proposal to
be accompanied by a certified check in a separate envelope , payable to
the order of the City Treasurer in an amount elual to 10% of the bid.
'aid check shall be security that the bidder will enter into a contract
for the doing of the work if he gets the same and will give the bond
required by section 814 of the Code as amended .
Be it further resolved that the City Clerk be and he is here-
by ordered and d irected to advertise for bids for the making of such
improvements to be receives at the time and place, hereinbefore specified
that each bid shall be accompanied in a separate envelope with a cer-
tif ied check as hereinbefore set out as security that said contractor
if successful will furnish the required bonds in the amount and firm pro-
vided for in the specifications for said work which bond includes a
provision requiring the contractor and his bondsmen to keep said im-
provement in D..00d repair for the period' of 4 years from and after the
completion and acceptance of said work and requiring him to pay the
laborers and persons furnishing material therefor and to carry work-
men' s compensation insurgnce, all as provided by the Code of iova.
Passed and adopted. by the Council of the City of Waterloo,
Iowa , this lath day of June , 1923.
