and found that the residents are overwhelmingly against developing the green space and will
not support the resolution.
Mr. Salamanca stated he also visited the property and that he too feels the property exhibits all
aspects of a park and will not support the resolution.
Mr. Simon commented on the petition filed and input from the residents in the area.
Ms. Creighton -Smith questioned the expense to the city for maintenance.
Todd Derifield, Leisure Services Director, estimated a couple of thousand dollars a year for
mowing along with a maintenance contract for the wetland area through the Iowa Department of
Natural Resources.
Ms. Creighton -Smith suggested, due to the upkeep, the city should consider declaring this as a
city park and questioned what the development would entail.
Noel Anderson, Community Planning & Development Director, explained the potential
developer would like to build a single-family home valued at $430,000.00 on the property for
resale.
Mr. Schmitt requested an overview of the history of the property.
Mr. Anderson explained the parcel was set aside for potential park purposes, but that the city
has never recognized it as a city park. City staff has worked on and maintained the drainage
way and wetland areas and would continue to own the wetland areas if sold. Noel Anderson
stated part of their duties are property management and to create an additional tax base and
that this parcel meets those needs while still maintaining green space.
Mr. Schmitt stated he is sympathetic to the residents, but is a proponent of infill housing and
feels this space should have a home on it.
Mr. Morrow stated that both the DNR and the city have spent funds to develop a watershed
area.
Mayor Boesen stated that if sold, the watershed area would remain. The residents offered to
help maintain the property with the city, but the Mayor does not believe this is a viable offer.

with the high school.
Jaime Knutson, City Engineer, confirmed there is a 60/40 split with the high school with no
grant money.
Mr. Salamanca questioned if an invoice was presented by the schools for their portion of the
project.
Mr. Knutson explained that once invoices are received, a reimbursement request is sent to the
schools for their portion and that he has submitted a request to the schools for the design
portion of the project.
Mr. Morrow questioned how long it typically takes to receive a response to requests.
Mr. Knutson explained he has not had to submit a request of this nature, so he has no
timeframe to reference.

Mr. Simon questioned if this was in the original school budget or if this was an additional cost.
Mr. Knutson responded this was an additional cost as he would not have had the amounts until
MidAmerican submitted their invoice, but that an estimated amount was included in the budget
in the design portion.
Mayor Boesen requested a clarification of the streets included in this agreement.
Mr. Knutson clarified that this agreement is for Katoski/Greenhill and the other one would be

the contract.
Jackson Dewitt, St. Michael, Minnesota, Axon Enterprise, Inc., gave an overview of the

M. Bailey, Sr., 325 E. Park Avenue, questioned if any competitive bids have been entertained or
if there is any relief funding to help with the cost.
Robert Duncan, Chief of Police, explained their department has been working towards this
agreement since 2021, including RFP's and that Axon's technology stood out all along. Chief
Duncan stated that all automatic traffic enforcement funds are going towards paying for the
equipment/technology, roughly $300,000.00 per year.
Mayor Boesen stressed that law enforcement agencies have moved to Axon due to the quality
of the product and, as a city, we do not want to go backwards in protecting the citizens and

Dennis Harbaugh, 6145 Kimball Avenue, questioned the specific Waterloo Police Department
policy regarding activation of body cameras when approaching an individual without engaging
their weapon.
Chief Duncan stated the policy, when interacting with the public, the cameras should be on, but
that each individual case is looked at separately. On calls for service, the policy is that cameras
shall be activated. Chief Duncan further explained that random audits are performed each
month and that if it is found that cameras were not turned on, disciplinary action is taken.
Mayor Boesen questioned if dash cameras are activated after a certain speed.
Chief Duncan confirmed dash cams are automatically activated if the speed is over 70 mph.
Aaron Stacey Roberts, 411 Almond Street, questioned policy regarding disciplinary action if
cameras are intentionally turned off.
Chief Duncan explained if officers are speaking with the public the cameras should be on, but if
they are speaking with other officers or experiencing a traumatic incident, they are allowed to
shut the cameras off.
Mayor Boesen explained cameras can also be activated remotely and watched live by the
Watch Command.
Aimee Ellingson, 810 Conger Street, questioned abuse of the tools by the police department.
Mayor Boesen clarified that the Waterloo Police Department does not use Flock Cameras.
Jay Grote, 2229 Edgemont Avenue, stated the city signed a contract with Flock in 2021,
coinciding with a contract with Axon, and requested Jackson's address for the record. Mr.
Grote also questioned the retention and storage of video and the use of that video in
subsequent investigations.
Mr. Dewitt gave his address as 2616 Kenwood Avenue, NE St. Michael, Minnesota. Mr. Dewitt
explained Axon does not house or have access to video, that it is owned by the City of Waterloo
and controlled by their policies.
Jeff Grell, 4422 Harbin Drive, questioned if the public could have input on the policies regarding
equipment.
Chief Duncan responded that all policies are available on the police department's website, but
that they don't have a specific organization that puts forth policy suggestions. Chief Duncan
further explained they do employ Lexipol to help develop PD policy.
Marla Fagan, 1146 Ackermant Street, would also like to see the community or a board to
provide input on the policies regarding this equipment.
Mr. Morrow thanked Assistant Chief McClelland for the extensive work and presentation in
regard to the equipment contract and feels this is the best solution for this program and
capabilities.

Ms. Creighton -Smith agrees that the public should share in input of policy for the program to
give consideration to all demographics.
Mr. Salamanca questioned if camera footage is public record and asked if this is an extension
of the contract as opposed to a new contract.
Chief Duncan confirmed it is public record unless it is a criminal case and that this is an
extension to the contract with annual upgrades.
Mr. Salamanca questioned if, during the five years, the current system has been used, if there
have been any failures.
Chief Duncan stated the system is state of the art and that they have not experienced any
failures in the system.
Mr. Salamanca stated he feels having this technology is a win -win for the city and the citizens
having access to video.
Ms. Creighton -Smith questioned if this included updated equipment.
Assistant Chief McClelland confirmed that this not only extends the contract to 2027, but that it
also provides for replacing/updating equipment during that period.

research the budget for this department, any deficiencies and if the department was operating
efficiently and in a fiscally responsible manner.
Ms. Berry stated she feels this issue is not about the person, but the requirement for local
authorities' maintenance of an independent Civil Rights Commission to be changed by the
State of Iowa from "shall have" to "may have" a Civil Rights Commission and the consequences
on the city's existing ordinance and if that had been changed since the governor signed the bill
