OF REINBECK, IOWA, FOR THE F.Y. 2010 RIVER RENAISSANCE LOWER PLAZA, CONTRACT NO. 763 , IN THE AMOUNT OF $3 , 189, 424 . 95 . BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That the bid of Peterson Contractors, Inc . of Reinbeck, Iowa, in the amount of $3 , 189, 424 . 95, for the construction of the F.Y. 2010 River Renaissance Lower Plaza, Contract No. 763 , described in the plans and specifications heretofore adopted by this Council for said project, after public hearing on published notice required by law, be and is hereby accepted, the same being the lowest bid received for said work. The Mayor Pro Tem and City Clerk are hereby directed to execute contract with the said contractor for the construction of said improvements, said contract not to be binding on the City until approved by this Council . Their bids and their proposed M/WBE subcontracting percentages are listed below: DAVID JONES Base Bid M/WBE % {lr'ard I PCI, $3,189,424.95 0% CAROLYN Cunningham Construction $3,431,549.53 $22,572.00 or.006% COLE Vieth Construction Corp. $3,596,334.30 0% :Ward 2 :3AROLD The City's M/WBE Contracting Policy is triggered at the $50,000 threshold. There were GETTY no WBE bidders who submitted bids to prime contractors. Two bidders, including the Kard3 apparent low bidder have elected to self-perform all segments of the project. The second apparent lowest responsive bidder had less than 1%MBE participation. The difference in HART IN M. the apparent low and next apparent low bidders' bids is approximately$245,125.00. The Ward 4 MBE subcontractor quote of$22,752 is roughly 9% of the amount of the difference in PCI's and Cunningham's bids. RON WELPER In the past I have used the a formula many jurisdictions used whereby if the second lowest hard 5 bidder's bid includes M/WBE participation and "...the bid does not exceed by more then BOB 3%to a maximum of$10,000 any other lowest and otherwise qualified bidder and if in the GREENWOOD opinion of the (City) the selection of such bidder as the lowest and best bidder will have At-Large the greatest potential among bidders for providing equal opportunity to local minority STEVE group member and women... " Where these facts do not exist,then it might be appropriate SCHMITT to find Good Faith on the part of the apparent low bidder who has 0%participation or At-Large lesser participation. Here the MBE participation is extremely small when compared to the total contract amount, and more significantly,the $245,125.00 difference in PCI's and Cunningham's bids far exceeds the"3%to a maximum of$10,000" spread between low bidder and second lowest bidder. Accordingly,under the particular facts and circumstances here, I conclude"Good Faith" has been established. Summary Statement At the City Council meeting on February 22, 2009, bids were opened for the F.Y. 2010 RIVER RENAISSANCE LOWER PLAZA, Contract No. 763,with PETERSON CONTRACTORS, INC., of Reinbeck, Iowa, as the apparent low bidder. The Contracts and Grants Coordinator has reviewed the items relating to the 2002 Contract Compliance Program requirements and has transmitted his recommendation in the attached letter.
