RESOLUTION NO. 2026-459
RESOLUTION APPROVING AN ENCROACHMENT
AGREEMENT WITH DAVID KNIPP TO ALLOW
DECORATIVE ROCKS WITHIN THE PUBLIC RIGHT-
OF-WAY OF BERTCH AVENUE AND WEST 7TH
STREET, AND WITHIN THE CITY ALLEY ABUTTING
902 BERTCH AVENUE TO THE SOUTH, FOR
PROPERTY LOCATED AT 902 BERTCH AVENUE,
WATERLOO, IOWA, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID
AGREEMENT.
WHEREAS, David Knipp has requested approval of an Encroachment Agreement to
allow decorative rocks within public right-of-way adjacent to the property located at 902 Bertch
Avenue, Waterloo, Iowa; and
WHEREAS, the subject property is located at the intersection of Bertch Avenue and
West 7th Street in the "R-2" One and Two -Family Residence District; and
WHEREAS, the applicant has placed approximately twelve decorative rocks within the
public right-of-way along Bertch Avenue and West 7th Street and a pile consisting of
approximately fifty-nine rocks within City right-of-way in the alley abutting the subject property
to the south; and
WHEREAS, the decorative rocks serve an aesthetic purpose and have been located in the
respective rights -of -way for multiple years; and
WHEREAS, the City Council finds that the requested encroachment may be permitted,
subject to the terms and conditions of the Encroachment Agreement and the City's continuing
right to use, maintain, improve, and regulate its public rights -of -way.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA,
1. That the request by David Knipp for an Encroachment Agreement to allow
approximately twelve decorative rocks within the public right-of-way along Bertch Avenue and
West 7th Street, and approximately fifty-nine decorative rocks within the City right-of-way in
the alley abutting 902 Bertch Avenue to the south, is hereby approved.
2. That the Mayor and City Clerk are authorized and directed to execute said document
on behalf of the City of Waterloo, Iowa.
PASSED AND ADOPTED this 17th day of August 2026.
