RESOLUTION NO. 2008-756 RESOLUTION MAKING AWARD OF CONTRACT TO ADVANCED ENVIRONMENTAL TESTING & ABATEMENT, INC. OF WATERLOO, IOWA, FOR THE ASBESTOS REMOVAL, RATH ADMINISTRATION BUILDING, CONTRACT NO. 131-AR-09-2-08-GO, IN THE AMOUNT OF $237, 000 . 00 . BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That the bid of Advanced Environmental Testing & Abatement, Inc. of Waterloo, Iowa, in the amount of $237, 000 . 00, for the Asbestos Removal, Rath Administration Building, Contract No. 131- AR-09-2-08-GO, described in the plans and specifications heretofore adopted by this Council for said project, after public hearing on published notice required by law, be and is hereby accepted, the same being the lowest bid received for said work. The Mayor and City Clerk are hereby directed to execute contract with the said contractor for the construction of said improvements, said contract not to be binding on the City until approved by this Council . (See attached letter from consultant with bid tab). Staff also requests Ward 3 that the Mayor or his designee execute the Contract. QUART TIN M. Abatement Contractors Bid Pricing: Contractors were asked to tender price offerings. a. Base Bid — Contractors were asked to submit on removing asbestos containing materials throughout the project based upon a pre-set timeframe submitted by them. b. Rate Sheets — Contractors were asked to provide standardized rate pricing for additional work if required or needed,outside of the original scope of services. This allows the County to have "pre-set pricing" for items on the onset of a project, rather than attempting to negotiate during the work. c. Alternate Bid—No alternates at this time. 2. Asbestos Contractor List Discussion: Of the twenty six (26) invitations, thirteen (13) contractors attended the walkthrough with six (6) responding with bids. The pricing was evaluated. See attached bid sheet as provided by you and the City. 3. Asbestos Contractor Evaluation of Bids and Recommendations All submitted contractors are listed with the State of Iowa. Each contractor is in good standing with the Department of Labor and the IA DNR. All submitting contractors received both addendums. Continued AETA has been in business for eleven (11) years. The company is incorporated in the State of Iowa. The past four years, the company has mainly worked in Iowa and Illinois. Its' bonding company at the time of the bid was unlisted and AETA submitted a certified check in lieu of a bid bond. Alloy Specialty would recommend to the City of Waterloo to accept AETA's bid offering. This offering is the best value to the owner. Acceptance of the bid should be provided only on the basis that within 1 week of notifying AETA,AETA can provide the City of Waterloo a performance bond for the project. If AETA cannot provide this document, then the next best valued Contractor,Great Plains Asbestos Corp. should be retained. 5. Next Steps The contractor should be notified verbally and then a written notice of bid acceptance after the City of Waterloo's City Council meeting. Execution of the contract enclosed within the bid should be completed by the contractor and submitted to the city within 48 hours of notification of award. AETA then has 10 calendar days to provide the City of Waterloo a performance bond for the project. AETA should also be advised to submit the proper asbestos remediation notifications to IA DNR and IOSH. Both notifications should also be forwarded to the City of Waterloo. All bidders should be notified, in writing, within 5 business days of the decision of the council. All bidders should be reminded that the bids are held for 60 days. The City of Waterloo now needs to restore an electrical hookup and water accessibility to the property by September 17,2008. The contractor will be responsible for utilities from the City designated point to the building. The City is responsible for all costs of utility usage. As we move forward together, Alloy Specialty will make every effort to keep the lines of communications open with all parties involved.
