RESOLUTION APPROVING ACCEPTANCE OF PROPOSAL
IN THE AMOUNT OF $62, 274 . 20 FROM ACCO
UNLIMITED CORPORATION IN CONJUNCTION WITH THE
BYRNES SWIMMING POOL PAINTING PROJECT.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the proposal in the amount of $62, 274 . 20 from ACCO Unlimited
Corporation in conjunction with the Byrnes Swimming Pool Painting
Project, be and the same is hereby accepted.
PASSED AND ADOPTED this 28th day of September, 2009 .

HAROLD I would like to set the date of hearing and contract award for the above-referenced
GETTY project for September 28, 2009.

QUENTIN M. This project is a continuation of Gates and Brynes Pool Renovation. Gates Pool was
HART completely painted along with the filter replacement last year. We advertised for bids
`°r'a on the project and only received a singe bid from Acco of Johnson, Iowa.

WELDER Acco has submitted a proposal for the painting of Brynes Pool at the same square
Ward s footage cost of$2.78. I recommend that we move forward with the painting and
BOB caulking of Byrnes Pool for a total cost of $62,274.20.
GREENWOOD
At-La-e State law established the threshold of$65,000 for vertical infrastructure improvement
STEVE projects before the project has to follow the formal bid process as outlined by state law.
SCHMITT I have enclosed with this memo the "Bid and Quote Threshold Summary" from the
At-Large state, bid proposal from Gates Pool and the project proposal from Acco for Byrnes
Pool.

Bid and Quote Thresholds for Iowa Cities and Counties
Background
Iowa Code Section 314.1 B establishes horizontal and vertical bid threshold subcommittees that meet at least every other
the bid and quote thresholds for city and county projects. Effective Jan. 1,2009,these thresholds are as follows.

Definitions
• Construction, reconstruction or improvement
For horizontal infrastructure,these terms are as defined in 761 Iowa Administrative Code Chapter 178. For vertic2
these terms describe work that results in a betterment to a facility by improving either the original design of the facility
the facility.
• Repair or maintenance
As defined in 761 Iowa Administrative Code Chapter 180.
• Competitive bid threshold
The maximum estimated total cost of a road, bridge, culvert, or other public improvement project for which a public adv
bid letting is not required.
• Competitive quote threshold
The maximum estimated total cost of a public improvement project, other than a road, bridge or culvert project,for whit
competitive quotation process is not required.The competitive quotation process is prescribed by 761 Iowa Administ
Chapter 180.
• Governmental entities
As defined in 761 Iowa Administrative Code Chapter 180.
• Horizontal infrastructure
Any publicly owned road, bridge or culvert.
• Public improvement

Paint and Caulk Project Contract
Byrnes Pool
ACCO RESPONSIBILITIES:
Sweep blast(not bare blast) and paint Byrnes swimming pool with 2
coats of Ramuc epoxy white paint. Application of black epoxy 6-6"
racing lanes and 12-6"targets.
Caulk 660 linear feet on deck and pool ledge at Byrnes pool.
City of Waterloo to provide sales tax exemption certificate.
ACCO guarantees that we will perform the above described job with professional workmanship in accordance with the
best standards of the trade and in accordance with the specifications. In the event that a defect in workmanship or
materials supplied by ACCO appears within one year from date of completion of the installation,ACCO will repair the
same without cost to the Customer,providing that Customer has complied in full with all terms of payment and other
conditions of this agreement Products,equipment and accessories manufactured by others are specifically excluded
from ACCO's material guarantee. Such items are subject to manufacturer warranty.
ACCO makes no other guarantee,express or implied. ACCO shall not be responsible for defects or damages of any
kind or character to the installation caused by other contractors or tradesmen employed by Customer,or by improper
maintenance or neglect by Customer.
Contract Price: $62,279.20
Full payment due upon completion-no later than October 23, 2009.
Subject to acceptance September 21, 2009_
A finance charge will applied to any account,where full payment is not made on the date specified in this agreement.
The finance charge will be at the periodic rate of 1.5%per month,which is an ANNUAL PERCENTAGE RATE of 15%.
Should ACCO be required to initiate legal proceedings to collect any balance due under this agreement,Customer agrees to
pay reasonable attorney's fees,cost and incidental expenses incurred in such proceedings.
Acceptance
In witness whereof,the parties have executed this Agreement on the day of
2009,in accordance with the acknowledgment, consent or approval of a majority of the Council. The
undersigned has full authority to bind this Agreement and does so upon its direction.

Filter Replacement & Painting Project Contract
ACCO RESPONSIBILITIES:
Installation of the new Horizon sand filter system at Gates pool.
Provide all piping, valves, gauges, levers, backwash sight glass, etc.,
necessary for the operation of the filter system.
Reuse DE tanks as surge tanks with new SS strainer basket assemblies
at Gates pool. Spare strainer basket not included.
Sweep blast (not bare blast) and paint Gates swimming pool with 2
coats of Ramuc epoxy white paint. Application of black epoxy 6 - 6"
racing lanes and 12 -6" targets. Inspect and check weld connections.
If any repairs are needed, it will be done on an additional time and
materials basis.
Caulk 550 linear feet on deck and pool ledge at Gates pool.
Inlet repairs at Byrnes pool will be done on a time and materials basis.
When plans are submitted to the state for approval and the state
requires additional work outside the scope of the filter installation
documents, the owner will be responsible for the additional cost.
City of Waterloo to provide sales tax exemption certificate.
ACCO guarantees that we will perform the above described job with professional workmanship in accordance with the
best standards of the trade and in accordance with the specifications. In the event that a defect in workmanship or

Progress payments due at end of each month with 5%
retainage due net 30 days after completion.
