RESOLUTION NO. 2008-910 RESOLUTION MAKING AWARD OF CONTRACT TO LEHMAN TRUCKING AND EXCAVATING, INC. OF WATERLOO, IOWA, FOR THE GENERAL OBLIGATION BOND DEMOLITION PROJECT (WATERFALLS CAR WASH) , CONTRACT NO. 160-D-EDI-10-06-08, IN THE AMOUNT OF $15, 500 . 00 . BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That the bid of Lehman Trucking and Excavating, Inc. of Waterloo, Iowa, in the amount of $15, 500. 00, for the General Obligation Bond Demolition Project (Waterfalls Car Wash) , Contract No. 160-D-EDI-10-06-08, described in the plans and specifications heretofore adopted by this Council for said project, after public hearing on published notice required by law, be and is hereby accepted. The Mayor and City Clerk are hereby directed to execute contract with the said contractor for the construction of said improvements, said contract not to be binding on the City until approved by this Council . Contract No. 160-D-EDI-10-06-08 - Waterfalls Carwash SCHMITT Ward i Dear Mayor and Council: CAROLYN COLE Staff is seeking authorization to Award the above referenced contract to Lehman Trucking Ward 2 and Excavating for the Mayor or designee to execute the same. There were two bids received for this project, they are listed below: HAROLD GEIIY Ward 3 Central States Contracting, Inc. $ 8,949.76 Lehman Trucking&Excavating, Inc. $15,500.00 QUENTIN M. Ward 4 HART Although Central States was the apparent low bidder, staff recommends that the bid be rejected as "non-responsive"based upon the unanimous opinion of several City RON Departments who experienced a myriad of problems with Central States work on Contract WELPER No. 142- D-GO-02-24-06-VGM involving the demolition of two homes in connection Ward s with the Ansborough Interchange and VGM Expansion Projects. The problems included, BOB among other things: failure to timely obtain permits, failure to send proper notifications, GREENWOOD possible misleading statements to Building Inspections and other personnel, failure to At-Large timely respond to disputes between subcontractors and Central States, and failure to timely STEVE respond to numerous follow up calls and emails from the undersigned and Building SCHMITT Officials regarding the progress of the project and resolution of issues stated herein. At-Large In general, a"Responsible Bidder"is defined as: "A bidder whose reputation,past performance, and business and financial capabilities are such that the bidder would be judged by an appropriate authority as capable of satisfying an organization's needs for a specific contract." On this charge, the undersigned and all other relevant City Departments do not find Central States to be a"responsible bidder,"and therefore rejects it's bid.
